Prosecutors drop case against gay couple accused of trespassing on LDS property
Prosecutors won’t pursue a case against two men accused of trespassing on LDS Church property earlier this month. An LDS Church security guard detained a gay couple on Salt Lake City’s Main Street Plaza on July 9 after observing the pair “kissing and hugging,” according to a police report. Derek Jones and Matt Aune were cited for trespassing after refusing to leave. The incident led to two kiss-in protests against the church in Salt Lake City and one in San Diego. Aune has said the couple’s display of affection was modest, but officials with The Church of Jesus Christ of Latter-day Saints, which owns the plaza, released a statement that the two men were “much more involved” than a “simple kiss on the cheek.” It said the couple “engaged in passionate kissing, groping, profane and lewd language, and had obviously been using alcohol.” In a statement released Wednesday, Salt Lake City Prosecutor Sim Gill said the trespassing case against Jones and Aune has been dropped. Gill said despite that Main Street Plaza is owned by the church, there “continues to be a mistaken belief by many visitors that there is a public right of way.”

After the break-up, what about the lake house?
IT was a perfect party — vodka lemonade on a dock overlooking a lake, dozens of close friends, a cool misty night in the country a couple of hours north of New York.
Inside, the house spoke of a passionate interest in style, and of a committed relationship. Silhouettes of the couple who owned the house hung on a wall in the master bedroom; the couple’s nickname — Benford — was spelled out in large letters leaning against a wall in the kitchen.
But the couple, Benjamin Dixon, 31, and Bradford Shellhammer, 33, who had planned the evening as a commitment ceremony, had broken up three months earlier. Still, with airplane tickets purchased by some of the guests, a catering deposit paid and a house they haven’t been able to sell, they figured it made sense to go ahead and have a party anyway.
Their tale of lost love has a familiar arc — love sparks, then blooms; lives intertwine; moments are lost and misunderstandings creep in; eventually the two begin to live as strangers — and an epilogue that has become increasingly familiar as well, as unwanted houses become prisons rather than cocoons.
Rather than being a glossy testament to their taste and their partnership, their house in Stanfordville, in Dutchess County, is now a dead weight that entangles them and makes it impossible to move on. Having bought it and an apartment in Manhattan at the height of the real estate boom (and having made an agreement with a third partner in their lake house property not to sell it until December 2009), they are left with joint custody of two large mortgages. They are also left with two carefully decorated homes filled with one-of-a-kind accessories found on eBay and quirky furnishings by high-end designers like the Dutch collective Droog that are reminders of what came before and, Mr. Dixon said, “big reminders of what was supposed to be.”

Gay marriage and the date debate
Nearly nine months after California voters banned same-sex marriage in the state, gay marriage supporters are ready to ask them to overturn Proposition 8. They’re just not sure when to ask: In November 2010 or November 2012. Choosing a date involves more than sifting through the polling, community meetings and consultants’ reports that have filled the time since last fall’s election with soul-searching and finger-pointing among supporters, culminating in a meeting of the movement’s leaders Saturday in San Bernardino. Generating enthusiasm for a grassroots campaign will also be a heart-based decision, one that has split same-sex couples even in Kern County, where 75 percent of voters backed Prop. 8. Bakersfield resident Jade Haley wants an initiative in 2010. Her partner Alee Gamino thinks that’s too soon. Gamino’s Catholic mother still refers to Haley as “she” and has no contact with them as a couple, who are raising Gamino’s teenage daughter from a previous relationship. On Sundays, Gamino, 34, goes to church twice. She attends a Catholic service solo with her mom in the morning and goes to a Metropolitan Community Church with her partner in the evening. “The churches have thousands and thousands of people ready to go against us,” said Gamino. She looked at 70 people who came to a Unitarian Universalist Church on Thursday to talk about the movement’s next step. “All we have is what’s in this room.” Still, Gamino was among only a dozen people at the Bakersfield meeting called by Marriage Equality USA who supported waiting until 2012. The sentiment for a vote next year echoed one at a similar gathering in San Francisco, while gatherings in liberal bastions such as Oakland and Berkeley leaned toward 2012. “The reaction was really mixed,” said Pam Brown, Marriage Equality USA’s political director, who compiled information from the organization’s “Get Engaged” tour of 40 California cities over the past several weeks. “A lot of people who wanted to wait until 2012 wanted to see what the plan was first before they committed.” A nonbinding straw poll of leaders gathered Saturday in San Bernardino to plan the movement’s next step found that 93 people voted to go in 2010, 49 in 2012 and 20 were undecided. Organizers expect to officially decide when to return to the ballot in a couple of weeks. bout 17 percent of gay men in Chicago are HIV-positive — and half of them don’t know it.
That’s according to authorititative new estimates from the Chicago Public Health Department.
In particular, black men who have sex with men have double the HIV infection rates of white and Hispanic men, even though they don’t appear to engage in riskier behavior, Chicago health officials said today.
Their report was based on data collected last year from 570 Chicago men in the National HIV Behavioral Surveillance system.
It’s the first time Chicago health officials have used blood-testing to determine HIV infection rates in this high-risk population, said Christopher Brown, assistant commissioner of the health department’s STD, HIV and AIDS division.
Past estimates have relied solely on interviews with gay and bisexual men about their HIV status.
“What we found out pretty much confirms what we’ve known for a while,” Brown said.

Councilmen waver on new gay marriage bill
Porterville city councilmen rehashed a contentious issue Tuesday night — gay marriage.
Former mayor Cameron Hamilton proposed that council members show adamant opposition to a bill circulating among state legislators.
Senate Bill 54 proposes same-sex couples married outside the state, and before the passage of Proposition 8, are warranted the equal recognition as married spouses in California.
The council formerly engaged with a state issue on Sept. 2, 2008 by adopting a resolution supporting Proposition 8. The ballot measure, which was passed by California voters in November, codifies that marriage in California is only between a man and a woman.
This time the vote was not unanimous.
By a sliver — two in favor, two opposed, one abstained — council members allowed Hamilton to draft a resolution to approve or disapprove at a future meeting.

Ancient India didn’t think homosexuality was against nature
NEW DELHI: Was Indian society tolerant of homosexuality before the colonial administration proscribed it in 1860? The government has taken conflicting positions on this within the country and outside.
On a petition pending before the Delhi high court seeking to decriminalize homosexuality, the government said in its counter affidavit that that there were “no convincing reports to indicate that homosexuality or other offences against the order of nature mentioned in Section 377 IPC were acceptable in the Indian society prior to colonial rule.�
But when it was being reviewed by the UN Human Rights Council last year for the first time ever, India distanced itself from that provision when Sweden, arguably the most gay-friendly country in the world, questioned its record in ensuring equality irrespective of a person’s sexual orientation.
This is how Goolam Vahanvati, who was then solicitor-general and is now attorney-general, tried to save India’s face before the council as part of its official delegation. “Around the early 19th Century, you probably know that in England they frowned on homosexuality, and therefore there are historical reports that various people came to India to take advantage of its more liberal atmosphere with regard to different kinds of sexual conduct.
“As a result, in 1860 when we got the Indian Penal Code, which was drafted by Lord Macaulay, they inserted Section 377 which brought in the concept of ‘sexual offences against the order of nature’.
Now in India we didn’t have this concept of something being ‘against the order of nature’. It was essentially a Western concept, which has remained over the years. Now homosexuality as such is not defined in the IPC, and it will be a matter of great argument whether it is ‘against the order of nature.”
Vahanvati’s admission on the international forum that the ban on homosexuality was a western import and its relevance was debatable flies in the face of the government’s unabashed efforts before the Delhi high court to retain Section 377, complete with its colonial baggage and archaic notion of unnatural offences.
Whatever the politics behind this glaring contradiction, there is ample evidence placed before the high court by petitioner Naz Foundation substantiating in effect Vahanvati’s view that in the centuries prior to the enactment of section 377, India was rather accommodating of homosexuals. Gay Kiss Arrests In Utah Defended By Mormon Church
In the wake of one “kiss-in” protest carried out last Sunday and ahead of another one planned for this Sunday, the LDS Church issued a statement Friday defending its Main Street Plaza property rights and its actions involving a pair of men cited there last week for their public displays of affection.
Echoing previous comments made by a church spokeswoman following the July 9 incident, Friday’s statement said the pair were asked “to stop engaging in behavior deemed inappropriate for any couple of the plaza,” which was “more involved than a simple kiss on the cheek.”
“They engaged in passionate kissing, groping, profane and lewd language and had obviously been using alcohol,” the statement continued. “They were politely told that the plaza was not the place for such behavior and asked to stop. When they became belligerent, the two individuals were asked to leave church property.”
The two — Derek Jones and Matthew Aune — were detained by church security, cited by Salt Lake police for trespassing, an infraction of city ordinances, and later released.
The police report stated that Aune said the two had been drinking earlier at the Gallivan Center. After leaving and passing through the plaza, they sat down and he kissed Jones. Aune told police that when the two were confronted by church security and asked to leave, he refused, and he was slammed to the ground as security detained the pair with handcuffs.

Human Rights Campaign Statement on Death of San Diego Area Sailor
The Human Rights Campaign, the nation’s largest lesbian, gay, bisexual and transgender (LGBT) civil rights organization, released a statement today in the death of Seaman August Provost, 29, at Camp Pendleton in San Diego, CA. According to local media reports, the Navy and Marine Corps confirmed that a sailor’s body was found on the base at about 3 a.m. Tuesday morning. A military spokesperson confirmed that there was evidence of foul play in the killing and that the case is a murder investigation. It is also understood a “person of interest” is in custody at Camp Pendleton but has not been charged with a crime. Local activists report the victim may have been targeted because of his sexual orientation.
“Our thoughts are with the Provost family at this time as authorities work to learn what happened in the early morning hours this past Tuesday,” said Human Rights Campaign President Joe Solmonese. “The Human Rights Campaign has confirmed Congresswoman Susan Davis has been in touch with officials at the base and is tracking the investigation. We know that every day members of the lesbian, gay, bisexual and transgender community are targeted for simply being who they are. Furthermore, our gay or lesbian soldiers struggle with the extra burden of not serving openly and honestly based on the discriminatory policy of ‘Don’t Ask, Don’t Tell.’ As we monitor the investigation, our community must continue to raise awareness on a law that we know hurts military readiness and national security while putting American soldiers at risk.”
