Gays under threat in Senegal

DAKAR, Senegal — A mob gathered near a mosque outside Dakar. They were there to hunt down and kill nine men accused of homosexual acts.

Earlier this week the nine Senegalese AIDS activists were freed from eight-year-prison terms for alleged homosexual acts, but they went into hiding because of death threats from Muslim religious leaders and the general population.

“The homosexuals will not escape lynching. They will be fish food,” Dakar newspaper L’Observeur quoted a local youth leader as saying.

“Gay men will never be free in Senegal. They expose us all to danger,” said Imam Mbaye Niang, a prominent religious leader and member of parliament. “The judges should understand that Senegalese people need to protect their children, their families from homosexuality.”

In Senegal — where 95 percent of the population is Muslim — homosexual acts are punishable by fines and up to five years in prison. In January, the nine men received the harshest sentence yet for such an offense in Senegal, getting the maximum of five years and an additional three for criminal conspiracy.

Though widely supported in Senegal, the conviction was condemned by international human rights groups and foreign governments, most notably France.

“They were judged and condemned very severely, surely on the basis of public outcry, therefore the justice was neither objective nor founded in law,” said lead defense attorney Barim Sassoum Sy, who called the initial ruling hasty and emotional.

A Dakar appeals court overturned that decision Monday, citing violations of legal protocol.

Acting on an anonymous tip, police had arrested the men — most of whom do HIV prevention work in the “men having sex with men” community — in December at the home of a prominent gay activist. But the police did not have a search warrant, nor did they catch the men in the act, which is required by the Senegalese law prohibiting “indecent acts against nature.” The judge hearing the appeal therefore declared their convictions null and void, Sy said.

Yet even as smiling attorneys and supporters celebrated in the packed courtroom Monday and exchanged congratulations, plans were already in place to get the freed men into hiding outside Dakar.

“The first judge sentenced them to eight years,” said Imam Niang. “He had the courage to say it. The judge that let them go was much less courageous. He yielded to international pressure.”

Mainline Clergy Survey shows high support for activist government, growing support for LGBT equality

Leading researchers on religion and politics today released the results of an in‐depth survey of

Mainline Protestant clergy political engagement during the 2008 election season, attitudes on social and economic issues, and the public role of the church. The Mainline Protestant Clergy Voices Survey (CVS), conducted by Public Religion Research, is the largest survey of mainline clergy in seven years, and the broadest ever in scope. Mainline Protestants, who make up 18 percent of all Americans and nearly a quarter of all voters, have been trending Democratic in recent years, but remain fairly evenly divided in their political behavior.

“Mainline Protestants are probably the most under‐examined major religious group in the United States,” said Dr. Robert P. Jones, President of Public Religion Research. “That’s especially surprising when you consider that they occupy so much of the vital middle ground in American politics.” Jones said that Mainline Protestants, once the religious bedrock of the Republican Party, are now an important swing constituency that has been moving slowly but steadily away from the GOP since the early 1990s. He said the new survey will be invaluable in helping us understand Mainline Protestants’ role in the American religious landscape by shedding light on the attitudes and political engagement of mainline clergy.

“Mainline clergy are highly educated, political interested, and socially engaged,” said Jones. “They are strong supporters of church‐state separation, but they are also interested in being more personally involved on social and political issues.”

The CVS surveyed senior clergy from the seven largest mainline denominations: United Methodist Church, Evangelical Lutheran Church in America, American Baptist Churches USA, Presbyterian Church USA, Episcopal Church, United Church of Christ, and Christian Church (Disciples of Christ). The survey found significant differences across the denominations on religious and political measures.

Among its findings on social and political issues:

Mainline clergy are much more likely to identify as liberal and Democratic than conservative or Republican. Almost half (48%) of all mainline clergy identify as liberal, compared to about one‐third (34%) who say they are conservative. A majority (56%) of mainline clergy identify with or lean towards the Democratic Party, compared to roughly one‐third (34%) who claim a Republican affiliation, a 22‐point gap. Clergy political leanings vary considerably by denomination. Three quarters (74%) of UCC clergy identify as liberal, compared to less than a third (32%) of ABCUSA clergy.

Mainline Protestant clergy are broadly supportive of government’s role in addressing social problems such as unemployment, poverty and poor housing. More than three‐quarters (78%) agree that the federal government should do more to solve social problems, and more than 4‐in‐10 strongly agree.

Mainline clergy are strongly supportive of government action in the areas of health care and the environment. More than two‐thirds (67%) of clergy agree that government should guarantee health insurance for all citizens, even if it means raising taxes. And nearly 7‐in‐10 (69%) clergy say that more environmental protection is needed, even if it raises prices or costs jobs.

On a broad range of issues, mainline clergy affirm equality for gay and lesbian Americans. Roughly two‐thirds of mainline clergy support some legal recognition for same‐sex couples (65%), passing hate crime laws (67%), and employment nondiscrimination protections for gay and lesbian people (66%). A majority (55%) of mainline clergy support adoption rights for gay and lesbian people.

Mainline Protestant clergy are strong advocates of church‐state separation. A majority (65%) of mainline clergy agree that the U.S. should “maintain a strict separation of church and state.” Mainline clergy are more worried about public officials who are too close to religious leaders (59%) than about public officials who do not pay enough attention to religion (41%).\

Mainline clergy are more likely to publicly address hunger and poverty and family issues than controversial social issues. More than 8‐in‐10 clergy say they publicly expressed their views about hunger and poverty often in the last year, and three‐quarters say they addressed marriage and family issues often. Only about one‐quarter (26%) say they often discussed the issues of abortion and capital punishment.

The survey also includes findings on religious measures, including clergy religious self‐identification (mainline, evangelical, born‐again), their views on the interpretation of scripture, and the relative importance of evangelism and social action.

Dr. John Green, Director of the Bliss Institute for Applied Politics at the University of Akron, served as advisor to the project and supervised its data collection. Green also participated in two of the earlier studies of mainline clergy in 1989 and 2001 upon which this new survey builds.

“This survey adds significantly to our knowledge and understanding of mainline clergy,” said Green. “Scholars of religion as well as journalists and interested activists will benefit from the information and insights it offers.”

The survey, which was conducted by mail, contained over 250 separate questions and generated

2,658 respondents with a response rate of 44%. The Mainline Protestant Clergy Voices Survey was funded by the Evelyn and Walter Haas, Jr. Fund.

Religious leaders, faith organizations file lawsuit to invalidate Prop 8

Today, the California Council of Churches and other religious leaders and faith organizations representing millions of members filed a petition with the California Supreme Court asking the to invalidate Proposition 8. The petition argues that Proposition 8 poses a severe threat to the guarantee of equal protection for all and was not enacted through the constitutionally required process for such a dramatic change to the California Constitution.

The petition is filed on behalf of the California Council of Churches, the General Synod of the United Church of Christ, two Episocopal bishops (of California and Los Angeles), the Progressive Jewish Alliance, the Unitarian Universalist Association of Congregations and the Unitarian Universalist Legislative Ministry of California, and the Northern and Southern California Nevada Conferences of the United Church of Christ. The groups are represented by Eric Isaacson, based in San Diego, and by Jon B. Eisenberg of Eisenberg and Hancock, LLP, based in Oakland.

“Proposition 8 poses a grave threat to religious freedom,” said Rev. Rick Schlosser, executive director of the California Council of Churches. “If the Court permits gay men and lesbians to be deprived of equal protection by a simple amjority vote, religious minorities could be denied equal protection as well — a terrible irony in a nation founded by people who emigrated to escape religious persecution. If the Court permits Proposition 8 to take effect, religious discrimination similarly could be written into California’s Consitution.”

Poll: Americans support gay rights

A Harris Interactive poll released Dec. 3 found that Americans support a range of policies and protections for gay people.

The Pulse of Equality survey, commissioned by the Gay & Lesbian Alliance Against Defamation, found that majorities of Americans favor either marriage or civil unions for gay couples, hate crime laws to protect gay and transgender people, letting gays in the military serve openly, and allowing gays and lesbians to adopt children.

The telephone survey questioned 2,000 adults between Nov. 13 and 17 and had a margin of error of plus or minus 2 percentage points.

Among the specific findings:

* Seventy-five percent of U.S. adults favor either marriage or domestic partnerships/civil unions for gay and lesbian couples. Only 22 percent oppose any legal recognition of gay couples.

* U.S. adults are evenly divided on whether gay couples should have access to marriage – 47 percent say yes and 49 percent say no.

* Sixty-four percent think gays in the military should not have to stay closeted, as required by the “Don’t Ask, Don’t Tell” policy.

* Sixty-three percent support expanding hate crime laws to cover gay and transgender people. At present, 31 states and the District of Columbia have such laws that cover sexual orientation and 12 of those laws also encompass gender identity.

* Fifty-one percent favor protecting gay and transgender people under existing laws that ban discrimination in employment, housing and public accommodations. Twenty states and the District of Columbia have such laws that cover sexual orientation and 13 of those laws also encompass gender identity.

* Sixty-nine percent oppose bans on gay adoption.

“We observed a positive relationship between knowing a gay or transgender person and one’s attitudes toward them and the policy issues that affect their lives,” said Laura Light, Harris Interactive’s vice president of public relations research.

“Based on other surveys we have conducted on attitudes toward LGBT people and issues, the results of this survey suggest that public sentiment in the U.S. is trending toward greater acceptance of gay- and transgender-related policy issues.”

The survey found that people under 65, and especially those 18-34, are more gay-friendly than people over 65. Women are generally more supportive than men. Latinos are more supportive than whites and blacks when it comes to gays in the military. Blacks are more supportive than whites and Latinos on hate-crime laws. And Catholics and “mainline” Christians (Protestant, Mormon or “other Christian”) are more supportive than “born-again” Protestants, Mormons or other Christians.

Nineteen percent of those questioned said their feelings toward gay people have become more favorable over the past five years. They attributed the change to such things as knowing someone who is gay, seeing gay people on TV and in movies, passage of gay-friendly laws, news coverage of gay issues, and learning of the gay-friendly positions of friends, family members and religious leaders.

“Knowing someone who is gay or lesbian” was the most significant factor, cited by 79 percent of those whose feelings had evolved.

        “I am very disappointed by President-elect Barack Obama’s decision to honor Reverend Rick Warren with a prominent role in his inauguration.  Religious leaders obviously have every right to speak out in opposition to anti-discrimination measures, even in the degrading terms that Rev. Warren has used with regard to same-sex marriage.  But that does not confer upon them the right to a place of honor in the inauguration ceremony of a president whose stated commitment to LGBT rights won him the strong support of the great majority of those who support that cause.
        “It is irrelevant that Rev. Warren invited Senator Obama to address his congregation, since he extended an equal invitation to Senator McCain.  Furthermore, the President-Elect has not simply invited Rev. Warren to give a speech as part of a series in which various views are presented.  The selection of a member of the clergy to occupy this uniquely elevated position has always been considered a mark of respect and approval by those who are being inaugurated.”
