US: Miami judge overturns Florida’s same-sex marriage ban

A Miami judge has overturned Florida’s ban on same-sex marriage in a ruling that impacts Miami-Dade County.

The ruling, issued Friday by Circuit Judge Sarah Zabel, was immediately stayed by the judge to allow for appeals.

This ruling follows a similar ruling by a Florida Keys judge who ruled in favour of same-sex marriage on 17 June.

Both rulings found the same-sex marriage ban approved by voters in 2008 is in violation of the constitutional guarantee of equal protection under the law.

Attorney General Pam Bondi filed an immediate appeal against the Florida Keys ruling on 18 June. 

A Florida judge denied a request on Monday to permit same-sex marriages while the appeal is pending.

The US 3rd District Court of Appeals also refused to override the decision yesterday.
