Two Anti-Gay Marriage Dems Cut Deal With Republicans to shift NY Senate to GOP control
ALBANY, N.Y. — Republicans and two dissident Democrats took control of New York’s Senate on Monday after the two New York City renegades voted with the GOP to throw the fledgling Democratic majority out of power.
The decision by senators Pedro Espada Jr. of the Bronx and Hiram Monserrate of Queens to join the coalition gave Republicans a 32-30 voting edge on hastily introduced measures that changed the leadership structure. Neither Espada nor Monserrate changed party affiliation.
Democrats held the Senate for barely five months after being out of power for four decades.
Shortly after the coup, Republicans named Espada temporary president of the Senate and Republican Dean Skelos of Nassau County vice president and majority leader. Skelos was majority leader in 2008.
Those are the most powerful positions in the chamber. With them, the bipartisan coalition can direct legislation and reassign committee and leadership posts.
Democrats tried to leave the chamber, even turning off the lights briefly, and are expected to challenge Monday’s action in court.
The coup throws into doubt the movement to legalize same-sex marriage, one of the major policy issues still pending for the last two weeks of the regular session. Although passed in the Democrat-led Assembly, it is stalled in the Senate. Several Republicans and Sen. Ruben Diaz, a Bronx Democrat oppose the measure.

‘People’s veto’ looms despite passage of gay marriage in Maine
Mary Breen, of South Berwick, Maine, is counting down the days until she and her partner can be married, now that Gov. John Baldacci has signed into law the state’s gay marriage bill.
“It’s a proud day to live in Maine,” she said after the signing. The moment the law goes into effect, she said, “We’ll be getting married.”
Exactly when that day will be depends on how quickly opponents can mount a petition campaign to force a citizen’s veto of the law, said Julie Flynn, deputy secretary of state for the Bureau of Corporation, Elections and Commissions.
Unlike New Hampshire, Maine has a mechanism to overturn a law called the “people’s veto.” Opponents must gather signatures of registered voters equal to 10 percent of those who voted in the last gubernatorial election. If verified, the veto measure is put on the next statewide ballot, with voters either upholding or repealing the law.
The secretary of state received an application for a people’s veto on Thursday, Flynn said. The office has 10 business days to write a legal ballot question and return it to the applicant.
The coalition of opponents, including the Catholic diocese of Portland and the Maine Jeremiah Project, must collect 55,087 valid signatures, but in practice need to get more than that in case signatures are disqualified.
For all practical purposes, said Flynn, opponents need to collect those signatures by mid-August to get on the November ballot, because they must be certified by town or city clerks first, then by the secretary of state — all by Sept. 4. That leaves 60 days before the Nov. 4 election, time enough for ballots to be printed and to allow for absentee voting.
Last year, opponents of a beverage tax were successful in garnering enough signatures for November and were ultimately successful in overturning the law. However, said Flynn, there was also a statewide election in June last year when organizers could gather signatures. There isn’t one in this off-election year.
“There’s always the county fairs and that sort of thing, but for this to be done, there’s going to have to be an organized effort,” she said.
Meanwhile, the bill itself is going on its own legal track. It will become law 91 days after the Legislature recesses, which is set for June 17 but could be earlier or later. That means the law would likely take effect Sept. 16. Obama strong, but gay marriage, big gov’t could be tricky
While Barack Obama is flying high in public opinion polls, there could be trouble ahead on the issues of same sex marriage, big government, and party identification, according to Frank Newport, Editor in Chief of the Gallup Poll.
“The data actually show some areas of concern for the Democrats,” Newport said at a Monitor-sponsored breakfast with reporters on Tuesday. In addition to his role at Gallup, Newport is the incoming president of the American Association for Public Opinion, the nation’s largest association of public opinion and polling professionals.
Still mostly sunny
Of course, the possible trouble areas Newport outlines for Democrats have to be viewed against a political backdrop that is far from encouraging for Republicans. President Obama’s job approval rating is a robust 67 percent.
And as non-partisan political analyst Charlie Cook [no relation] says in his latest column, “Half a year past a second-consecutive devastating election for Republicans — in which they went further in the hole in the House and Senate and lost the presidency — are they any better off now? Are there any signs of a rebound? The short answer would appear to be ‘no’.”
A conservative retrenchment
But that does not mean the Obama administration has uniformly strong support on every issue. “I do not think the public has moved radically liberal on a lot of social and values issues,” Newport said. He noted that Gallup’s daily polling had found “a retrenchment to the more conservative on gun control as an example.”
“And there is some evidence even on abortion there may be somewhat of a retrenchment there.” he said.
Obama has been “very careful” on the issue of same sex marriage, Newport said, supporting civil unions but not marriage for gays. “Nevertheless I think that is an issue where the Republican Party might have an edge because the public remains conservative on social and value issues,” he said.

“People’s veto effort” likely if gay-marriage becomes law in Maine
UGUSTA — Michael Heath of the Maine Family Policy Council announced this week he will work to gather the signatures necessary for a people’s veto of the gay-marriage bill.
A few things need to happen first, but during Senate debate Thursday, many senators said they felt it was inevitable that the question would end up before voters.
The Senate voted Thursday 22-14 in favor of the bill. It will be taken up in the House Tuesday, then come back to the Senate for a final vote.
From there, it goes to Gov. John Baldacci, who has not taken a position on the bill.
Assuming he doesn’t veto it, it would be set to take effect 90 days after the Legislature adjourns. Adjournment is set for June 17, give or take a day or two.
This is where the people’s veto comes in.
Heath and others would have 90 days from the date of adjournment to gather 55,087 signatures.
Julie Flynn, deputy secretary of state, said any group wanting to turn in signatures for a people’s veto would have until Sept. 15 to submit signatures. Her office would then have 30 days to determine whether there are enough valid signatures to call for a public vote.
However, in order to make the November ballot, groups would have to turn in signatures by Sept. 3 or 4, because it must be at least 60 days before the election, she said.
If not, the question wouldn’t go to voters until June.

Transexual lesbian loses party bias case
A TRANSEXUAL lesbian banned from attending an all-female party has had her discrimination case thrown out.
Dr Tracie O’Keefe lost her three-year battle this week, after the Equal Opportunity Tribunal ruled the organisers of “Sappho’s Party” – an all-lesbian event held in Adelaide – were within their rights to refuse her entry.
The Sydney psychotherapist wrote to organisers in 2005 after she was handed a flyer advertising the Adelaide Hills party.
“I am someone who has lived as a woman for 35 years and considered in my country of origin, England, and my adopted country, Australia, as legally female,” Dr O’Keefe wrote.
“Although initially I was raised as a boy, I have lived as a female since I was 15 years old, where I was still legally a child, therefore I was raised both male and female. I would like to come to your event with my long-term female partner of 12 years.”
But a reply sent to Dr O’Keefe refused her request. “. . . this event is specifically being organised for those lesbians raised female from birth who feel the need to meet as a specific group,” organisers wrote.
“Our intention is affirmative action for this group. Therefore it is not appropriate for you to attend.”

IGLHRC Asks the Iraqi Government to Protect Gay People
NEW YORK, April 17, 2009 – The International Gay and Lesbian Human Rights Commission (IGLHRC) has sent a letter to the Iraqi Minister of Human Rights, Wijdan Salim, requesting that she takes specific measures to protect lesbian, gay, bisexual and transgender (LGBT) Iraqis and prevent hate crimes against those perceived to be gay.
IGLHRC’s letter, written to coincide with Ms. Salim’s visit to Washington D.C., responds to a recent wave of violent crimes against Iraqi citizens perceived to be gay.
Just hours before IGLHRC sent its letter, an Iraqi group identified as “Fazilat” (Virtue) posted flyers threatening homosexuals with death on walls in the Sadr City neighbourhood of Baghdad.
The flyers, distributed on April 17, list the names of some of the would-be targets and states that “we will soon punish all you perverts.” Residents of Sadr City say the people who were outed in these fliers have gone into hiding.
Previous acts of anti-LGBT violence in Iraq include the April 2, 2009 murder of two men in the Sadr City neighbourhood of Baghdad.
An unidentified local official described these men as “sexual perverts (Monharef Jensiyan) who were killed by members of their tribe to restore their family honour.”
Prior to death, the men’s relatives had disowned them and they were also thrown out of their tribes. So far no one has claimed their bodies and the government has not launched an investigation into the case.
These murders took place one week after Iraqi authorities unearthed the bodies of 4 men killed by gunshots in Sadr City on March 25.
The words “pervert” and “son of a bitch” (jaravah: a derogatory term to describe homosexuals) were written on the chests of the victims. As part of this new wave of violence, a coffee house in Sadr City that was frequented by gay men has also been burnt down.
Apart from these cases, IGLHRC has also received reports of the arrest, torture, and murder of several members of the group Iraqi-LGBT amid a nationwide government crackdown on gay-friendly businesses across Iraq.
Several other reports indicate dozens of extra-judicial murders of LGBT people across Iraq during the past few months.
In response to these violent murders, on April 8, 2009, IGLHRC and Human Rights Watch submitted an urgent appeal to the Special Procedures of the United Nations to ask for an investigation.
IGLHRC is also working closely with the D.C.-based Council on Global Equality to bring the plight of gay and lesbian Iraqis to the attention of U.S. government officials, who will be meeting with the Iraqi minister next week.
