US: Judge rules Arizona must recognise man’s marriage to deceased spouse

A federal judge ruled on Friday that Arizona, despite its ban on same-sex marriage, will have to provide benefits to a gay man who lost his husband to cancer last month.

Represented by Lambda Legal, Fred McQuire went to court Friday to have his name listed on George Martinez’s death certificate in order to be eligible to receive Martinez’s Social Security and veterans benefits.

The judge issued a quick ruling in McQuire’s favor.

McQuire and Martinez, who had been together for 45 years, married this summer in California as part of Martinez’s final wishes.
