On the night of June 26, two days before the gay pride parade would overtake Manhattan in honor of the 40th birthday of the Stonewall riots that are popularly imagined as the birth of the gay rights movement, a group numbering a couple of dozen mostly gay men and women found themselves crammed into the parlor floor of the West Village townhouse of John Connor, a former banker who lives with his companion, the designer Steven Gambrel.
It raged and stormed outside, while inside, City Council Speaker Christine Quinn, the first openly gay person to win that office, thanked the group for coming.
They’d been summoned either because they had money or because they had influence in the “gay movement,” such as it is today, and the organizers of this affair needed their money and influence to stage a large national march for gay rights in Washington, D.C., this October.
The mood was intense, and hardly celebratory, despite the tremendous progress toward legalizing gay marriage in New York State that many of the attendees had been involved in.
“We want results,” Ms. Quinn said. “We want them now. We don’t want to be told any longer that we have to wait. ‘Cause look, in Albany? They said they couldn’t do marriage at the beginning of the session—that they had to get other business done first. And now it’s exploded in Albany. If they kept their promise from Day 1, we wouldn’t be where we are.”

Why Libertarians Are Courting Gays and Lesbians KPBS
MAUREEN CAVANAUGH (Host): I’m Maureen Cavanaugh. You’re listening to These Days on KPBS. Candidate Barack Obama said several things gay and lesbian voters were very happy to hear. While he never lent his support for gay marriage, Obama said he was against the “Don’t Ask, Don’t Tell” policy in the military and that he would sign legislation repealing the Defense of Marriage Act. So, many gay people were enthusiastic supporters of Barack Obama’s campaign, and when he became president they waited for him to make good on his promises. They are still waiting. And while they wait, some in the LGBT community are boycotting Democratic fundraising events and writing about re-examining their political affiliations. It is in this atmosphere that a third political party sees an opportunity. Can the Libertarian Party, with its support of same-sex marriage, become a comfortable place for disappointed gay voters?

Obama A “Champion” For The Gay Community?
That remains to be seen, but President Barack Obama insists that he will not neglect the rights of the gay community any longer. The President invited leaders of the community to the White House today for a reception celebrating Gay Pride Month. He spoke to the audience about the “support” the community will garner from himself and the First Lady and looks forward to changing minds as well as laws. “I will not only be your friend, I will continue to be an ally and a champion and a president who fights with you and for you,” he said. You can talk the talk, but can you walk the walk????? The President addressed the fact that many gay rights leaders have viewed his administration as being somewhat lax in the fight for equal rights. However, Obama assured his guests that the fight was just beginning and that the community should look forward for things to come: “I know many in this room don’t believe that progress has come fast enough. And I understand that…I expect and hope to be judged not by words, not by promises I’ve made, but by promises that my administration keeps.”

DOJ Will Not Appeal Veteran’s VictoryIn Transgender Discrimination Case
Signals Commitment By Obama Administration To Protect Transgender Workers From Discrimination
WASHINGTON, DC – The U.S. Department of Justice decided not to appeal a federal court ruling awarding transgender veteran Diane Schroer the maximum compensation for the discrimination she suffered after being refused a job with the Library of Congress. The deadline for seeking an appeal was June 30. The American Civil Liberties Union has represented Schroer in her case.
The Obama administration’s decision whether to appeal the final ruling in the case has been closely watched in part because the Bush administration defended the case so vigorously, arguing that transgender Americans are not protected by any existing federal laws. The decision not to appeal the verdict is consistent with the Obama administration’s campaign promises to protect transgender workers against discrimination and his administration’s recent order taking steps to bar gender identity discrimination in federal employment.
“I am grateful that the court took the time to examine the case in detail and come to a fair and unbiased decision. In that same light, I am gratified that the current administration saw this for what it was, a case of sex discrimination focused against transgender people, and recognized that it must end in this country,” said Schroer, an Army Special Forces veteran with 25 years service. “The important signal that the administration’s decision sends to all LGBT individuals gives me renewed hope and restores some of my shaken faith in what our country stands for.”
On April 29, 2009, a federal court awarded Schroer maximum damages of $491,190 for back pay, other financial losses and emotional pain and suffering after finding the Library illegally discriminated against Schroer because of her sex. At trial, Schroer testified that she had applied for a position with the Library of Congress as the senior terrorism research analyst and was offered the job. Prior to starting work, she took her future boss to lunch to explain that she was in the process of transitioning and wished to start work presenting as female. The following day, Schroer received a call from her future boss rescinding the offer, telling her that she wasn’t a “good fit” for the Library of Congress.
“We are pleased and relieved that the Obama administration has decided to bring an end not only to years of hard-fought litigation but also to a painful chapter of Ms. Schroer’s extraordinary life,” said Sharon McGowan, a staff attorney with the ACLU LGBT Project. “The administration’s decision not to challenge this important civil rights ruling is a welcome sign that it intends to live up to its commitment to help end transgender discrimination in the workplace.”
The ACLU filed the lawsuit against the Library of Congress on June 2, 2005, charging that the library unlawfully refused to hire Schroer in violation of Title VII of the Civil Rights Act of 1964, which prohibits sex discrimination in the workplace. In an earlier ruling in this case, the court issued a groundbreaking opinion that discriminating against someone who transitions from living as one gender to another is sex discrimination under federal law. In reaching this decision, the court compared the discrimination faced by Schroer to religious-based discrimination, saying, “Imagine that an employee is fired because she converts from Christianity to Judaism. Imagine too that her employer testified that he harbors no bias toward either Christians or Jews but only ‘converts.’ That would be a clear case of discrimination ‘because of religion.’ No court would take seriously the notion that ‘converts’ are not covered by the statute.” The court also ruled that the library was guilty of sex stereotyping against Schroer because of its view that she failed to live up to traditional notions of what is male or female.
“This case put employers on notice that discrimination against transgender individuals is like any other form of discrimination – counterproductive and against our principles as a nation,” added Schroer. “But this case alone won’t end the rampant discrimination that transgender people face throughout the country. That’s why we need Congress to pass the Employment Non-Discrimination Act that was introduced last week.”
In addition to McGowan, the legal team consisted of Ken Choe, Senior Staff Attorney for the ACLU LGBT Project, James Esseks, Litigation Director for the ACLU LGBT Project and Arthur Spitzer, Legal Director of the ACLU of the Nation’s Capital.

Paterson Vows Vote on Gay Marriage Before Break
ALBANY — Gov. David A. Paterson said in an interview Sunday night that he would make sure that the State Senate votes on same sex-marriage legislation before it breaks for the summer, hours after he and his administration had refused to commit to forcing a vote on the issue.
The development came as the governor announced plans to call the Senate to a special session on Tuesday, after trying unsuccessfully for two weeks to broker a compromise in a leadership battle that has deadlocked the chamber. But Mr. Paterson dismayed gay rights groups in his comments at a news conference early Sunday afternoon, when he said same-sex marriage would not be on the special session’s agenda.
“It has always been my intention to see same-sex marriage come to the floor,” he said, adding, “I don’t want there to be any confusion.”

Obama To Consider Gay Pentagon Appointment
President Obama is considering nominating an openly gay man to a top civilian Pentagon post, the Washington Post reported Thursday. The president, under pressure from gay activists to live up to campaign promises he made to help secure greater rights for gay men and lesbians, is considering nominating William White to a high-ranking civilian Pentagon post. The paper did not disclose the post being considered, but White, chief operating officer of Manhattan’s Intrepid Museum Foundation, was once touted by top retired military leaders and some Democrats in Congress to be the next Secretary of the Navy. While heading the Intrepid, White has accumulated extensive contacts in the armed forces, and in 1996, he was awarded the Meritorious Public Service Award for his work with the Navy.

Senator Harry Reid Says Obama Should Sign Order on Gay Troops, SLDN Also Joins Call for Executive Option
SANTA BARBARA, CA — Senate Majority Leader Harry Reid has called on President Obama to sign an executive order suspending the “don’t ask, don’t tell” policy, according to the Advocate magazine.
Referring to the repeal of the ban, Reid told Advocate reporter Kerry Eleveld that, “My hope is that it can be done administratively.” Eleveld added that, “A Democratic aide later clarified that Reid was speaking about the possibility of using an executive order to suspend discharges or perhaps halting enforcement of the policy by changing departmental regulations within the Department of Defense.”
As well, the Servicemembers Legal Defense Network (SLDN) has called on President Obama to sign an executive order. In a letter to the New York Times yesterday, SLDN Executive Director Aubrey Sarvis wrote that, “President Obama should consider all viable options he can take on his own to get rid of this discriminatory law, including issuing a ‘stop-loss’ order.” For more than a decade, SLDN has been the largest and most influential group in the country working on the “don’t ask, don’t tell” policy.
The idea of ending the ban by executive order gained momentum after the release last month of a Palm Center study showing that the president has the authority to suspend “don’t ask, don’t tell” via a stroke of the pen. Before that time, many argued that only Congress or the courts could lift the ban on service by openly gay troops.
Others calling for the President to sign an executive order include the New York Times editorial page, the Human Rights Campaign, Knights Out, an organization of gay and lesbian alumni of the U.S. Military Academy at West Point, Los Angeles Gay and Lesbian Center CEO Lorri Jean, and former Clinton White House official Richard Socarides.
Palm Center Director Aaron Belkin said that awareness of the executive option has changed the conversation about “don’t ask, don’t tell” substantially. “Obama used to duck the issue by blaming Congress for the inertia. Now it’s clear that he has unilateral authority to fulfill his campaign promise.”

Kalamazoo gay-rights issue will be revisited
KALAMAZOO — The Kalamazoo City Commission is expected to take the first step Monday night in a process that could lead to voters deciding whether Kalamazoo should grant “protected-class” status to gays, lesbians and transgender individuals.
The commission will consider for first reading a new city ordinance that includes revisions from the first anti-discrimination measure that members unanimously approved in December. A subsequent citizen petition drive challenged the measure and resulted in commissioners rescinding it and establishing a subcommittee to attempt to reach a compromise on a new ordinance.
The language coming back to the commission Monday does not change the basic premises, however. It essentially will make it a municipal civil infraction to discriminate against someone in the city in issues of housing, public accommodation and employment because they are gay. Violators could face up to a $500 fine, plus court costs.
The local proposal to ban discrimination based on sexual orientation or gender identity represents an expansion of existing state and federal laws that prohibit discrimination based on factors such as race, color, religion and sex.
Proponents of the local ordinance — including the Kalamazoo Alliance for Equality, which proposed the original concept — say they’ll support the new measure.

TAKE ACTION: Obama Defends DOMA
President Obama had a chance to take a strong stance against the Defense of Marriage Act – and he blew it, going back on his promise to repeal the discriminatory law.
In a recent California Federal Court challenge filed by a couple married in California, President Obama’s Justice Department filed a brief supporting DOMA and justifying discrimination in government benefits against legally married same-sex couples.Enough is enough.
Demand that President Obama stop defending DOMA and instruct the Department of Justice to take any and all actions to support its repeal.
Demand President Obama push for complete equality for LGBT Americans, as he promised during his campaign.
