Paterson Vows Vote on Gay Marriage Before Break

ALBANY — Gov. David A. Paterson said in an interview Sunday night that he would make sure that the State Senate votes on same sex-marriage legislation before it breaks for the summer, hours after he and his administration had refused to commit to forcing a vote on the issue.

The development came as the governor announced plans to call the Senate to a special session on Tuesday, after trying unsuccessfully for two weeks to broker a compromise in a leadership battle that has deadlocked the chamber. But Mr. Paterson dismayed gay rights groups in his comments at a news conference early Sunday afternoon, when he said same-sex marriage would not be on the special session’s agenda.

“It has always been my intention to see same-sex marriage come to the floor,” he said, adding, “I don’t want there to be any confusion.”

Obama Faces Gay Groups’ Growing Anger

The anger from gay rights advocates toward President Obama is starting to boil over.

On Monday, Joe Solmonese, the president of the establishment gay rights group The Human Rights Campaign, sent an angry letter to the president objecting to the decision by the Obama Justice Department to file a brief defending the Defense of Marriage Act.

“I realized that although I and other LGBT leaders have introduced ourselves to you as policy makers, we clearly have not been heard, and seen, as what we also are: human beings whose lives, loves, and families are equal to yours,” Solmonese wrote. “I know this because this brief would not have seen the light of day if someone in your administration who truly recognized our humanity and equality had weighed in with you.”

The Clinton-era Defense of Marriage Act, or DOMA, mandates (1) that the federal government not recognize same-sex marriages and (2) that states not be forced to recognize same-sex marriages from other states.

Mr. Obama vowed to repeal DOMA as a presidential candidate but he has not taken any action to do so since becoming president. The Justice Department brief calls the legislation a “valid exercise of Congress’ power” and says it is “reasonable and rational for Congress to maintain its longstanding policy of fostering this traditional and universally-recognized form of marriage.”

“The government does not state why denying us basic protections promotes anyone else’s marriage, nor why, while our heterosexual neighbors’ marriages should be promoted, our own must be discouraged,” Solmonese writes in his letter.

He goes onto single out a portion of the brief referencing a case involving “marriage of uncle to niece” to support the Justice position.

“I cannot overstate the pain that we feel as human beings and as families when we read an argument, presented in federal court, implying that our own marriages have no more constitutional standing than incestuous ones,” he writes. See Obama Faces Gay Groups’ Growing Anger

Conservatives Shift In Favor Of Openly Gay Service Members

A new Gallup poll shows that 69 percent of Americans are now in favor of openly gay men and women serving in the military, up from 63 percent five years ago. Support among liberals and Democrats remains high — around 86 percent and 83 percent respectively — but the biggest shift in support occurred among conservatives and Republicans. Fifty-eight percent of people who identify as conservatives say they support gays serving in the military, up from 12 points from 46% in 2004. Fifty-eight percent of Republicans support what is essentially a repeal of “Don’t Ask, Don’t Tell.”
While a majority of Americans still oppose legalizing gay marriage, the shift in support for gays serving in the military “suggests the political playing field may be softer on this issue, and President Barack Obama will be well-positioned to forge ahead with his campaign promise to end the military ban on openly gay service members with some support from more conservative segments of the population,” Gallup writes.

Gay Groups Prepare For Prop. 8 Decision

Gay groups across the nation are preparing for Tuesday’s ruling by the California Supreme Court on the state’s controversial gay marriage ban, Proposition 8.

The court announced Friday it would hand down its decision Tuesday morning at 10AM.

Justices will rule on a lawsuit that seeks to invalidate the November results of a referendum that placed a gay marriage ban in the California Constitution.

Proposition 8 effectively overturned the high court’s 4 to 3 decision that legalized gay marriage last May and put an end to the thousands of gay and lesbian marriages that took place during the June-to-November “summer of love” when gay marriage was legal. The court will also rule on the fate of 18,000 marriages.

Gay marriage proponents began preparing for the decision in March, shortly after the court heard oral arguments.

The largest event is being organized by veteran gay activists Robin Tyler and Andy Thayer. The Day of Decision is a large, multi-state demonstration scheduled to take place on Tuesday night, just hours after gay activists learn whether they will be celebrating or protesting the court’s decision.

California activities connected to the event include: In San Francisco a prayer service at Grace Cathedral is scheduled for Monday at 7PM, while a blessing on Tuesday at St. Francis Lutheran Church begins at 8:30AM; On Tuesday in Los Angeles, a rally will take place outside the County Marriage License Office at 12AM and a rally and march begins at 7PM in the West Hollywood neighborhood; Activists will gather at 7PM Tuesday for a rally at the Palm Springs Courthouse; And San Diegans will rally Tuesday at 5PM at Balboa Park.
