Gov. Arnold Schwarzenegger and Attorney General Jerry Brown on Thursday urged a federal judge to keep Proposition 8 in force for now, arguing that it would create too much uncertainty across the state to put the voter-approved ban on gay marriage on hold while the latest legal challenge unfolds in the federal courts.
In court papers, state lawyers argued against an injunction that would freeze the current gay marriage ban, opposing a request filed in federal court in San Francisco last month by two gay couples seeking the right to marry. Backed by former U.S. Solicitor General Theodore Olson and renowned lawyer David Boies, the couples moved to counterract the California Supreme Court’s recent ruling upholding Proposition 8, arguing that it violates equal protection rights under the federal constitution.
Brown and Schwarzenegger argued separately that it would create too much havoc to put the law on hold until the constitutional issues are resolved, perhaps eventually by the U.S. Supreme Court. The governor and attorney general did not take a position on the federal constitutional questions, focusing only on whether Prop 8 should be blocked while the case is litigated, a move that would allow same-sex couples to resume marrying in California.
Brown had previously urged the California Supreme Court to overturn Prop 8, and Schwarzenegger has said publicly he believes the courts eventually will permit gay marriage.

New Prop. 8 court challenge brings former legal rivals together
The California Supreme Court failed to protect gay couples’ fundamental right to marry when it upheld Proposition 8, forcing same-sex couples to appeal to the federal courts to remedy the injustice, two prominent lawyers said today in announcing a lawsuit on behalf of two gay couples.
Former U.S. Solicitor General Theodore Olson, a renowned conservative, and David Boies, who opposed Olson in Bush v. Gore in the 2000 fight over the presidential election, cast their collaborative effort to restore the right of gays to marry in California as a moral imperative to correct an injustice. Their suit seeks an immediate injunction on Prop. 8’s ban, thereby allowing same-sex marriages to resume while the case makes its way through the federal court system.
But Olson’s role in the gay rights mission prompted much speculation about his motives. The former Bush administration official, who lost his wife in the Sept. 11 terror attacks, conceded that the federal courts might not be ready to recognize sexual orientation as a class in need of protection from discrimination, but he said he hoped “that people don’t suspect my motives,” vowing to demonstrate his commitment to equal rights by winning the challenge.

Cuba to resume transgender surgery
(Havana) Cuba will reinstate sex-change operations previously banned on the island, President Raul Castro’s daughter Mariela said Wednesday.

Now that Iowa has come out of the closet, it’s a no-brainer that gay Republicans would launch a new political organization.
That’s right, it’s called GOProud, and it promises a traditional conservative agenda (except for being, uh, homosexual, I presume). Some of those agenda issues are to repeal inheritance taxes, fight against global extremists, and defend gun rights.
Sounds like, say, Ronald Reagan would feel quite at home in this group if he was, well, gay, and, well, alive.

VT Leaders vow to pass gay marriage bill
MONTPELIER — State legislative leaders announced this afternoon they intend to take up a gay marriage bill when the Legislature reconvenes in two weeks.
Senate President Pro Tempore Peter Shumlin and Speaker of the House Shap Smith said at a join news conference at the Statehouse that the Senate Judiciary Committee will hold a week of testimony and a public hearing on the matter. They predicted a bill would emerge from committee by week’s end.
The Legislature is on a two-week hiatus and will resume work March 17.

Gay skiers want to return to Park City
A group of gay skiers plan to resume their trips to Park City in 2010, saying the ill will between gays and Utah stemming from California’s gay-marriage ballot measure will likely have subsided by next year.
Next year’s Utah Gay & Lesbian Ski Week is tentatively scheduled Jan. 6-10. An Internet site indicates the skiers plan to visit each of the three local resorts, hold cocktail and social hours and have a party. A dinner is scheduled at the Wasatch Brew Pub.
The 2010 event is scheduled one year after organizers were forced to cancel this year’s annual visit.
They said few gay skiers signed up for the 2009 trip because they were unhappy with the role The Church of Jesus Christ of Latter-day Saints played in the passage of Proposition 8, the California ballot measure. After Election Day, gays and their supporters called for a boycott of Utah. This year’s trip would have been the ninth consecutive year visiting Park City.
One of the organizers, John Harriott, a bisexual who lives in West Hollywood, Calif., said there remains a possibility of the 2010 event being canceled. He said, though, there is a three-in-four chance that it will be held. A decision will not be finalized until early December.
Much depends on the political climate by early 2010, he said. Similar boycotts typically do not last longer than a year, he said.
“I have a feeling this will be a lot of water under the bridge,” he said, adding, “I have a feeling Prop. 8 will be a distant memory by next year.”
California courts are expected to consider the validity of the ballot measure in 2009, likely shifting some of the emotions from Utah to the state where Proposition 8 passed.

NEW FILING IN PROP 8 LEGAL CHALLENGE: Reply brief reiterates that Prop 8 should be struck down
(San Francisco, California, January 5, 2009) — Today, the National Center for Lesbian Rights (NCLR), the American Civil Liberties Union (ACLU), and Lambda Legal filed a reply brief in the California Supreme Court, the next step in the lawsuit seeking to overturn Proposition 8, which passed by a mere 52 percent on November 4. The brief argues that Proposition 8 is invalid because it seeks to eliminate a fundamental right only for a targeted minority, which cannot be done through the initiative process. The brief also agrees with California Attorney General Jerry Brown that certain fundamental rights, including the right to marry, are inalienable and can not be put up for a popular vote. The brief also argues —again in agreement with the Attorney General — that Proposition 8 cannot be applied to invalidate existing marriages because new laws and amendments are presumed to apply only on a prospective basis. “If Prop 8 is permitted to stand, it would be the first time an initiative has successfully been used to change the California Constitution to take away an existing right only from a historically targeted minority group,” said NCLR Legal Director Shannon Minter. “Such a change would defeat the very purpose of a constitution and fundamentally alter the role of the courts in protecting minority rights.” On November 19, 2008, the California Supreme Court granted review in the legal challenges to Proposition 8, and established an expedited briefing schedule, under which briefing will be completed in January 2009, with amicus curiae or “friend-of-the-court” briefs due on January 15. Oral argument potentially could be held as early as March 2009. Elizabeth Gill, a staff attorney with the ACLU, added “Prop 8 is a radical and unprecedented change to the California Constitution that puts all Californians at risk. It actually mandates government discrimination against a minority.” In May of 2008, the California Supreme Court held that laws that treat people differently based on their sexual orientation violate the equal protection clause of the California Constitution and that same-sex couples have the same fundamental right to marry as other Californians. Proposition 8 would completely eliminate this fundamental right only for same-sex couples. No other initiative has ever successfully changed the California Constitution to take away a right only from a targeted minority group. “Prop 8 is not valid and never has been,” said Jennifer Pizer, Lambda Legal National Marriage Project Director. “California’s Equal Protection clause was not written in sand, to be erased by shifting political tides. It’s a solid guarantee that we all have the same rights and it’s the foundation of our government. Exceptions can’t be carved by simple majority vote or the equality guarantee becomes a discrimination guarantee. No initiative can cause such a profound change in our legal system.” NCLR, Lambda Legal, and the ACLU filed this challenge on November 5, representing Equality California, whose members include many same-sex couples who married between June 16 and November 4, 2008, and six same-sex couples who want to marry in California. The California Supreme Court has also agreed to hear two other challenges filed on the same day: one filed by the City and County of San Francisco (joined by Santa Clara County and the City of Los Angeles, and subsequently by Los Angeles County and other local governments); and another filed by a private attorney. Activists in Arizona resume gay-rights fight
Just weeks after voters approved amending Arizona’s Constitution to define marriage as between one man and one woman, some gay-rights activists already are looking toward 2010.
A man who champions equality for gays in the United Kingdom has traveled here to launch a drive for a ballot initiative that would establish civil partnerships, which since 2005 have allowed British same-sex couples to legally register their relationships.
“We’re not fighting for marriage; we’re fighting for equal rights,” said Gino Meriano, whose business, Pink Weddings, arranges commitment ceremonies and provides free legal advice for gay couples wishing to establish civil partnerships.
