SCLC SPLIT OVER GAY MARRIAGE: Los Angeles office at odds with national officials.
*Civil Rights Movement icon Dr. Martin Luther King, Jr. led a group of Black activists who founded the Southern Christian Leadership Conference (SCLC) in 1959.
Even after King’s assassination in 1968, the SCLC remained one of the nation’s leading civil rights organizations. But now the group’s cohesion is under threat. The issue which could potentially split the organization is same-sex marriage.
The Atlanta, Georgia-based leadership of the group has threatened to suspend or remove Rev. Eric P. Lee as head of the Los Angeles SCLC chapter because of his outspoken support for homosexual marriage.
But Lee and supporters in the L.A. chapter are fighting back essentially arguing that the national board does not have the authority to remove him. Lee is also thought to be seeking support from other SCLC chapters around the country.
Officially the national board says it is neutral on the gay marriage issue but in reality, the group dominated by Black Southern ministers is strongly opposed to same-sex marriage. Their view appears to be backed by a large majority of African Americans. An Edison/Mitofsky exit poll found that 70 percent of Black voters supported California’s Proposition 8 last fall. The proposition banned gay-marriage in the state.
A similar national online survey conducted recently by Taylor Media Services found 72 percent of Blacks opposing same-sex marriage which was supported by a slim majority of whites. Hispanics were evenly split on the issue.

Gay marriage case will go to Supreme Court: attorney
The attorney representing two same-sex couples who were denied a right to wed in California said on Thursday he expected the case to end up before the U.S. Supreme Court, which has yet to hear a case on the gay marriage issue.
“When it does get to the United States Supreme Court, we expect to win,” Theodore Olson, who was solicitor general under former President George W. Bush, told reporters after the first hearing on federal lawsuit that was filed in May.

Voter ‘animus’ to be issue in Calif marriage case
When the U.S. Supreme Court overturned an amendment to the Colorado Constitution that outlawed discrimination protections for gay people, same-sex couples could not enter into civil unions or domestic partnerships anywhere in the nation, much less get married. But as they seek to persuade a federal judge to strike down California’s ban on gay marriages, lawyers for two unmarried gay couples are using that 13-year-old decision as their road map — one they expect will eventually lead the high court to take up the marriage issue. In the Colorado case, Romer v. Evans, the Supreme Court majority held that voters’ dislike of gays and the laws that several cities had approved to shield them from bias motivated the state amendment. Such “animus,” it said, was incompatible with the section of the U.S. Constitution that requires the government to treat its citizens equally absent a compelling reason to do otherwise. The attorneys behind the challenge to California’s Proposition 8 plan to argue during a pretrial hearing Thursday that by stripping gays of the right to wed, the voter-approved ban runs afoul of America’s founding framework in the same way — and for the same reason. “Romer is a strikingly similar situation to what we have here. You had a ballot initiative, a majority vote of the people, taking away a right,” said Theodore J. Boutrous Jr., a member of the legal team led by former U.S. Solicitor General Theodore Olson and veteran trial lawyer David Boies. “And there was no justification or rationale other than disapproval by that majority of that group.” U.S. District Chief Judge Vaughn R. Walker on Tuesday issued a tentative order to fast-track the case in his San Francisco court. Among the questions he said he wants covered at trial are whether sexual orientation is unchangeable, if permitting same-sex marriage “destabilizes” traditional unions and whether Proposition 8′s ballot history demonstrates the measure had “discriminatory intent.” California Attorney General Jerry Brown, a defendant in the case, has sided with gay rights advocates and declined to defend the ban, which overturned a California Supreme Court ruling that had legalized same-sex marriages. The state Supreme Court five weeks ago upheld the measure, saying it represented a valid exercise of voters’ authority to amend the California Constitution. Proposition 8′s sponsors, a coalition of religious conservative groups called Protect Marriage, has been given permission to intervene in the federal case. In court papers, the group’s lawyers rejected the assertions that anti-gay attitudes fueled the November measure and that the 1996 Colorado case was applicable. “Nothing in California law, either Proposition 8 or otherwise, indicates that Californians harbor animus towards gay and lesbian individuals,” they wrote. Since the U.S. Supreme Court’s 6-3 decision, attorneys for gay rights and Christian conservative groups have debated whether the Romer decision could be used to expand gay rights. The ruling marked the first time the Supreme Court determined that the Constitution’s equal rights guarantees extended to gays and lesbians. “The basic point of Romer is that government cannot ever act out of hostility toward a group of people, and whether that is in the context of marriage or anti-discrimination law, the point carries over,” said Suzanne Goldberg, who worked on the case and now directs Columbia Law School’s Sexuality and Gender Law Program. The ruling has been cited, though so far unsuccessfully, in past challenges to gay marriage bans in Nebraska and Florida. At the same time, gay rights groups mostly have shied away from pursuing federal marriage cases in favor of pursuing marriage rights in state courts. Legal observers on both sides of the debate agree, however, that California’s Proposition 8 presents novel questions that could make the issue ripe for federal action.

NY Gay Marriage Bill Faces New Challenges
With what some are describing as a “circus” in Albany, many gay marriage supporters fear that proposed legislation recognizing same sex marriage in New York will not come up for a vote in a state Senate in flux.
And now, one group is also trying harder to keep that from happening. The National Organization for Marriage announced Tuesday that they have set up a Political Action Committee for New York to fight the measure.
With the announcement, Executive Director Brian Brown also said that the first $500,000 raised will be used to back a primary challenger to GOP Senators who vote for gay marriage.
“The first half million dollars will be used in GOP primaries,” Brown said. “But we are also looking to aid Democratic candidates who want to buck the establishment on the marriage issue, and to help in general election contests.”

DC Panel Hears Arguments On Gay Marriage Referendum Washington Post -
The battle over same-sex marriage in the District moved to the city election board yesterday as supporters and opponents packed into a hearing room to debate whether the city should put the issue on the ballot.
The D.C. Board of Elections and Ethics, which currently has two members and one vacancy, will determine whether voters should have a chance in a referendum to block a bill legalizing same-sex marriages performed elsewhere.
The board heard four hours of testimony yesterday and is expected to make a decision Friday or early next week.
Both sides presented legal and political arguments about whether the same-sex marriage issue should be in the hands of voters or the politicians who represent them.
“All we are asking for is a public debate,” said the Rev. Dale Wafer, a supporter of the referendum and a minister with the Harvest, a religious community in Northeast Washington. “We are not afraid of a debate. All we want is a public debate.”
Philip E. Pannell, a longtime gay rights advocate and Democratic Party activist, accused referendum supporters of “advocating for a popular vote that will give vent to public homophobia.”

Mike Gin, Redondo Beach’s Chinese-American, Rotarian, Gay Mayor
After months of living legal limbo, Redondo Beach Mayor Mike Gin’s marriage was finally declared legal several days ago by the California Supreme Court. But marital validation was no tonic for Gin, who wasn’t celebrating the landmark decisions on same-sex marriage issued last week by the California Supreme Court.
“It’s a bittersweet feeling,” he admits. “My husband and I are thrilled about that part of the ruling that affects us, but there are many other couples now who cannot share in the happiness that we were able to experience on our wedding day. I’m hoping that someday all of us can experience that same happiness.”
Gin and his husband, Christopher Kreidel, were part of the pool of approximately 18,000 gay people married after the California Supreme Court ruled a year ago that same-sex marriages were legal, but before the Proposition 8 vote last fall banned same-sex marriage.
Despite the ruling early last week upholding Prop. 8, he is not discouraged. He notes that Prop. 22, the long-standing gay-marriage ban overturned by the courts last May, passed in 2000 with 60 percent of the vote, while Prop. 8 passed with only 52 percent.
“I think it is still a very strong social issue on both sides in our society right now,” he says. “But the voting numbers show that as a society we’re moving in the right direction.”
Gin is an unusual public official in that he is gay, married, Asian-American — and popular at a time when California politicians are reaching new lows in approval-rating polls. After serving eight years on the Redondo City Council and four as mayor, Gin has developed a reputation as a classic old-school politician who listens patiently to residents, considers a wide array of arguments and interests before making a decision, and goes out of his way to avoid confrontation.

Gay Activists, Black Ministers Seek Common Ground in DC
WASHINGTON — When the District of Columbia city council voted 12-1 recently to recognize same-sex marriages performed in other jurisdictions, a raucous protest led by African-American ministers erupted in the hallway outside council chambers.
Security officers quelled the pandemonium, but not before video and cell phone cameras captured images of the confrontation — with councilman Marion Barry, who cast the lone dissenting vote, predicting “civil war” over the issue in the D.C. black community.
Watching the commotion was the Rev. Robert Hardies, who happened to be in City Hall on another matter when the ministers stormed the corridor.
“I was heartbroken,” says Hardies, a gay man who is senior minister at the city’s historic All Souls Church, Unitarian.
“I had vowed to myself that after what happened in California, when the gay marriage issue came to Washington, D.C., we would do it differently and prevent the racial divide,” he said.

Gay marriage a minefield for candidates for California governor
From the start of his run for governor, San Francisco Mayor Gavin Newsom has tried to show there is more to his career than the gesture that won him worldwide fame: his 2004 decree legalizing same-sex marriage.
Yet there he was Tuesday on CNN’s “Larry King Live,” speaking out for gay rights after the state Supreme Court upheld Proposition 8, the same-sex marriage ban that Californians passed in November.
For Newsom and five major-party rivals, the resurgence of the same-sex marriage issue has added a new complication to the race for governor.
If gay rights groups get their way, the nominees to succeed Gov. Arnold Schwarzenegger will share the November 2010 ballot with a measure to repeal Proposition 8, turning an emotionally charged cultural issue into a central focus of the campaign.
Across the nation, the subject has grown more challenging for candidates of all kinds as the mere concept has given way to the reality of tens of thousands of married gay couples. Massachusetts, Connecticut, Vermont, Maine and Iowa have legalized same-sex marriage.
Voters have also shifted their views. In April, a Washington Post-ABC News poll found that 49% of Americans said gay marriage should be legal, and 46% said it should be illegal. Three years earlier, 36% had said it should be legal, and 58% had said it should not.
“The trajectory of public opinion on this issue has been dramatic,” said Democratic pollster Mark Mellman.
In California, where Newsom’s rebel edict in 2004 touched off the court battles that spawned some 18,000 marriages that were declared valid Tuesday, candidates for governor face multiple dangers on the issue. Although support for gay marriage has risen over the last decade — the 52% yes vote on Proposition 8 was down from 61% on a similar measure in 2000 — the issue still sharply divides Californians.
“People care about this one — a lot — on both sides,” said Steve Smith, a Democratic strategist who worked on the campaign to defeat Proposition 8.
A Field Poll taken three months ago affirmed stark generational and ideological splits on same-sex marriage.
Younger voters were far more likely to approve of it than older voters. And Democrats overwhelmingly favored it, while Republicans were strongly opposed.

Gay Marriage Is Anti-Small Business, Says Michael Steele
GOP Chairman Michael Steele explained in a recent speech how his party should “recast” the gay marriage issue as not just a social issue, but a business issue:
“Now all of a sudden I’ve got someone who wasn’t a spouse before, that I had no responsibility for, who is now getting claimed as a spouse that I now have financial responsibility for,” Steele told Republicans at the state convention in traditionally conservative Georgia. “So how do I pay for that? Who pays for that? You just cost me money.”
It’s almost unfair to comment on this because it’s so hard to figure out what Steele even means here. I guess he’s saying that if a small-business owner has gay employees who suddenly are able to get married, that owner will have to pay higher benefit costs, such as higher health-care premiums to insure the spouse.
