Tax laws discriminate against gay couples

BOSTON — They are not the only married couple in America who talk about taxes and ulcers in the same sentence. Nor are they the only couple who believe they are paying more than they should. On that ground they are part of a noisy majority. But they are a couple for whom tax season also entails an identity crisis. You see, Melba Abreu and Beatrice Hernandez file state taxes as what they are — a legally married Massachusetts couple. But under federal law, they have to file federal taxes as what they aren’t — two single women.

This identity crisis is not just some psychological blip on the cheerful landscape of their family life. In the last four years, the government’s refusal to consider them a married couple has cost the writer and the CFO of a nonprofit about $5,000 a year. As Beatrice puts it, “We don’t know anyone for whom $20,000 and counting isn’t significant.”

This is one reason they joined seven other married couples and three surviving spouses last month in bringing a legal complaint against DOMA, the law that deliberately denies federal benefits to same-sex marriages. The other plaintiffs include a postal worker who can’t get health care coverage for her spouse, a widower ineligible for higher Social Security benefits, and a couple who can’t get a passport under their married name.

The suit is not just timely because we all share a certain post-tax traumatic stress syndrome. But we have just doubled the number of states in which same-sex couples can be legally married. First, Iowa joined Massachusetts and Connecticut. Then Vermont followed with the first legislative approval. And a bill was just introduced in New York, where people cringe to find themselves lagging behind Iowa.

This is all part of a careful state-by-state strategy. But as a side effect, it’s producing more Americans with a strange dual citizenship: Married in the eyes of Iowa, single in the eyes of Washington. GLAAD, the nation’s lesbian, gay, bisexual and transgender (LGBT) media advocacy and anti-defamation organization, present the GLAAD Media Awards to recognize and honor media for their fair, accurate and inclusive representations of the LGBT community and the issues that affect their lives.

At the ceremony, T.R. Knight presented the Vanguard Award to Kathy Griffin, a strong ally of the LGBT community, who regularly includes LGBT people in her Bravo reality program Kathy Griffin: My Life on the D-List and in her live comedy shows. In media outlets around the world, Griffin is a vocal advocate for marriage equality for same-sex couples, and regularly supports LGBT community organizations. The Vanguard Award is presented to individuals who, through their work, have increased the visibility and understanding of the LGBT community in the media.

“This is a thrill and an honor and an awesome night,” Griffin said in her acceptance speech. “You guys have been so good to me. I appreciate you, I get you, I love you, and I’ll keep making you laugh as long as you’ll let me! Thank you!”

Also at the event, Oscar-winning screenwriter Dustin Lance Black and Cleve Jones, creator of the AIDS Memorial Quilt, presented the Stephen F. Kolzak Award to Bishop Gene Robinson, the first openly gay Bishop in the history of the Episcopal church. The Stephen F. Kolzak Award is presented to an openly lesbian, gay, bisexual or transgender person who has made a significant difference in promoting equal rights for the LGBT community in the media.

“It is such an honor to be here, and to be honored by the Board of GLAAD….To have you say thanks in this way just means the world to me,” Robinson said accepting his award. Speaking of the LGBT movement, Robinson continued, “We need to be in this for the long haul…Just because we achieved civil rights in the sixties for African Americans, it doesn’t mean racism is gone. Because we achieved rights for women in the seventies, it doesn’t mean sexism is gone….But we can stay in this fight because we know how it’s is going to end. This is going to end with full equality for LGBT people in our churches and in society. I have no doubt of it.”

Alan Cumming presented a Special Recognition Award to The L Word which completed its sixth and final season on Showtime in March. Show creator Ilene Chaiken accepted the award with cast members Jennifer Beals, Leisha Hailey and Katherine Moenning. At the 17th Annual GLAAD Media Awards in 2005, The L Word received the award for Outstanding Drama Series.

In her remarks, Chaiken commented on the continuing need to advocate for the inclusion of LGBT characters in the media. “At this moment in history, when marriage equality is virtually inevitable and maybe even imminent, when we’ve welcomed new LGBT civil rights legislation in Iowa, Colorado, Washington D.C., New Hampshire and soon New York…how can it be that LGBT people – after years of slow but promising momentum – have careened backwards in terms of representation in mainstream popular entertainment media?” Chaiken said.

Chaiken continued, “GLAAD has been working vigilantly to ensure that the defamation of LGBT people does not go unchecked. GLAAD’s been working to ensure that our lives are visible in the news and in the media. GLAAD’s work is vital and critical to helping us to achieve the milestones that are lifting LGBT people to our rightful place of full, unfettered equality. Thank you, GLAAD. GLAAD also recognized Prop 8: The Musical, a video created for FunnyorDie.com in response to the passage of Proposition 8, a California ballot initiative which eliminated the right to marry for same-sex couples. Directed by Adam Shankman and written by Marc Shaiman, the video received over one million hits on its first day online. During the show, Miss Coco Peru and the Gay Men’s Chorus of Los Angeles performed the song live onstage. Shankman accepted the award on behalf of the team of creators.

Milk received the GLAAD Media Award for Outstanding Film – Wide Release. The award was accepted by director Gus Van Sant, screenwriter Dustin Lance Black, and producers Bruce Cohen and Dan Jinks. Ellen DeGeneres and Portia de Rossi accepted a GLAAD Media Award for the episode “Ellen & Portia’s Wedding Day” from The Ellen DeGeneres Show nominated for Outstanding Talk Show Episode. Show creator Marc Cherry, along with Teri Hatcher, Dana Delaney, Kyle MacLachlan, Tuc Watkins, Kevin Rahm, Andrea Bowen and Brenda Strong accepted the award for Outstanding Comedy Series for Desperate Housewives. Gay Take on Shakespeare Sets Off UK Row

For GLBT students in London, it must have been a romantic dream come true to see their lives and feelings depicted on the stage in a work pf passion and sweeping poetry authored by none other than William Shakespeare.

For others, however, the idea of a gay version of “Romeo and Juliet” called “Romeo and Julian” is “political correctness gone mad.”

The play was adapted by the London high schoolers in January for LGTB History Month.

Gay men can enter the Philippine Army

Gay men can go to war with brave Filipino soldiers, a military spokesman said as he announced Wednesday that members of the third sex can apply for enlistment in the Philippine Army.

“We welcome them. We welcome everybody. We don’t discriminate [gay] people here,” Lt. Col. Romeo Brawner Jr., Army spokesman, told ABS-CBN’s morning show, “Umagang Kay Ganda.”

Brawner said as long as an applicant is physically, emotionally and mentally fit, the Army would be proud to enlist them, including gay people.

“They are allowed [and] of course they will have the same assignments. They can also go to war,” the Army spokesman added.

Ammiano Introduces LGBT Prisoner Safety Act in California Assembly

EQCA Sponsors Bill Seeking to Eliminate Violence, Abuse Against LGBT Prisoners

Sacramento – The LGBT Prisoner Safety Act, AB 382, was introduced in the California State Assembly this week by Assemblymember Tom Ammiano (D – San Francisco). The bill, sponsored by Equality California (EQCA), is designed to prevent violence against lesbian, gay, bisexual, and transgender (LGBT) people in the state prison system. According to a recent study from the Cali¬fornia Department of Corrections and Re¬habilitation, 67 percent of LGBT inmates report being sexually assaulted by another inmate, a rate 15 times higher than the overall prison population.

“All Californians deserve protection from violence,” said Geoff Kors, EQCA Executive Director. “This bill seeks to end abuse and assault against LGBT prisoners, ensuring they receive equal and fair protection under the law.”

The legislation promotes safety for and prevents abuse and assault against LGBT people in the prison system by adding sexual orientation and gender identity to the current list of factors that should be considered when classifying and housing prisoners. The current list of factors includes age, gender, type of offense, and prior time served.
“All people deserve basic protections – including those serving time in our state prisons,” Assemblymember Ammiano said upon introducing the bill. “No prisoner should fear for his or her life or be the target of abuse because of his or her sexual orientation or gender identity.”

The bill was developed as a direct result of a Senate Public Safety Committee meeting held in San Francisco this past December and chaired by Senator and former Majority Leader Gloria Romero (D-Los Angeles). The meeting, which was sponsored by EQCA along with Just Detention International, the Transgender Law Center, National Center for Lesbian Rights, and the Transgender Gender-Variant and Intersex Justice Project, exposed the dire issues facing LGBT people in California prisons in order to produce concrete solutions.

Equality California to Bring Over 2,000 Californians to Sacramento for Lobby Day to Support the Invalidation of Prop 8

Equality California is sponsoring Lobby Day where a diverse group of volunteers and activists will urge legislators to support Equality California-sponsored companion resolutions SR 7 (Leno) and HR 5 (Ammiano), in the State Senate and Assembly. The resolutions would put the legislature on record as opposing Prop 8 as an invalid revision to the California Constitution. More than 2,000 volunteers have already registered to participate.

‘Thank Gays It’s Friday’ Comedy Show Moves to New Venue

WEST HOLLYWOOD, Calif — The Sunset Strip caters to a young vibrant crowd and while other industries have been laying off workers or going under, live comedy continues to flourish in Southern California, the entertainment capital of the world.

After a 16-week run, the gay and lesbian standup comedy show: ‘Thank Gays It’s Friday,’ moves to its new home: The World Famous Comedy Store, this Friday January 23rd, with its Midnight Show.

As the demand for this LGBT show has grown, the new venue shifts from an 18 and over audience to a 21 and over audience at its new venue: The Comedy Store.

Producer, host and comic, Jerome Cleary remarks, “It’s a natural progression that the response and feedback from audiences the past 4 months has carved out a niche.”

According to ArtistsForce Blog: “Despite the recession, 2008 figures show revenue gains in the live entertainment industry. Pollstar reported North American receipts for 2008 at $4.2 billion, an increase of 7.8 percent over 2007. The revenue growth was not due to increased unit sales, though. Instead, the growth came from higher ticket prices.”

“We continue to have sold out shows at our club over the past six months, says, comic-actor, Pauly Shore, son of Mitzi Shore, owner of The Comedy Store.

In addition to standup comics, the show has featured drag performances, juggling acts along with other non-standup performers.

1 Dead in Bushwick Bias Attack

Two Ecuadorian brothers, Jose and Romel Sucuzhanay, were walking home early on the morning of Dec. 7, a little tipsy and arm-in-arm. That, allegedly, was enough to incite a group of men to physically assault them while shouting anti-gay and anti-Hispanic epithets.

Jose Sucuzhanay, 31, was declared brain-dead by doctors at Elmhurst Hospital Center two days later, and now the Brooklyn community where the attack took place is seeking arrests and answers.

The incident occurred about 3:30 a.m., when the two brothers were on their way home from a bar near the intersection of Bushwick Avenue and Kossuth Place in Bushwick. According to the New York Times, witnesses saw a maroon sport utility vehicle pull up to the Sucuzhanays on the sidewalk. Three men jumped out, yelling anti-gay and racist slurs. GLBT Historical Society Celebrates Castro Exhibit Opening

SAN FRANCISCO, CA — On December 18th, the Gay, Lesbian, Bisexual, Transgender (GLBT) Historical Society will hold a ribbon-cutting ceremony to formally open its newest exhibit Passionate Struggle: Dynamics of San Francisco’s GLBT History.

The exhibit, located at the corner of 18th and Castro streets in the heart of the City’s main GLBT district, has been open in preview since the release of the MILK film on November 26th, but will formally open on the 18th. “During our previews, thousands of people have come through,” said the exhibit’s Co-Curator Don Romesburg. “My favorite, though, was when Harvey Milk’s gay nephew, Stuart Milk, thanked us for so respectfully and powerfully displaying elements of his uncle’s life and death. Straight couples, families, long-time Castro residents, queer youth groups, tourists, and politicians have all told me how moving the show has been for them. Passionate Struggle speaks volumes to the importance of the GLBT Historical Society and how relatable our community’s history can be to so many people.”

The opening ceremony will feature private tours of the items on display by the exhibit’s curatorial team, speeches by GLBT Historical Society Staff and a ribbon-cutting by San Francisco Supervisor Bevan Dufty, who helped the Historical Society secure Washington Mutual’s donation of the space and a major grant from Levi Strauss & Co.

The exhibit features artifacts, documents, images, video and audio that illustrate four key themes in GLBT history — People, Places, Politics and Pleasure. Several artifacts from Harvey Milk, the subject of the film MILK, are also on display.
