Wash. gay partnership foes say “too close to call”
OLYMPIA, Wash. —
Washington state’s latest expansion of domestic partnerships for gay couples was hanging in limbo Friday as opponents announced a final push to force a public vote, calling their effort so far “too close to call.”
In a statement to supporters, organizers of the Referendum 71 campaign said they believe they will have at least the minimum 120,577 petition signatures needed by Saturday to qualify for the ballot.
However, R-71 organizer Gary Randall said the campaign doesn’t have enough extra signatures to act as a cushion for erroneous or duplicate petition signatures, which must come from registered Washington voters.
To help meet the deadline, Randall appealed to R-71 supporters to gather additional signatures and drive them to the state Capitol on Saturday afternoon.
“We’re not trying to have a rally or anything,” Randall said later by telephone. “We need the signatures, we truly do.”
The new “everything but marriage” expansion of domestic partnerships is scheduled to take effect Sunday, but the law will be delayed if referendum sponsors turn in their petitions.

Local media swallows ‘bathroom bill’ rhetoric
On July 14, the day of a legislative hearing on the transgender rights bill currently on Beacon Hill, WCVB’s NewsCenter 5 ran a story about the bill on its evening newscast. Anchor Liz Brunner introduced the story by saying, “It’s being called the bathroom bill, [and it] is essentially meant to end discrimination based on transgender status.” Behind Brunner was an image of the traditional male and female stick figures found on restroom doors, positioned next to the State House dome and above the tagline, “Bathroom Bill.” Yet the only people calling the trans rights bill, House Bill 1728, a “bathroom bill” are its opponents, and the label is a misnomer by any objective criteria.
H.B. 1728 adds trans-inclusive language to the state’s non-discrimination laws in the areas of employment, public accommodations, credit, housing, and education, as well as to the state’s hate-crimes laws, going far beyond simply allowing transgender people to use bathrooms that match their gender identity or expression. Opponents of the legislation, led by the Massachusetts Family Institute (MFI), claim that the bill will allow male sexual predators to masquerade as women and sneak into women’s restrooms and locker rooms. WCVB’s coverage of the transgender rights bill, as well as the coverage by some other local media outlets, suggests that the work of the bill’s opponents to label the legislation a bathroom bill in public discourse has been at least somewhat successful. Another front for fairness
AT A HEARING at the State House last week, supporters of a bill to ban discrimination on the basis of gender identity and expression outlined the myriad barriers that confront transgender people – those who are born male but live as females, or vice versa. Unlike those whose religions or sexual orientations expose them to discrimination, transgendered people might not be able to avoid the issue when applying for jobs, apartments, or loans. The truth may become evident from a check on a Social Security number or a search of credit reports.
Transgender advocates aren’t looking for sympathy. The goal of the legislation, introduced by Representative Carl Sciortino, is to give transgender residents of Massachusetts space to live without discrimination or violence. The bill responds sensibly to a real problem, and deserves to pass.
Transgender people don’t make the transition lightly; many, though not all, undergo gender-reassignment surgery. The case of Dana Zircher, profiled recently by the Globe’s Bella English, underscores the difficulty of the process, even when individuals have supportive families and employers. Zircher, a software designer and a parent, has undergone a divorce, surgery, and 350 hours of electrolysis.
Instead of addressing the complexities of actual people’s lives, though, opponents are trying to undermine Sciortino’s legislation by calling it a “Bathroom Bill.’’ The difference between a transgender woman and a man who wants to infiltrate a ladies’ room is perfectly obvious, at least to anyone who is not deliberately obfuscating the issue. The difference would surely be obvious to police officers and judges. Thirteen other states, including Vermont, Maine, and Rhode Island, and dozens of cities, including Boston and Cambridge, already forbid discrimination against transgendered people – and public washrooms are as safe as ever.

Senate adopts amendments to hate crimes measure
The U.S. Senate has adopted a hate crimes measure as part of the fiscal year 2010 defense authorization bill — and with it, amendments introduced by an opponent of hate crimes legislation.
Adopted on July 16 by unanimous consent after cloture was invoked, 63-28, the hate crimes measure was altered by four amendments. All four amendments were approved Monday.

Effort To Ban Gay Unions Falling Short In Wash. State
The effort to place a gay-inclusive domestic partnership law up for a vote in Washington State appears to be falling short.
With a looming deadline of Saturday at 2PM, opponents of the law dubbed by the media as the “everything but marriage law” have only 4 full days left to gather thousands of valid signatures.
Opponents – a coalition of mostly religious groups – announced their attempt to repeal the bill in November, even before it became law in May. Gary Randall, president of the Faith and Freedom Network, says his group filed Referendum 71 because the law is too close to marriage and violates the law.
“The bill … elevates homosexual relationships to that of traditional marriage, thus eliminating any legal difference between domestic partnerships and marriage,” Randall wrote in a blog entry posted on the group’s website before the bill became law.
“I do not believe a majority [of] Washingtonians believe in homosexual marriage, nor do they want to become a national attraction for homosexuals from other states and countries,” he added.
Organizers, however, admit that they have fallen desperately behind in collecting the 120,577 valid signatures needed to qualify the measure. Randall told the conservative group Concerned Women for America that only 75,000 signatures had been collected as of Friday. Leaving the group at least 45,577 signatures short. But in order to ensure there are sufficient valid signatures, the group estimates it needs to collect 75,000 signatures. In other words, opponents need to collect as many signatures in one week as they did in the previous seven to eight weeks.
The Democratic-controlled House passed the bill in April along a mostly party-line vote of 62 to 35. Senators approved the bill in March with a 30 to 18 vote, and Governor Chris Gregoire signed the bill into law on May 18. See Effort To Ban Gay Unions Falling Short In Wash. State

Marriage backers are being outspent by foes in Maine referendum
The group trying to defend Maine’s marriage-equality law in a Nov. 3 referendum is raising money at a slower pace than the law’s opponents. The latter has brought in more than $343,000, while marriage backers have reported contributions of $138,640. Portland Press Herald (Maine)

Gay marriage stalls as RI lawmakers wrap up
PROVIDENCE, R.I. — Rhode Island seems almost certain to remain the only New England state that does not recognize gay marriage after measures legalizing same-sex unions stalled just before the part-time General Assembly ended the bulk of its annual work.
None of the bills legalizing same-sex marriage in Rhode Island advanced to a floor vote this session, continuing a trend begun in 1997.
The lack of State House action on gay unions means that Rhode Island is unlikely to allow same-sex marriage anytime soon, despite decisions this year by lawmakers in New Hampshire, Maine and Vermont to join Connecticut and Massachusetts in legalizing marriage equality.
“I was hoping the momentum that was going around New England and the support we had in the House would get enough representatives to ask for it,” said Rep. Frank Ferri (D-Warwick), who is gay and sponsored same-sex marriage legislation. He and his partner wed in Canada.
Equally disappointed were marriage equality opponents, who wanted voters to be able to decide whether the state constitution should be changed to ban gay marriage.
“I think that if you put it to the voters on a statewide basis, gay marriage would fail,” said Rep. Jon Brien, D-Woonsocket.

Judge Declines to Stay Law on Gay Marriage
A Superior Court judge decided yesterday not to delay enactment of a law stipulating that the D.C. government will recognize same-sex marriages performed in other jurisdictions.
Judge Judith E. Retchin ruled that she would not a grant a stay preventing the law from taking effect Monday, as requested by opponents. However, the effective date is likely to be delayed by the need for congressional approval. Attorneys for the group said they needed more time to research and argue their position before the law takes effect.
Opponents, led by Bishop Harry Jackson of Hope Christian Church in Beltsville, and seven other D.C. voters want a referendum on the issue, but the D.C. elections board said that would be illegal under the District’s Human Rights Act.
Although Retchin decided against delaying the law’s enactment, she said opponents could seek to amend the law after the marriage provision takes effect.

Gay marriage now key issue for Corzine
Gov. Corzine has made “marriage equality” for gays and lesbians a prominent piece of his reelection campaign, taking another step in his conversion on the issue and encouraging gay-rights advocates who hope to see same-sex marriage approved in New Jersey this year.
In public speeches and private appearances, Corzine, who as recently as 2006 said he believed marriage should be between a man and a woman, has touted his support of same-sex marriage.
In raising the issue, he has tried to draw a bright-line divide with his Republican opponent, Christopher J. Christie, who has said he would veto a bill allowing gay and lesbian couples to wed.
“We believe that government should allow people the freedom to marry whomever they love,” Corzine said in his general-election kickoff speech June 2.
At a gay-pride parade days later in Asbury Park, N.J., Corzine referred to his campaign and told cheering revelers: “Marriage equality is on the ballot. Are you going to help us make it come to pass in New Jersey?”
His campaign posted a video clip online showing the event.

LGBT discussion takes on a new tone in the Ohio Statehouse
Columbus–As the House State Government committee considered a bill to outlaw discrimination by sexual orientation or gender identity, State Rep. Cliff Hite of Findlay challenged Crystal Curry of the anti-gay Concerned Women for America.
“You and the other [Equal Housing and Employment Act opponents] have testified that homosexuals are only about three percent of the population,” said Hite, a Republican. “So how is it that three percent represents such a threat?”
“They’re not,” Curry answered, “unless we give them civil rights and allow them to marry. Then they are a threat. Three percent is not harmful unless they keep pushing and pushing and take on rights.”
Curry then told lawmakers that because LGBT people use the word “gay” instead of “homosexual” and Will and Grace has gay characters, homosexuality will “become accepted.”
“Kids will grow up and try it,” she complained.
The exchange caused a visible reaction in Hite and other committee members, both Democrats and Republicans.
This illustrates what might be the most significant development in the bill’s movement through the Ohio legislature:
The measure’s opponents can no longer make wild, unsubstantiated and long-debunked claims about the lives of LGBT people without challenges from both sides of the partisan aisle.
