It’s the wound that won’t heal. The rift that won’t close. And earlier this month, two gay lovers’ purportedly innocuous late-night kiss — though LDS Church officials insist it was far more amorous than that — ripped it wide open. Utah’s simmering religious divide boiled over — once again — at the geographical and philosophical intersection of church and state: the Main Street Plaza in downtown Salt Lake City. “It is a scab that will continue to be peeled away — and may never heal,” says Dani Eyer, the former ACLU director who fought to preserve First Amendment rights on the plaza. Matt Aune and Derek Jones say they held hands, kissed and then squabbled with security guards on the LDS Church-owned square. Salt Lake City police issued a ticket for trespassing. In protest, supporters of the couple staged a “kiss-in” last Sunday outside the plaza and plan another such demonstration today. The LDS Church — a faith to which 60 percent of Utahns belong — defended its right to regulate “inappropriate behavior” on the plaza. “What we’re seeing now is a manifestation of what should have been obvious from the very beginning,” says former Salt Lake City Mayor Rocky Anderson. “This block of Main Street never should have been conveyed to the LDS Church. It was a recipe for ongoing resentments between the LDS Church and those who are not members.” The church bought the strip of Main — from North Temple to South Temple — in 1999 after then-Mayor Deedee Corradini and the City Council, with the only two non-LDS members dissenting, signed off on the $8.1 million deal. But the controversy burned for five more years as federal courts were asked to settle the prickly issue of whether the church could govern expression on the plaza and whether the city could retain a public right of way (as outlined in the original deal). “It was meant to be for everybody,” Eyer says. “Where people come and go their constitutional rights go with them.” After a 10th U.S. Circuit Court of Appeals ruling in 2002, First Amendment activities returned to the plaza. But demonstrations by anti-Mormon protesters — including cries of “whore” and “harlot” hurled at newlywed brides — “sustained divisions” that “reached to the point of hatred” between Mormons and non-Mormons, Anderson says. In the end, he agreed to trade the public easement for cash and LDS land to build a west-side community center.

Last November, Jay Pimentel began hearing that people in his neighborhood were receiving letters about him. Pimentel lives in Alameda, Calif., a small, liberal-leaning community hanging off Oakland into the San Francisco Bay. Pimentel, who is a Mormon, had supported Proposition 8, the ballot initiative banning same-sex marriage. And that made him a target. “Dear Neighbor,” the letter began, “Our neighbors, Colleen and Jay Pimentel” — and it gave their address — “contributed $1,500.00 to the Yes on Proposition 8 campaign. NEIGHBORS SHOULD BE AWARE OF THEIR NEIGHBORS’ CHOICES.” The note accused the Pimentels of “obsessing about same-sex marriage.” It listed a variety of local causes that recipients should support — “unlike the Pimentels.”
Pimentel, a lawyer and a lay leader in the small Mormon congregation in Alameda, is markedly even-keeled. Yet the poison-pen note still steams him, even though in May the California Supreme Court validated Prop 8 as constitutional. He is bothered less by the revelation of his monetary contribution, which he stands by, than the fact that the letter’s author didn’t bother to find out that every other Saturday for 15 years, he or someone else from Alameda’s 184-member Mormon ward has delivered a truckload of hot meals to the Midway Shelter for Abused and Homeless Women and Children — one of the organizations the Pimentels allegedly wouldn’t support. “The church does a lot of things in the community we don’t issue press releases about,” he says. “And when people criticize us, we often just take it on the chin. I guess you could say I’m not satisfied with the way we’re seen.”
Across the country, that’s the dilemma facing the Church of Jesus Christ of Latter-day Saints. With 13 million members worldwide (by its own count), the LDS is the fourth largest church in the country, the richest per capita and one of the fastest-growing abroad. The body has become a mainstream force, counting among its flock political heavyweights like former Republican presidential candidate Mitt Romney and Democratic Senate majority leader Harry Reid, businesspeople like the Marriotts and entertainers like Glenn Beck and Twilight novelist Stephenie Meyer. The passage of Prop 8 was the church’s latest display of its power: individual Mormons contributed half of the proposition’s $40 million war chest despite constituting only 2% of California’s population. LDS spokesman Michael Otterson says, “This is a moment of emergence.”

How Far Will Mormons Go to Fight Gay Marriage?
If a gay marriage question is put on the California ballot in 2010, it will put the Church of Jesus Christ of Latter-day Saints at a seriously interesting crossroads.
It has been three or four decades since the Mormon Church chose a low profile in American politics, after its opposition to the Equal Rights Amendment, and theological hostility to black Americans, spurred an anti-Mormon backlash. The Mormons are among the most persecuted of American sects, and highly sensitive to criticism.
The church’s low-key strategy seemed to work. There are still some Mormon-haters in evangelical Christian circles, but for the most part the Mormons are accepted and admired, and church membership has soared. Mormon politicians like former Massachusetts Gov. Mitt Romney and Utah Gov. Jon Huntsman are regarded by mainstream America as legitimate presidential timber.
Mormon watchers were surprised, then, when the church hierarchy took such an active role in the passage of Proposition 8 in California, limiting marriage to a man and a woman. Gay Americans were surprised as well. They didn’t expect the church to embrace gay marriage, but neither did they predict that the Mormon Church would emerge as a resolute and politically-active foe, whose support for Prop 8 was perhaps determinative. Some of the resultant anti-Mormon rhetoric has been vicious.
Now that Prop 8 has been upheld by the California Supreme Court, gay rights groups say they will put gay marriage on the ballot in California again, and mount a full scale effort to win public approval, perhaps as soon as 2010.
That will put the ball back in the church’s court. The family is at the center of Mormon theology. But the national political trends are running against the church. Younger Americans—even young evangelicals—are more than willing to see their gay friends get married.
Opposing gay marriage in Utah (as the church did in 2004) is one thing, but taking a lead public role in a national campaign to deprive a persecuted minority of a right shared by all other Americans is another. It would be seen as a sign that the days of low-key tactics are over, and that the current Mormon leaders are prepared to give, and get, the political bruising that occurs when religion mixes with politics in America.

As more states take up the debate on same-sex marriage, some advocates of legalization are taking a very specific lesson from California, where the Church of Jesus Christ of Latter-day Saints dominated both fundraising and door-knocking to pass a ballot initiative that barred such unions. With the battle moving east, some advocates are shouting that fact in the streets, calculating that on an issue that eventually comes down to comfort levels, more people harbor apprehensions about Mormons than about homosexuality. “The Mormons are coming! The Mormons are coming!” warned ads placed on newspaper Web sites in three Eastern states last month. The ad was rejected by sites in three other states, including Maine, where the Kennebec Journal informed Californians Against Hate that the copy “borders on insulting and denigrating a whole set of people based on their religion.” “I’m not intending it to harm the religion. I think they do wonderful things. Nicest people,” said Fred Karger, a former Republican campaign consultant who established Californians Against Hate. “My single goal is to get them out of the same-sex marriage business and back to helping hurricane victims.”

Governor Gregoire Signs Domestic Partnership Law
It’s not marriage. But a new law in Washington state will soon give gay and lesbian couples the same legal rights as married couples. Governor Gregoire signed the measure Monday.
Hundreds of couples, families and children packed into a muggy Seattle community center, to celebrate a victory. They cheered as Governor Chris Gregoire signed the so–called “everything but marriage” bill.
Gregoire: “It is time for all us here in the state of Washington to stand up and say, ‘We stand for justice. And we stand for shared responsibility to one another.’ Today is that day.”
This measure is the latest step in a three–year effort to give gay couples the same rights as married couples. This final piece adds spousal benefits and rights previously denied to some domestic partners, like workers’ compensation and disability insurance.

NBC Bay Area.com is reporting that Archbishop George Niederaurer of San Francisco’s Most Holy Redeemer Church refused to allow a group of Catholic high school students to peform a gay-themed play yesterday.
Apparently, students from Sacred Heart Preparatory in Atherton were scheduled to perform “Be Still and Know” at the church, but at the last minute Niederaurer changed his mind and told them to “go home.” The play is an adaptation of The God Box, a novel by Alex Sanchez, about a a male Christian high school student who struggles to reconcile bibilical scripture with his burgeoning homosexuality when he befriends a new student who is openly gay.
Neideraurer, who actively supported the Yes on Prop 8 campaign, came to San Francisco from Salt Lake City and is rumored to have been instrumental in getting the Mormons involved in the issue. He’s the Archbishop who took heat from the Catholic community when he gave communion to two members of the Sisters of Perpetual Indulgence who were dressed in drag. His church “welcomes all people of good faith, regardless of their background, gender, race, social status, gender identity, or sexual orientation”, according to its website.

Illinois Mormons against civil unions?
Gay rights advocates fear that Mormons in Nauvoo might try to undermine civil unions up for debate in Springfield today. They point to the church’s overwhelming financial support of California’s Proposition 8, the successful ballot measure that made it illegal for lesbian and gay couples to marry.
The Human Rights Campaign, the nation’s largest lesbian, gay, bisexual and transgender civil rights organization, accused the Latter-day Saints of sending a private e-mail to Illinois members, urging them to contact state legislators and voice opposition to the Illinois Religious Freedom Protection and Civil Union Act, a bill that would define “civil union” as a legal relationship between two persons, of either the same or opposite sex. It would also entitle both parties of a civil union to the same legal obligations, responsibilities, protections, and benefits afforded to spouses.
The bill has been scheduled for a hearing in the Illinois House of Representatives Youth and Family Committee today. If the bill is voted out of committee, it becomes eligible for a vote before the full Illinois House of Representatives.
But Kim Farah, a spokeswoman for the national church, said the e-mail was not part of a church wide opposition campaign. The church’s engagement with political causes is evaluated on a case-by-case basis. It is unclear if the Illinois legislation would violate church doctrine as interpreted by Latter-day Saints.
“As is widely known, The Church of Jesus Christ of Latter-day Saints believes in the sanctity of traditional marriage,” she said in a statement. “The Church has not taken a position on any legislation currently being considered by the Illinois State Legislature … An e-mail was sent from a local Illinois Church leader to his congregation – one of 129 congregations in the state — who was free to express his own views.”
The e-mail in question was sent to at least one Mormon ward in Illinois and authorized by Bishop Chris Church of Nauvoo.
The message warns recipients that the legislation would “empower the public schools to begin teaching this lifestyle to our young children regardless of parental requests otherwise.”
