Married lesbian couple seeks protection in India

LUCKNOW: Even as the country debates pros and cons of legalising the same sex marriages and the Central government finds itself in a fix over the issue, a lesbian couple tied nuptial knot defying all social norms in Muzaffarnagar, known for honour killings and fundamentalist diktats by caste-based panchayats.

This is not all. Two days after the incident hit the headlines, the Muzaffarnagar district administration received another application for same sex marriage from another lesbian couple. While in the first case, officers have provided security to the newly wedded, they have not given permission to the second couple fearing a backlash from the community. Significantly, in both the cases, the couples belong to low income group and are not highly educated.

In the first case, Komal Sharma and Pinki Kashyap entered into wedlock and left their families to live together. The couple hails from Dayanand Nagar, a small locality in Shamli tehsil of Muzaffarnagar district. While Komal belongs to a Brahmin family and is educated till class XI, Pinki hails from an other backward class family and has studied only till class VIII. Komal’s father Rajendra Sharma is with home guard and Pinki’s father Hariram runs a small dairy.

The two girls met three months back in a vocational training centre where both had enrolled for a course in stitching. The friendship soon turned into love and they got secretly married through Arya Samaj rituals at a temple in Muzaffarnagar. They also to have entered wedlock legally through a court marriage in Delhi. While Pinki posed as the groom, Komal dressed as a bride.

The couple kept their marriage a secret till July 23, the day they left their families. According to police, Pinki came to Komal’s house in the morning of July 23 when Komal was alone with her two younger siblings. The duo gave sleeping pills mixed in cold drink to the Komal’s younger brother and sister and left the house. The two girls also filed an application in the office of Senior Superintendent of Police (SSP), Muzaffarnagar, complaining that they have threat to their lives from their families. History Is on My Side, Says Calif. Justice Who Voted Against Gay-Marriage Ban

Carlos Moreno stood alone in May when he dissented from the decision upholding Proposition 8. But the California Supreme Court justice says history will prove him right — that denying gays and lesbians the right to marry is illegal discrimination.

“Someday at some point my dissent will be the majority view in California,” he said during an interview in his San Francisco chambers late Wednesday. “I think that’s where the law is headed.”

“Equal protection is either equal or it’s not,” he added. “It’s not the kind of thing you can chip away at.”

Moreno, one of four justices to back same-sex marriage last year and the sole vote against Prop 8 this year, took time to talk to The Recorder about his votes, his brief moment on the Obama administration’s short list for the nation’s highest court, and U.S. Supreme Court nominee Sonia Sotomayor’s controversial “wise Latina” comment.

Moreno’s dissent in Strauss v. Horton, 46 Cal.4th 364, came at a touchy time for him. He had been contacted by the Obama administration a week earlier as a possible replacement for retiring U.S. Supreme Court Justice David Souter. Since President Obama has officially stated his opposition to same-sex marriage, it could be assumed Moreno’s position on marriage and Prop 8 might be troublesome.

But, Moreno said, Obama’s vetters didn’t ask him how his Prop 8 vote — which wasn’t yet public — would go.

“They just asked if there were any high-profile cases — past or present, including on the trial court — that would be the kind of case that would draw attention.”

Gay partnership foes turn in referendum signatures

Opponents of a measure that passed the Legislature this year giving same-sex domestic partners all the rights of married people turned in signatures to the secretary of state’s office Saturday in attempt to overturn the new law through a citizen referendum.

Referendum 71 needs 120,577 valid voter signatures to qualify for the fall ballot. Exactly how many signatures the R-71 camp turned in Saturday wasn’t immediately clear. The secretary of state’s office said it received the first batch a little after 3 p.m. Saturday.

Election officials suggest submitting about 150,000 signatures to offset any invalid signatures. Dave Ammons, spokesman for the secretary of state’s office, said usually about 18 percent of signatures checked turn out to be invalid.

He said Saturday that R-71 backers were cutting it very close.

“They’re definitely running on fumes, in terms of trying to get their pad,” Ammons said.

The process of counting and verifying the signatures could go until the last week of August.
If R-71 proponents don’t have enough signatures, the domestic partnership expansion will immediately take effect. If the measure does qualify, voters will be asked to either approve or reject the new law.

Gay spouses to get AAA discounts Florida Times-Union -

AAA Auto Club South will now allow same-sex married couples to receive spousal discounts under AAA’s Associate Membership program, a rights group that advocates for gay, lesbian, bisexual and transgender people announced Thursday.

The company met with members of Equality Florida on Wednesday after the group received calls from gay couples who had been denied family memberships.

“Our policy does include gay and lesbian spouses, wherever they were married. Whether in other states or countries, they qualify,” said Tom O’Brien, president and chief executive officer of AAA Auto Club South, in a statement.

Gay marriage is not legal in Florida but has been approved in other states.

Outgames international gay sport and culture event opens in Copenhagen

There will be triathlon and handball – but also bridge and line dancing. Copenhagen is preparing for thousands of gay people from dozens of nations to descend this weekend for the Outgames, a nine-day sporting and cultural olympics for the lesbian, gay, bisexual and transgender community.

When the 5,500 participants are introduced on a catwalk in Copenhagen’s central square today, it will kickstart nine days of sport, arts and political debates with almost 100 nations represented in more than 30 events, traditional and improvised.

But the event is about much more than podium places. The Outgames has launched itself under the banner of sport, culture and human rights. Participants from a host of cities, including Tel Aviv and Mexico City, will take over public spaces throughout Copenhagen to showcase artists and performers.

Gay incident reopens Salt Lake City’s Main Street plaza wounds

It’s the wound that won’t heal. The rift that won’t close. And earlier this month, two gay lovers’ purportedly innocuous late-night kiss — though LDS Church officials insist it was far more amorous than that — ripped it wide open.

Utah’s simmering religious divide boiled over — once again — at the geographical and philosophical intersection of church and state: the Main Street Plaza in downtown Salt Lake City.

“It is a scab that will continue to be peeled away — and may never heal,” says Dani Eyer, the former ACLU director who fought to preserve First Amendment rights on the plaza.

Matt Aune and Derek Jones say they held hands, kissed and then squabbled with security guards on the LDS Church-owned square. Salt Lake City police issued a ticket for trespassing. In protest, supporters of the couple staged a “kiss-in” last Sunday outside the plaza and plan another such demonstration today.

The LDS Church — a faith to which 60 percent of Utahns belong — defended its right to regulate “inappropriate behavior” on the plaza.

“What we’re seeing now is a manifestation of what should have been obvious from the very beginning,” says former Salt Lake City Mayor Rocky Anderson. “This block of Main Street never should have been conveyed to the LDS Church. It was a recipe for ongoing resentments between the LDS Church and those who are not members.”

The church bought the strip of Main — from North Temple to South Temple — in 1999 after then-Mayor Deedee Corradini and the City Council, with the only two non-LDS members dissenting, signed off on the $8.1 million deal. But the controversy burned for five more years as federal courts were asked to settle the prickly issue of whether the church could govern expression on the plaza and whether the city could retain a public right of way (as outlined in the original deal).

“It was meant to be for everybody,” Eyer says. “Where people come and go their constitutional rights go with them.”

After a 10th U.S. Circuit Court of Appeals ruling in 2002, First Amendment activities returned to the plaza. But demonstrations by anti-Mormon protesters — including cries of “whore” and “harlot” hurled at newlywed brides — “sustained divisions” that “reached to the point of hatred” between Mormons and non-Mormons, Anderson says.

In the end, he agreed to trade the public easement for cash and LDS land to build a west-side community center.

NYC Prep: PC Bares It All as Gay Rumors Spread

Among all the cast members of NYC Prep , I’ve always been puzzled about PC. Aside from being the most notorious and flashy, he seems to be struggling with something —something that I’ve been trying to hold back until various other websites have reported it as well. Word on the street is that PC is gay!

I guess it all started in the first episode, where viewers were introduced to PC as someone obsessed with fashion and shopping. On top of that, viewers also learned that he has several effeminate mannerisms. While these things make PC potentially gay, that might not be enough to prove that he is. Apple using double-standard for gay iPhone apps?

Apple is maintaining a double-standard when it comes to gay-themed iPhone apps, a developer claims. Attempting to draw publicity, Terry Ray claims that his iGaydar title was rejected from the App Store on the same day as Bruno — an app based on the Sacha Baron Cohen movie — was approved. iGaydar was rejected for “objectionable content,” despite being considerably less graphic than the Bruno app, according to Ray.

iGaydar pretends to detect a person’s sexuality, first displaying a random percentage and then announcing a tongue-in-cheek statement, such as “Honey, not even your priorities are straight.” By contrast the Bruno app lets users undress Cohen’s character, and touch various body parts which can elicit potentially offensive responses. Bruno is only on the App Store as a result of major studio backing and publicity, Ray charges.

Apple has rejected a number of apps with sex-related themes in the past, even when the titles did not show anything explicit. Naughty Loaded Dice was briefly blocked earlier in July, while an e-book reader, Eucalyptus, was temporarily blocked in May. Though only meant as general-purpose reading software, one of the books available for Eucalyptus is the Kama Sutra, a centuries-old Indian religious text that Apple deemed “inappropriate sexual content.”

Nominee confirmed for Civil Rights job

The New Jersey Commission on Civil Rights yesterday approved the nomination of a new state civil rights chief who is not admitted to practice law in New Jersey despite two lawmakers’ questions about his residency and commitment to gay and lesbian issues.

Chinh Le, Attorney General Anne Milgram’s nominee, was approved as head of the state Division on Civil Rights by a 6-0 vote of the commission at its monthly meeting in Newark. One commissioner abstained after her proposal for a private executive session between commissioners and the nominee was rejected.
