LGBT Prisoner Safety Act Passes Assembly with Bipartisan Support
Bill Sponsored by EQCA and Introduced by Assemblymember Ammiano Now Moves to Senate
Sacramento – The California State Assembly passed the LGBT Prisoner Safety Act, AB 382, today by an overwhelming margin of 64-9. The bill garnered significant bipartisan support. Sponsored by Equality California (EQCA) and introduced by Assemblymember Tom Ammiano (D – San Francisco), the bill is designed to prevent violence against lesbian, gay, bisexual, and transgender (LGBT) people in the state prison system. The bill received more Republican votes than any other piece of legislation sponsored by EQCA.
“The California Assembly sent a powerful message today that all Californians deserve protection from violence,” said EQCA Executive Director Geoff Kors. “This vital bill seeks to end abuse and assault against LGBT prisoners, ensuring they receive equal and fair protection under the law.”
According to a recent study from the Cali¬fornia Department of Corrections and Re¬habilitation, 67 percent of LGBT inmates report being sexually assaulted by another inmate, a rate 15 times higher than the overall prison population.
By amending the Sexual Abuse in Detention Elimination Act (SADEA) of 2005 to include sexual orientation and gender identity on the list of factors for consideration when classifying and housing prisoners, the legislation promotes safety for and prevents assault against LGBT people in the prison system. The list of factors currently includes age, gender, type of offense, and prior time served.
“All people deserve basic protections – including those serving time in our state prisons,” Assemblymember Ammiano said upon introducing the bill. “No prisoner should fear for his or her life or be the target of abuse because of his or her sexual orientation or gender identity.”
The bill developed following a Senate Public Safety Committee meeting held in San Francisco this past December and chaired by Senator and former Majority Leader Gloria Romero (D-Los Angeles). The meeting, which was sponsored by EQCA along with Just Detention International, the Transgender Law Center, National Center for Lesbian Rights, and the Transgender Gender-Variant and Intersex Justice Project, exposed the dire issues facing LGBT people in California prisons in order to produce concrete solutions. The LGBT Prisoner Safety Act is an important step toward ensuring the safety of this highly vulnerable population. Last month, the bill passed the Assembly Public Safety Committee unanimously by a 7-0 vote.

Ceremonial Gay Marriage with Raymond and Byron, Featured in “13 Love Stories”
A press conference announcing the expansion of the ‘Hyatt Hypocrisy’ campaign to Long Beach Hyatt Hotel is set today in Long Beach, CA. Members of the coalition will participate in a ceremonial gay marriage ceremony, calling on Hyatt management with demands regarding marriage equality.
The Reverend Sunshine Daye, Namaste Science of Mind and Spirit Center/Grand Marshall Long Beach Gay Pride Parade; Tonia Reyes Uranga, Long Beach City Councilwoman; Mike Bonin, Co-Founder of Camp Courage, Courage Campaign; Raymond and Byron, married gay activists featured in “13 Love Stories;” and Kimberlee Woods, Exec. Director Gay and Lesbian Center of Greater Long Beach are expected to attend.
LGBT rights activists, workers, and community leaders will join forces outside the Long Beach Hyatt hotel in support the ongoing fight for marriage equality. The Hyatt Hotel is owned and operated by the Hyatt Corporation, which also operates the Manchester Grand Hyatt in San Diego, owned by Doug Manchester. Manchester donated $125,000 to help put California’s Proposition 8 on the ballot last November. The Manchester Grand Hyatt has been at the forefront of the battle over same-sex marriage since leaders of San Diego’s LGBT community called a boycott of the hotel in July.
This event is co-sponsored by the Long Beach Coalition for Good Jobs & a Healthy Community, San Diego Equality Campaign, Courage Campaign, Equal Roots, Pride at Work and Equality California.
The coalition is not calling for a boycott of the Hyatt Hotel, but pledges to hold the Hyatt Long Beach and its owner and operator, The Hyatt Corporation, accountable for their relationship to Manchester. With this press conference and delegation, labor and gay rights activists will expand the Hyatt Hypocrisy campaign, which is in full swing in San Diego, to Hyatt’s Long Beach Hotel.

Economist: Is Outing Of Closeted Political Figures A Useful Tactic?
KIRBY DICK’S documentary “Outrage“, which opened nationally last week, has turned gay activists’ controversial tactic of exposing closeted public figures—in this case, closeted Republicans perceived as advancing anti-gay policies in their public lives—into a feature-length film. The movie targets an array of elected officials and prominent GOP operators, but of particular interest is its focus on Charlie Crist (pictured with wife), the governor of Florida, who has thrown his hat into the 2010 race for the US Senate, with the support of much of the party establishment.
As if to confirm the film’s thesis that the press go out of their way to help preserve this sort of charade, National Public Radio opted to edit their reviewer’s piece on the movie to remove the names of politicos identified as closeted. At this point, as several others note, this seems rather quaint—and indeed, like an endorsement of the notion that there’s something especially awful about being accused of being gay. Nor do the network’s protestations that they simply avoid traffic in gossip and rumour hold up: They are only too happy to pass along unconfirmed reports about the sex lives of entertainers.
Which is odd, when you think about it, since while the public is clearly interested in the romances of musicians and movie stars, it’s hard to claim there’s a genuine public interest served by poking into their private lives. When it comes to public servants, however, we generally accept that it’s perfectly legitimate to scrutinise their private conduct to the extent it’s relevant to assessing the sincerity of their professed beliefs or the veracity of their public personas. Usually the controversy over “outing” has to do not with elected officials, but with high-level staffers, who have not volunteered themselves for scrutiny in the same way as political candidates. In practice legislative directors and analysts too yield significant public power—legislators are important people, and can’t be bothered with writing and reading bills themselves—but “Outrage” limits itself to indisputable public figures. If the claims about them are so poorly sourced as to constitute plain slander, the film shouldn’t be rewarded with any kind of attention; if they’re at least credible, one may as well save the listeners a Google search and say what they are.

Taking aim at the hypocrisy of closeted politicians
Does a politician’s right to privacy trump the wrong of hypocrisy? Documentary filmmaker Kirby Dick thinks not.
He doesn’t care about the sex lives of politicians. But he cares that when a pol’s sexual orientation is secret, often shame and self-hatred color his voting record. Dick is outraged when closeted gay politicians vote against gay marriage, against the right of gays to adopt, and against funding for HIV/AIDS. He’s so outraged that he has made a movie exposing the disconnect between what these men practice and what they preach.
Despite its title, Outrage is calm, riveting, and provocative, taking pride in officials who come out and and taking aim at those who remain closeted. The film saves most of its ammunition for the media’s “orchestrated conspiracy,” creating a double bind that perpetuates the double lives of these men. Yes, they are all men, and with the exception of Ed Koch, former New York mayor, all are Republicans. (Why should we care? One, Florida Gov. Charlie Crist, who recently married a woman, is a leading GOP candidate for president in 2012.)
Dick, whose prior documentaries include This Film Is Not Yet Rated, a trenchant and amusing take on the double standard of the motion-picture ratings board, is ambivalent about his role in “outing” closeted politicians.
Beltway blogger Michael Rogers, on hand to furnish color commentary on who’s in the closet and why, considers the question of whether outing is a form of sexual McCarthyism. Is it the closeted practice or the outing that perpetuates the climate of shame? Certainly, whenever a James McGreevey or Eliot Spitzer admits his hidden sexual practices, he must take the media walk of shame.
Rogers’ answer to the chicken-or-egg question is that the goal of outing is to expose political hypocrisy, not sexual orientation. To this end, Dick provides each closeted politician’s voting record on gay rights; most of them show that he is voting against his own self-interest. Gay politicians’ hypocrisy uncovered in movie ‘Outrage’
As Obama passes his first 100 days in office, I find myself sad that we liberals have less and less to complain about. Guantanamo Bay is closing, good health care policy is in the works, and I no longer have nightmares about McCain invading my living room on top of an elephant as if he were a Carthaginian emperor.
Nonetheless, liberals in 2009 still have more things to complain about than Holden Caulfield would, holding a broken Miley Cyrus record.
One such complaint is homosexuality in America. This week’s “gay controversy” surrounded Miss California and her Twitter-quarrel with Perez Hilton. I could take an opinion on this. But I won’t. Why? Because important American figures don’t wear tiaras.
Moving on, a controversy occurred at the Tribeca Film Festival. A documentary titled “Outrage,” which outs allegedly closeted right-wing politicians, previewed this past weekend in lower Manhattan.
To begin with, I should be upset there’s a movie dedicated to this. To out someone is a bit of a faux pas, and this movie probably doesn’t help the queer cause. At the same time, it kind of makes the director of the film, Kirby Dick, look like the same four-letter word that is also his last name. On the other hand, gossiping about and laughing at the follies of Republican congressmen is definitely quite fun.
Dick’s film draws on a compilation of substantiated rumors to expose conservative Republicans. The more obvious of these individuals includes former Rep. Mark Foley, who was indicted for sexual relationships he had with 16-year-old male pages, and Larry Craig, who was caught cruising a men’s bathroom at a Minnesota airport.

Sacha Baron Cohen: The men in his life
His latest alter ego, a gay Austrian fashionista, is already hailed as a work of genius. But can Sacha Baron Cohen ever just be himself?

They didn’t know, the Alabama National Guard. Never realised that allowing a German documentary-maker into their high-security training camp 65 miles east of Birmingham would go so wrong. They certainly couldn’t have guessed, when they agreed to let him take part in training, that this curiously effeminate man would adorn his US military uniform with a white D&G belt, or strip in front of a locker room-full of crew-cut squaddies to reveal a camouflage thong.
Ron Paul didn’t twig, either, that a TV interview that was supposed to be about Austrian economics might end in a candle-lit hotel bedroom, where a blond male journalist would proffer cheap champagne before attempting to seduce him. Never, in his wildest dreams, could the 73-year-old hero of the Republican right have envisioned that a predatory homosexual would have the gall to suddenly drop his trousers. That’s why Paul ran away shouting: “This is ENDED!”
Then there was the crowd lured to a fairground in Fort Smith, Arkansas, on the promise of one-dollar beer and “blue-collar brawling”. They expected to spend the evening watching good, old-fashioned fisticuffs. Instead, the cage-fighting took an unexpected turn when a contestant called “Straight Dave” and his opponent stopped wrestling and started, in the words of a police report, “stripping down to their underwear, kissing and rubbing” each other.
How could that crowd have guessed? How could they possibly have realised, in a town where men are men and “gay” is a form of insult, that a pair of tough-guys would start canoodling, and force them to watch? Little wonder they promptly started a riot. Whoever you happen to be, what other emotion, except extreme anger, is the natural reaction to being “punked” by Sacha Baron Cohen?
It’s been a while, now, since this ludicrously talented British comedian burst onto the scene. A decade since his character Ali G first demonstrated that you can make highly intelligent people say incredibly revealing things by asking them the stupidest questions imaginable. Three years since his Kazakhstani alter ego, Borat, toured Middle America exposing staggering levels of misogyny, anti-Semitism, and public ignorance.
But now he’s back. This summer, Baron Cohen will complete his trio of “mockumentary” films with a movie following the flamboyant exploits of Brüno, an outrageously camp fashion reporter from Klagenfurt, whose “MeinSpace” page proudly declares: “If I vas a Starbucks drink, ich vould be a tall, skinny Austrian mit a great personality und a really big brains.”
The film boasts the extended title Delicious Journeys Through America for the Purpose of Making Heterosexual Males Visibly Uncomfortable in the Presence of a Gay Foreigner in a Mesh T-Shirt. That pretty much sums up what the film is about. Firstly, Brüno’s preposterous vanity will expose the excesses of a fashion industry (and celebrity culture) obsessed with body image and consumerism. Secondly, his overbearing homosexuality will be used as a tool to generate, expose, and thus satirise public homophobia.

Gays under threat in Senegal
DAKAR, Senegal — A mob gathered near a mosque outside Dakar. They were there to hunt down and kill nine men accused of homosexual acts.
Earlier this week the nine Senegalese AIDS activists were freed from eight-year-prison terms for alleged homosexual acts, but they went into hiding because of death threats from Muslim religious leaders and the general population.
“The homosexuals will not escape lynching. They will be fish food,” Dakar newspaper L’Observeur quoted a local youth leader as saying.
“Gay men will never be free in Senegal. They expose us all to danger,” said Imam Mbaye Niang, a prominent religious leader and member of parliament. “The judges should understand that Senegalese people need to protect their children, their families from homosexuality.”
In Senegal — where 95 percent of the population is Muslim — homosexual acts are punishable by fines and up to five years in prison. In January, the nine men received the harshest sentence yet for such an offense in Senegal, getting the maximum of five years and an additional three for criminal conspiracy.
Though widely supported in Senegal, the conviction was condemned by international human rights groups and foreign governments, most notably France.
“They were judged and condemned very severely, surely on the basis of public outcry, therefore the justice was neither objective nor founded in law,” said lead defense attorney Barim Sassoum Sy, who called the initial ruling hasty and emotional.
A Dakar appeals court overturned that decision Monday, citing violations of legal protocol.
Acting on an anonymous tip, police had arrested the men — most of whom do HIV prevention work in the “men having sex with men” community — in December at the home of a prominent gay activist. But the police did not have a search warrant, nor did they catch the men in the act, which is required by the Senegalese law prohibiting “indecent acts against nature.” The judge hearing the appeal therefore declared their convictions null and void, Sy said.
Yet even as smiling attorneys and supporters celebrated in the packed courtroom Monday and exchanged congratulations, plans were already in place to get the freed men into hiding outside Dakar.
“The first judge sentenced them to eight years,” said Imam Niang. “He had the courage to say it. The judge that let them go was much less courageous. He yielded to international pressure.”

Safer or Stupid? Some Gay Men ‘PrEP’ for Sex
More than two decades into the AIDS epidemic, the well-known conundrum of condom burnout among gay men has produced a highly controversial underground practice. “Pre-exposure prophylaxis,” or PrEP, involves taking a comprehensive anti-retroviral drug, usually tenofivir, before having sex.
Some men are actually doing this because they take safer sex seriously indeed. One doctor told me of two patients who took the drug before they had protected sex with strangers as an added preventative in case a condom breaks.
But for the vast majority of gay men, PrEP means a key to not using a condom. That’s what makes it such a hot-button issue among AIDS researchers, doctors and activists. The theory behind is that the anti-retroviral drug prevents HIV from grafting itself onto healthy cells and replicating. When HIV first enters the human body, there isn’t much of it; theoretically, if those few viruses swimming around the bloodstream don’t have anywhere to go, they’ll die out–just as do millions of germs we come across every day that don’t affect us.
One prominent doctor in Boston maintained that PrEP, despite its bad rep, is necessary as one more tool in the arsenal of AIDS fighters. But others see it as an enabler for those men who don’t want to bother using protection. See Safer or Stupid? Some Gay Men ’PrEP’ for Sex

Prop 8 in court today: Stop Ken Starr from divorcing loving couples!
This morning, before the California Supreme Court, Ken Starr will argue for the forcible divorce of 18,000 loving same-sex couples who married before Proposition 8 passed.
Starr has said the marriage ban should stand because of the state’s role in protecting the welfare of children.
The hypocrisy of “protecting” children by divorcing their parents is unconscionable. Yet this is just one in a parade of outrageous lies by right-wing extremists.
So HRC is launching a new campaign to expose this dishonest fear-mongering against equality – to counteract the lies with respectful dialogue and grassroots action.

Since it’s no longer as acceptable to display open bigotry against LGBT people, the right-wing has resorted to lies and fear tactics. Take Ken Starr’s statement that same-sex marriage amounts to “seizing and hijacking the marriage relationship in order to achieve apartheid-type values.”
