California Supreme Court appears likely to uphold gay marriage ban

The California Supreme Court today appeared inclined to uphold Proposition 8, but showed obvious reluctance to void thousands of same-sex marriages already in place when voters restored a ban on gay marriage last fall.

During three hours of arguments in San Francisco, the justices peppered lawyers opposing Proposition 8 with questions that suggested they do not believe they have the authority to trump the will of the voters.

At the same time, even justices who voted against striking down California’s previous ban on gay marriage indicated that Proposition 8 should not wipe out an estimated 18,000 same-sex marriages that took place last year. Those couples mobilized around the state to obtain marriage licenses after the Supreme Court ruled last May that California’s prior ban on gay marriage was unconstitutional.

“Is that really fair to people who depended on what this court said was the law?” Justice Ming Chin asked Ken Starr, the former Clinton impeachment prosecutor who argued that same-sex marriages shouldn’t be recognized under Proposition 8.

Prop 8 in court today: Stop Ken Starr from divorcing loving couples!

This morning, before the California Supreme Court, Ken Starr will argue for the forcible divorce of 18,000 loving same-sex couples who married before Proposition 8 passed.
Starr has said the marriage ban should stand because of the state’s role in protecting the welfare of children.

The hypocrisy of “protecting” children by divorcing their parents is unconscionable. Yet this is just one in a parade of outrageous lies by right-wing extremists.

So HRC is launching a new campaign to expose this dishonest fear-mongering against equality – to counteract the lies with respectful dialogue and grassroots action.

Sign our first petition at EndtheLies.org – Tell Ken Starr to stop using lies about child “welfare” to divorce loving parents.

Since it’s no longer as acceptable to display open bigotry against LGBT people, the right-wing has resorted to lies and fear tactics. Take Ken Starr’s statement that same-sex marriage amounts to “seizing and hijacking the marriage relationship in order to achieve apartheid-type values.”
HRC’s EndtheLies.org campaign will help us combat these untruths in the media, in Congress, in our statehouses, schools, workplaces and faith communities. And that will be key during the brewing battle over hate crimes legislation – which the right-wing is already trying to drag into the gutter.

They say that hate crimes laws will criminalize pastors and “do away with our freedom of speech.”

They spent millions during the Prop. 8 campaign telling Californians that marriage equality was corrupting schoolchildren and eroding their “moral character.”

They’re running absurd ads that suggest transgender anti-discrimination measures will lead to men attacking women and girls in public restrooms.

Ken Starr vs. transsexual in Prop 8 case

Kenneth Starr and Shannon Minter, lead attorneys in the California Supreme Court case that will decide the fate of same-sex marriage in the state, are as different as the competing sides they represent.

Starr, dean of Pepperdine University School of Law, is best known for leading the inquiry into President Bill Clinton’s affair with a White House intern.

Since then, the former federal judge and U.S. solicitor general has dedicated himself to conservative causes, including writing briefs for the Mormon church in a previous gay marriage case in California.

Minter, legal director of the National Center for Lesbian Rights in San Francisco, is a transsexual who spent his first 35 years as a female. He was a lead counsel in the state Supreme Court case decided last May that allowed same-sex couples to marry, a ruling that was reversed in November when voters approved Proposition 8.

Starr and Minter will square off Thursday in the most closely watched California Supreme Court hearing in a generation. They’re set to deliver oral arguments in three suits in which supporters of gay marriage contend that Proposition 8, which limits marriage to a man and a woman, is unconstitutional.

Minter, 48, representing gay rights groups, will be the first attorney to address the court in San Francisco. Starr, 62, will deliver the final arguments on behalf of the Yes on 8 campaign.

Yes, THAT Ken Starr. The prosecutor who led the campaign to impeach President Bill Clinton has filed a legal brief — on behalf of the “Yes on 8″ campaign — that would forcibly divorce the 18,000 same-sex couples married in California last year before the passage of Prop 8.

News broke Tuesday that the state Supreme Court will hear oral arguments on March 5, and will then make a decision within 90 days on the validity of Prop 8 and these 18,000 marriages.

When Starr’s legal brief went public in December, the Courage Campaign immediately launched the “Don’t Divorce…” campaign, asking our members to send us pictures with a simple message for Starr and the Prop 8 Legal Defense Fund.

Those pictures, and the heartfelt messages on them, inspired blogger Paul Delehanty (also known as “kid oakland”) to send us a suggestion: Would Regina Spektor allow us to put your pictures to the words and music of her hit song “Fidelity”? So, we asked her and she said yes, very enthusiastically.
