MD State AG studies recognizing out of state gay nuptials
Attorney General Douglas F. Gansler is exploring whether same-sex marriages performed in other states can be recognized in Maryland, a move that could open an avenue for legal recognition of gay and lesbian couples who have been rebuffed by the courts and legislature here.
The exercise puts Gansler – a Democrat and vocal proponent of same-sex marriage – in a difficult position. Maryland law clearly defines marriage as between a man and a woman, but the state also adheres to a long-standing legal principle that generally acknowledges couples married elsewhere.
Gay-rights activists say the ability to marry would not only strengthen their relationships but confer hundreds of rights, benefits and responsibilities on them, including community property protections, control over funeral arrangements of a spouse and an obligation to pay child support.
For many married same-sex couples living in Maryland, the issue isn’t just a legal conundrum but deeply personal.

Marriage Equality and Religious Freedom Win in Key Statehouse Vote In New Hampshire
Committee of Conference votes to advance HB73
CONCORD Today the house and senate committee of conference in the New Hampshire legislature voted in favor of a compromise bill that will advance the freedom to marry while ensuring religious liberties.
HB73 is a bill that will uphold the Constitutional right to freedom of religion, while complimenting previously passed bills that grant marriage equality to same-sex couples. Today’s committee of conference decision treats gay and lesbian people as well as people of faith with dignity and respect. The conference committee report on HB73 is expected to be voted on by the full legislature on June 3rd.
“We remain confident that marriage equality will become law this year, and HB 73 is an important final step in that effort,” said Mo Baxley the Executive Director of New Hampshire Freedom to Marry. “Individual equality and religious freedom are New Hampshire values. We expect the House and Senate to now vote for HB 73 as reported out by the committee of conference. This is a very positive step and we remain optimistic that we will see legal protections for thousands of gay and lesbian couples signed into law by the Governor.”
The freedom to marry for gay couples, partnered with religious protections in HB73 is supported by Governor Lynch, the State Senate, the committee of conference, and the majority of New Hampshire residents.

Gay? Lesbian? Looking fabulous and over 50?
The Sexual Health Team at Public Health Development are currently in the process of producing a guide about relationships/sexual health and the over 50s.
The guide will contain photography of individuals and couples that will tell some story about their relationship to sensuality, sexual expression, and sexual well being.
The models will have control over the shots – they can be subtle in nature or more edgy – depending on how people want to be.
Most of the photography is taking place in people’s homes, but it could also happen outside (it’s just weather dependant). The photography is taking place at the end of June.
The Sexual Health Team are looking for gay and lesbian couples and individual lesbians and gay men, aged between 50 and 80, who are willing to volunteer to be models.

Gay Divorce Still Legal in California
Gay and lesbian couples who took advantage of California’s brief fling with gay marriage last year to tie the knot, but now can’t stand the sight of one another, will be relieved to hear that gay divorce remains an option.
Frederick Hertz, a lawyer in Oakland, Calif., who specializes in same-sex family law, told The Lede that since California’s Supreme Court ruled on Tuesday that same-sex marriages that took place in 2008, before voters approved a ban in November, will remain “both valid and recognized,” that means “all the rules of marriage apply, including divorce.” That said, the state’s new law explicitly outlawing same-sex-marriage does create something of a gray area for couples who live in California, but were married in another state, or nation, and now want to get a divorce. As Mr. Hertz explains, the problem for unhappily married same-sex couples living in a state that bans same-sex marriage, is that “getting a divorce requires a recognition of the marriage.”
In an article explaining how the legal patchwork of state laws makes it nearly impossible for some same-sex couples to get divorced, the Los Angeles Times reported that a lesbian couple from Rhode Island who got married in Massachusetts were later denied a divorce in their home state, since the courts there can not recognize their marriage. Center CEO Welcomes Obama to L.A. With Open Letter, Urging Him to Fulfill Campaign Promises and Speak Out in Favor of LGBT Equality
LOS ANGELES, CA — The L.A. Gay & Lesbian Center’s Chief Executive Officer Lorri L. Jean released the following letter to President Barack Obama today:
Dear President Obama:
Welcome to California, Mr. President. I welcome you with a heavy heart because of the California Supreme Court’s decision to uphold Prop. 8, relegating same-sex couples to second-class status and denying us that most noble promise of America, “liberty and justice for all.”
You are arriving in Los Angeles on the heels of emotional demonstrations throughout California and our nation and your silence at such a time speaks volumes. LGBT people and our allies have the “audacity to hope” for a country that treats us fairly and equally and for a President with the will to stand up for those ideals. From you we expect nothing less.
We know the country faces many serious challenges and we have strived to be patient. We’ve waited for the slightest sign you would live up to your promise to be a “fierce advocate” for our equal rights while watching gay and lesbian members of the armed forces, who have never been more needed, get discharged from the military. And so far you have done nothing. No stop loss order. No call to cease such foolish and discriminatory actions that make our nation less safe.
You pledged to repeal the “Don’t Ask, Don’t Tell” policy, Mr. President. You promised to support a “complete repeal” of the so-called Defense of Marriage Act and pledged to advocate for legislation that would give same-sex couples the 1,100+ federal rights and benefits we are denied, including the same rights to social security benefits. You said, “Federal law should not discriminate in any way against gay and lesbian couples.”
What of those promises, Mr. President?
Your commitment to repeal DOMA has been removed from the White House Web site. Your promise to repeal Don’t Ask, Don’t Tell was removed and then replaced with a watered-down version. And in the aftermath of yesterday’s California Supreme Court ruling, you have remained silent while your press secretary summarily dismisses questions about the issue.
We not only need to hear from our President, we need his action. And we need it now.
We need your words, Mr. President. But we also need your deeds. We expect you to fulfill the promises you made to us. As Dr. Martin Luther King Jr. taught us, “Justice too long delayed is justice denied.” Do not delay, Mr. President. The time for action is now.

For gay couples, married matters
Five years after the first same-sex weddings in Massachusetts, gay and lesbian couples express deeply traditional reasons for deciding to wed and cite equally conventional benefits flowing from marriage, according to a study being released this week.
A significant majority of the 558 gay men and women surveyed said that since marrying, they feel more committed to their spouses, more accepted in their community, and more likely to be open about their sexual orientation at work.
The survey indicates that there is something universal about the legal protections and social advantages afforded by the institution of marriage, said the study’s authors from the University of California, Los Angeles as well as independent researchers. And it suggests, they said, that a ritual once scorned even by many same-sex couples has the power to ease discrimination.
“This really helps us confirm and makes us understand why same-sex couples demand marriage – if it’s just about the legal rights, why wouldn’t they be happy with civil partnerships?” said Stephanie Coontz author of “Marriage, A History.”
“They want access to that word that is so highly valued by our society and by other people.
“It is one thing not to invite your child’s girlfriend or boyfriend to dinner,” said Coontz, a professor at The Evergreen State College in Olympia, Wash. “It is quite another thing not to invite the spouse.”
Same-sex marriages began in Massachusetts on May 17, 2004, after the Supreme Judicial Court declared that gay and lesbian couples had the right to wed. The ruling ignited a political and social maelstrom in Massachusetts and beyond, but since then four other states – Connecticut, Iowa, Maine, and Vermont – have extended marriage rights to same-sex couples. Lawmakers in New Hampshire are currently debating whether to make their state the next to do so.
The study was prepared and paid for by UCLA’s Williams Institute, which examines legal and public policy issues related to sexual orientation and is funded by foundations and individuals, including supporters of gay marriage.
The authors of the survey, which consisted of about 30 questions, said they regarded it as an initial assessment of gay marriage, largely designed to explore issues arising during public debate rather than to delve into more personal aspects of couples’ relationships. For example, researchers asked whether respondents’ children had faced taunting as a result of their parents’ same-sex marriage – only 5 percent had – but did not ask how happily married partners were.
“We’ve been interested in the impact of marriage for a long time,” said Lee Badgett, researcher director of the Williams Institute and senior author of the study. “I’ve been combing the universe for data, but there just aren’t that many places to look at same-sex couples who are literally married.”

Governor Gregoire Signs Domestic Partnership Law
It’s not marriage. But a new law in Washington state will soon give gay and lesbian couples the same legal rights as married couples. Governor Gregoire signed the measure Monday.
Hundreds of couples, families and children packed into a muggy Seattle community center, to celebrate a victory. They cheered as Governor Chris Gregoire signed the so–called “everything but marriage” bill.
Gregoire: “It is time for all us here in the state of Washington to stand up and say, ‘We stand for justice. And we stand for shared responsibility to one another.’ Today is that day.”
This measure is the latest step in a three–year effort to give gay couples the same rights as married couples. This final piece adds spousal benefits and rights previously denied to some domestic partners, like workers’ compensation and disability insurance.

Harkin: Gay couples can be good parents
Iowa Sen. Tom Harkin said today he prefers children to be adopted into heterosexual marriages, if all other factors are equal, but that some gay couples are better parents.Harkin’s mixed feelings disappointed some longtime supporters in Iowa’s gay community and raised the question of how other elected officials who support the Iowa Supreme Court’s ruling allowing gay marriage feel about same-sex adoptions.
“I’m just saying that, if everything was equal, I guess my proclivity would be to have a heterosexual couple, Harkin said during a conference call with reporters.Harkin had previously said he preferred adoptions by heterosexual couples. He was asked today if he still felt that way, in light of the ruling allowing same-sex marriage.He said heterosexual couples do not always make better parents than same-sex couples.“I don’t want to practice armchair psychology here or anything like that. I guess it’s my own feelings on that,” Harkin said. “But I’m saying there may be times when that is not the best — because I’ve known gay couples who have raised children, and they’ve done great in doing that, and the children did not grow up to necessarily be gay or lesbian.” See Harkin: Gay couples can be good parents

Busy First Day For Cleveland’s Gay Partner Registry
Cleveland city leaders offered a warm welcome to gay and lesbian couples arriving at City Hall to take advantage of a new domestic partner registry taking effect Thursday.
Gay advocates celebrated with a rally on the steps of City Hall. Six council members attended the rally, including Council Members Jay Westbrook, Joe Cimperman and Joe Santiago.
Registering with the city is mostly a symbolic act. Registered couples receive no guaranteed benefits or protections; any benefits gained would be strictly voluntary.
The registry’s shortcomings, however, appeared to be lost on the steady stream of couples lining up for it. Sixty-four couples, mostly gay or lesbian, had paid the $55 registration fee by 2PM, openly gay Councilman Santiago told On Top Magazine.
Opposition to the registry appears to have diminished since ministers called for its repeal in January. A group of mostly black ministers lead by Rev. C. Jay Matthews failed in an effort to stop the registry from taking effect. And while the group has vowed to place a referendum on the November ballot, it appears they missed a March deadline. See:

Maine’s Gay Marriage FAces Likely Ballot Initative
Portland, ME – Maine Governor John Baldacci signed into a law today a bill ending the ban on marriage for same-sex couples. The Maine Civil Liberties Union, which lobbied hard for the bill, applauds the governor for recognizing that lesbian and gay couples in the state should no longer be denied the legal protections, recognition and respect that comes with marriage.
“Our great state became the first to end the ban on marriage for same-sex couples solely through the legislative process,” said Shenna Bellows, Executive Director of the Maine Civil Liberties Union. “While we know that the bill signed into law may ultimately have to be approved by the voters, today marks a turning point in the fight for the freedom to marry.”
Although Governor Baldacci had not previously stated publicly whether he would support the bill, he signed it into law just a day after the bill passed the state house by a vote of 89 to 57. Because of the state’s referendum process, it is likely that an initiative will be placed on the ballot where the voters could reject the legislation. Opponents of the freedom to marry have 90 days from the date of adjournment of the legislature to gather just over 55,000 signatures to put the issue on the ballot, which will stay the law from going into effect and bar couples from being able to marry. The initiative will be on the ballot in November 2009 or June 2010.
“We understand that many Maine people on both sides feel as passionately as we do,” added Bellows. “We are confident that if our opponents succeed in making this a referendum issue, the majority of Mainers will vote for fairness.”
