President Obama to Bestow Presidential Medal of Freedom on Harvey Milk
San Francisco – Today President Obama announced that he will honor assassinated civil rights leader Harvey Milk with the Presidential Medal of Freedom, the nation’s highest civilian honor recognizing significant contributions to the nation and the world. The President will also honor Senator Edward Kennedy and tennis legend Billie Jean King, an open lesbian and longtime champion for the rights of the lesbian, gay, bisexual, and transgender (LGBT) community, with the Medal of Freedom on August 12.
Last year, EQCA sponsored the first bill in the country to officially honor Milk, the nation’s first openly gay man elected to major political office, but the Governor vetoed it. Senator Mark Leno (D-San Francisco) introduced the Harvey Milk Day bill, sponsored by EQCA, again this year. The legislation would require the governor to annually proclaim May 22 as Harvey Milk Day, designating it as a “day of special significance,” to recognize Milk’s work to secure equal protections.

CA Supreme Court Upholds Student Civil Rights Act
(Sacramento, June 1, 2009) –Today, a Sacramento Superior Court dismissed a lawsuit seeking to invalidate SB 777, the California Student Civil Rights Act, which prohibits discrimination against students on the basis of race, religion, disability, gender, and sexual orientation. The lawsuit was brought by a right-wing group that specifically objected to protections for lesbian, gay, bisexual and transgender students. The court held that the plaintiffs had failed to show any way in which the statute was even allegedly unlawful.
“We are pleased the court rejected this attack on the Student Civil Rights Act,” said Carolyn Laub, Gay-Straight Alliance Network Executive Director. “School should be safe place for all children, including those who are—or are perceived to be—lesbian, gay, bisexual, or transgender.”
The lawsuit was filed on November 5, 2008. State Superintendent Jack O’Connell, represented by California Attorney General Jerry Brown, filed a motion to dismiss the lawsuit on January 8, 2009. On March 19, 2009, the National Center for Lesbian Rights, Lambda Legal, the Transgender Law Center, Equality California, and Gay-Straight Alliance Network filed a friend-of-the-court brief supporting the motion to dismiss.
Governor Schwarzenegger signed SB 777 into law on October 12, 2007. SB 777 reinforced existing anti-discrimination protections in publicly-funded schools and updated the Education Code so that teachers and administrators do not have to cross-reference other parts of state law to understand their obligations to protect students from harassment and discrimination in all school activities. The bill was sponsored by Equality California, the state’s LGBT legislative organization, and authored by former Senator Sheila Kuehl.
According to the 2001 California Healthy Kids Survey, nearly 30 percent of California youth in grades 7 to 11 report experiencing harassment or bullying based on their actual or perceived race, ethnicity, religion, disability, gender, or sexual orientation.

Harvey Milk Day Legislation Under Attack!
The same group, motivated by fear and hate, who brought us Prop 8 is at it again—with a new target.
This time they are turning up the heat, urging their members to contact the governor asking him to veto EQCA’s legislation–authored by Senator Mark Leno–to honor my uncle, Harvey Milk.
The governor needs to see a groundswell of support for legislation to honor one of our movement’s greatest heroes, Harvey Milk. Please sign the petition today!
This morning, EQCA Executive Director Geoff Kors will be joined by Senator Leno and Dustin Lance Black, the Academy Award-winning screenwriter of the movie “Milk,” to give testimony before the Senate Education Committee urging the passage of this legislation that pays tribute to the sacrifices Harvey made to advance equality.
Last year, Governor Schwarzenegger vetoed a similar bill saying that my uncle was a figure of only local significance. Since then, millions have seen how important my uncle was to the LGBT rights movement – and how he inspired so many to fight for what is right.

Equality California Remembers Lawrence King One Year after the Teen’s Shooting Death
SAN FRANCISCO – Equality California honors and remembers the life of Lawrence King, a gay junior high school student from Oxnard, CA, who was shot in the head one-year-ago by his classmate at E.O. Green Junior High School. The 15-year-old died of his injuries last February 13.
Brandon McInerney, King’s shooter, is being tried on first-degree murder and a hate crimes charge. According to reports from friends of Lawrence King, who self-identified as gay, King sometimes wore make-up and feminine jewelry and was the target of ridicule by some of his classmates.
Last year, EQCA sponsored AB 3015 (Brownley), the Foster Youth School Education Act, which was introduced to better protect LGBT foster youth like Larry from violence at school and was signed into law by Governor Schwarzenegger.
“As we remember the tragic, senseless killing of Lawrence King, we must continue to take the appropriate steps to ensure that no one else becomes a victim to homophobia in our schools,” said Geoff Kors, executive director for Equality California. “On the anniversary of this tragedy, we stand committed to defending safe schools laws that EQCA lobbied to enact to prevent any young person from being bullied, harassed or worse because of their sexual orientation or gender identity and expression.”
Equality California-sponsored legislation, the Student’s Civil Rights Act, SB 777 (Kuehl), which was implemented in 2008 and reinforces existing prohibitions of discrimination in publicly funded schools and activities, including discrimination based on religion, race, disability, gender and sexual orientation, has been challenged by a failed referendum and an ongoing federal lawsuit.
