Congressional Race in California Draws a High-Profile Cast

, Calif. — With competitive races in a rarity in California, the unexpected availability of a seat here has set off a sudden and furious chase, with at least a and a mélange of political styles and personal .

California’s 10th , a sprawling made up of a collection of suburbs east of , has been represented since 1997 by Ellen O. , a who resigned after being confirmed on June 25 to a top post in the .

The field to succeed her includes the governor, two state , a decorated who is openly and a former newspaper reporter. And that does not even include the candidates in this Democratic-leaning district.

The crush of , said Henry , a professor and of the school at University of California, Berkeley, might stem in part from the of the district, which extends from the liberal Bay Area to more territory inland.

“These seats don’t come available very much, and the reason is very simple: geography,” Dr. said. “The are primarily on the coast, and the are in the and the mountains, so it’s very hard to build a competitive district. But this has the potential to be one.”

The governor, John Garamendi, is considered the early favorite to replace Ms. . Mr. Garamendi, a who had considered for governor next year, said he opted instead for in large part because of the abbreviated campaign. A primary, followed by a special election, to complete Ms. ’s term must be held within 126 days of the governor setting the date. Gov. Arnold Schwarzenegger issued a proclamation Friday declaring Nov. 3 the date for the special election.

“I thought, How am I going to spend two valuable ?” said Mr. Garamendi, 64, who previously served as the of interior in the as well as the California’s first elected commissioner. “Am I going spend two years dialing for dollars, or am I going to spend out ringing doorbells and person to person and the other 20 months working on issues?”

Mr. Garamendi’s principal among the , some show, are Mark James DeSaulnier and Assemblywoman Joan Buchanan. Both were elected to their posts last fall.

Mr. DeSaulnier, 57, is a former mayor, city and , who says his comes in spite a devastating with : a involving his father, Judge Edward J. DeSaulnier Jr., who was removed from the of the and disbarred in 1972 after being accused of rigging a sentence for the Mafia. The older Mr. DeSaulnier was never charged with a crime but was disgraced nonetheless and committed in 1989.

“I’ve been very affected by my father’s journey,” said Mr. DeSaulnier, who worked as a before for office. “And I’ve loved my public life.”

The rest of the Democratic field is not as well known, though one candidate has attracted some : Anthony Woods, a 28-year-old graduate of the United States Military Academy at and a of the war who was awarded the for two tours of duty. Shortly after his return from combat, while at working toward his master’s degree, Captain Woods told military that he is , resulting in an .

While considered a long shot for the , Mr. Woods would be the first openly in , though he has been careful on the to trumpet more than his .

WASHINGTON - Anthony Woods says he grew up without , struggled to get an and fought in , a war he didn’t believe in.

Voter ‘animus’ to be issue in Calif marriage case

When the U.S. overturned an amendment to the Colorado that outlawed protections for , same- could not enter into civil or anywhere in the nation, much less get married.

But as they seek to persuade a to strike down California’s ban on marriages, for two unmarried are using that 13-year-old decision as their road — one they expect will eventually the high court to take up the issue.

In the , Romer v. Evans, the majority held that voters’ dislike of and the laws that several cities had approved to shield them from motivated the state amendment. Such “,” it said, was incompatible with the section of the U.S. that requires the government to treat its equally absent a compelling reason to do otherwise.

The behind the challenge to California’s Proposition 8 plan to argue during a Thursday that by stripping of the right to wed, the voter-approved ban runs afoul of America’s founding framework in the same way — and for the same reason.

“Romer is a strikingly similar situation to what we have here. You had a ballot , a majority of the , taking away a right,” said Theodore J. Boutrous Jr., a member of the legal team by former U.S. General and trial . “And there was no or rationale other than by that majority of that group.”

U.S. District Vaughn R. Walker on Tuesday issued a tentative order to fast-track the case in his court.

Among the questions he said he wants covered at trial are whether is unchangeable, if permitting same- “destabilizes” traditional and whether Proposition 8’s ballot history demonstrates the measure had “discriminatory intent.”

California , a in the case, has sided with rights and declined to defend the ban, which overturned a California ruling that had legalized same- marriages. The state five weeks ago upheld the measure, saying it represented a valid of voters’ authority to amend the California .

Proposition 8’s sponsors, a coalition of religious called Protect , has been given permission to intervene in the federal case. In court papers, the group’s rejected the that anti- fueled the November measure and that the 1996 was applicable.

“Nothing in , either Proposition 8 or otherwise, indicates that harbor towards and individuals,” they wrote.

Since the U.S. ’s 6-3 decision, for rights and Christian have debated whether the Romer decision could be used to expand rights. The ruling marked the first time the determined that the ’s guarantees extended to and .

“The basic point of Romer is that government cannot ever out of toward a group of , and whether that is in the context of or anti- law, the point carries over,” said Suzanne Goldberg, who worked on the case and now directs ’s and Gender Law Program.

A Long Road Traveled

The I got as close to the as I did this week was many years ago— after the riots, when I was a 13-year-old from St. Margaret’s School in Lowell, Mass. We spelling bee kids didn’t make it into the that day—we stood outside as spoke to us from a . By then I already knew I was . Raised in a staunch Catholic home and taught (and tormented) by , I was certain that an open (that was the only term I knew back then) could never be allowed inside the . I knew nothing of the nascent -rights movement—it ’t reached Lowell in 1975. All I knew was that that whatever words there were to describe what I was, it would have to be suppressed forever. I assumed that I would have to either become a priest or figure out some other way to hide.

Thankfully, time marched on, and I eventually became a politicized college student rather than a candidate for the —and ultimately I kicked open my closet door and came out. But I can’t help thinking about that as I the reel of yesterday’s visit to the in my head. As the of , an for senior citizens, I was invited, along with some 200 other leaders, to join the Obamas in commemorating —which falls this year on the of the Stonewall riots.

I was accompanied by three : a couple who are 86 and 91, who reminisced about voting for and described as “the most inspiring since ,” and a and founder of the Liberation Front, an group formed in the , who proudly chose his over the worn by every other man in the room.

Apart from celebrating, we had gone to the to make a point: that older have to be included in the for progress. And we did what we came to do, with one of our (the ) even receiving a personal meeting with the and Mrs. . But as I stood with my , in the front row, some five feet from the presidential podium, I realized how intensely personal this experience was for me. I thought about how each member of the has had our own life’s journey—and each of us was moved deeply and differently by that moment.
