New Delhi Lifts Colonial-Era Ban on Gay Sex
A top court in the Indian capital of New Delhi yesterday overturned a colonial-era law banning gay sex between consenting adults as the world’s biggest democracy struggles to balance tradition and modernity.
In a strongly worded statement, New Delhi’s High Court ruled that the 150-year-old statute prohibiting homosexual acts was discriminatory and therefore a “violation of fundamental rights.”
“It cannot be forgotten that discrimination is antithesis of equality and that it is the recognition of equality which will foster dignity of every individual,” the court said in a 105-page judgment.
Quoting India’s first prime minister, Jawaharlal Nehru, Justice A.P. Shah said: “Words are magic things often enough, even the magic of words sometimes cannot convey magic of human spirit and of a nation’s passion.”
The ruling applies only to New Delhi and to adults older than 18. But federal government ministers are also in the process of reviewing the law.

2 little 2 late? Rep. Foxx Sends Apology Letter To Matthew Shephard’s Mother
U.S. Rep. Virginia Foxx has written a letter of apology to the mother of Matthew Shepard, a gay Wyoming man whose name is on a bill adding sexual orientation to federal hate-crimes legislation.
During recent debate on the bill, Foxx, R-5th, called attempts to label Shepard’s 1998 murder a hate crime “a hoax.” She said that he was killed during a robbery and not because he was gay.
Shepard, 21, was robbed, beaten and left to die on a prairie fence near Laramie, Wyo., in 1998. Two men pleaded guilty to killing him and testified that they singled him out because he was gay.
Foxx’s remarks caused an uproar, and she later issued a statement saying that her use of “hoax” was “a poor choice of words.”

A first gay justice?
President Barack Obama is looking to advance diversity with his pick to replace retiring Supreme Court Justice David Souter — and early speculation has focused on whether he’ll pick a woman, or perhaps the first Hispanic justice.
But gay rights groups — disappointed that Obama didn’t pick an openly gay man or woman for his Cabinet — are pushing him to put the first openly gay justice on the Supreme Court.
Within hours of word of Souter’s departure, the Gay and Lesbian Victory Fund was hailing the candidacy of a First Amendment scholar and former dean of Stanford Law School, Kathleen Sullivan. “Out lesbian a contender for Supreme Court,” one of the group’s web sites declared.
Another Stanford law professor on the “frequently mentioned” lists, Pam Karlan, has been open about being a lesbian, colleagues and former students say. In response to an e-mail from POLITICO, Karlan expressed no reticence about discussing her sexual orientation, though she downplayed talk about being a possible nominee.
“It’s no secret at all that I’m counted among the LGBT crowd,” she wrote, using a common acronym for the lesbian, gay, bisexual and transgendered community. As for the possibility she’d be nominated, Karlan said, “Given the landscape, I’m flattered, but not fooled, by having my name tossed around.”
Unrelatedly, a rave for Karlan as “(1) brilliant, (2) broadly knowledgeable — Cass Sunstein aside, I can’t think of anyone who knows so much about so many different legal fields — and (3) a spectacularly gifted writer” from a right-leaning Harvard Law professor, William Stuntz.
