LGBT Prisoner Safety Act Passes Assembly with Bipartisan Support

Bill Sponsored by EQCA and Introduced by Assemblymember Ammiano Now Moves to Senate

Sacramento – The California State Assembly passed the LGBT Prisoner Safety Act, AB 382, today by an overwhelming margin of 64-9. The bill garnered significant bipartisan support. Sponsored by Equality California (EQCA) and introduced by Assemblymember Tom Ammiano (D – San Francisco), the bill is designed to prevent violence against lesbian, gay, bisexual, and transgender (LGBT) people in the state prison system. The bill received more Republican votes than any other piece of legislation sponsored by EQCA.

“The California Assembly sent a powerful message today that all Californians deserve protection from violence,” said EQCA Executive Director Geoff Kors. “This vital bill seeks to end abuse and assault against LGBT prisoners, ensuring they receive equal and fair protection under the law.”

According to a recent study from the Cali¬fornia Department of Corrections and Re¬habilitation, 67 percent of LGBT inmates report being sexually assaulted by another inmate, a rate 15 times higher than the overall prison population.

By amending the Sexual Abuse in Detention Elimination Act (SADEA) of 2005 to include sexual orientation and gender identity on the list of factors for consideration when classifying and housing prisoners, the legislation promotes safety for and prevents assault against LGBT people in the prison system. The list of factors currently includes age, gender, type of offense, and prior time served.

“All people deserve basic protections – including those serving time in our state prisons,” Assemblymember Ammiano said upon introducing the bill. “No prisoner should fear for his or her life or be the target of abuse because of his or her sexual orientation or gender identity.”

The bill developed following a Senate Public Safety Committee meeting held in San Francisco this past December and chaired by Senator and former Majority Leader Gloria Romero (D-Los Angeles). The meeting, which was sponsored by EQCA along with Just Detention International, the Transgender Law Center, National Center for Lesbian Rights, and the Transgender Gender-Variant and Intersex Justice Project, exposed the dire issues facing LGBT people in California prisons in order to produce concrete solutions. The LGBT Prisoner Safety Act is an important step toward ensuring the safety of this highly vulnerable population. Last month, the bill passed the Assembly Public Safety Committee unanimously by a 7-0 vote.

Equality California Congratulates Rabbi Denise Eger on Historic Achievement

LOS ANGELES – Longtime advocate for lesbian, gay, bisexual and transgender (LGBT) community members, Rabbi Denis Eger has been installed as the president of the Board of Rabbis of Southern California, becoming the first woman and lesbian to serve in that capacity. The board brings together more than 300 rabbis.

EQCA to air ads for same-sex marriage

The state’s largest gay rights group announced plans May 7 to launch a new media and public relations campaign for same-sex marriage in California.

Equality California said it is buying air time for new television ads, hiring dozens of field organizers and reaching out to clergy to help change attitudes about same-sex couples.

LGBT Domestic Violence Services Bill Passes State Assembly

Bill Sponsored by EQCA and Authored by Assemblymember Pérez Now Moves to Senate

Sacramento – The California State Assembly passed the LGBT Domestic Violence Services Bill along party lines, with all 44 Democrats present voting in favor while all 17 votes against were cast by Republicans. Sponsored by Equality California (EQCA), the bill, AB 1003, will increase and expand services to lesbian, gay, bisexual or transgender (LGBT) survivors of domestic violence.

“By passing this bill, we are expanding innovative and proven program models already being pioneered by LGBT centers and organizations across the state,” said Assemblymember John A. Pérez (D-Los Angeles), the author of the bill. “Now more people will have greater access to the services they need – in a safe, comfortable environment.”

Rates of domestic violence in same-sex relationships are equivalent to those in opposite-sex relationships. However, support for LGBT survivors continues to lag far behind those available to non-LGBT couples.

“We must do all in our power to ensure that LGBT survivors of domestic violence have access to culturally competent services and resources,” Geoff Kors, executive director of EQCA. “EQCA is extremely grateful to Assemblymember Pérez for his leadership on this important issue and thank the California Assembly for helping move us one step closer to making this goal a reality.”

The LGBT Domestic Violence Services Bill is designed to correct this inequity by expanding access for LGBT service providers to a state fund within the California Emergency Management Agency, which supports LGBT-specific domestic violence programs across the state. The fund, originally established as part of another EQCA-sponsored bill in 2006, is subsidized by a $23 fee on domestic partner registrations. The new bill also eliminates the requirement for providers to offer shelter – an impediment to many smaller LGBT organizations that inadvertently keeps several California communities from providing any services for LGBT survivors of domestic violence. The bill previously passed the Assembly Public Safety Committee by a vote of 5-2.

Bill Making Identification Change More Accessible for Transgender Persons Passes Key Assembly Committee, Moves One Step Closer to Becoming State Law

Sacramento – The Equal ID Act took one step closer to becoming law today when it passed the State Assembly Judiciary Committee by a 7-3 vote. The bill, sponsored by Equality California (EQCA) and introduced by Assemblymember Ted Lieu (D – Torrance), increases the legal rights and recognition enjoyed by transgender people by clarifying that qualified transgender people born in California can return to the county of their birth to obtain a court order reflecting their correct gender and accompanying name change. The court order is then used to obtain a corrected California birth certificate.

“All Californians deserve legal documentation that accurately reflects who they are,” EQCA Executive Director Geoff Kors said. “Once passed, this law will make it easier for transgender people both in California and beyond to obtain accurate identification, apply for jobs, and live their lives as full and equal members of society.”

Until recently, California law only allowed transgender persons to petition the court for an order recognizing a change of gender in the county in which they presently reside. Last month, the Transgender Law Center successfully challenged the residency requirement in the California Court of Appeals. In Somers v. Superior Court, the court held that the residency requirement violated the equal protection rights of California-born transgender people residing out of state. The Equal ID Act is the next step in ensuring that all Californians are able to obtain accurate birth certificates.

“The Equal ID Act would bring the Health and Safety Code up to date with case law,” said Kristina Wertz, Legal Director of the Transgender Law Center. “It would alleviate any confusion and ensure that California-born people residing in other states know that they, too, can be afforded the dignity of a birth certificate that reflects who they truly are.”

The new bill ensures that transgender people born in California know that they can return to the county of their birth to obtain a corrected birth certificate. It also provides greater access to transgender persons living in the state, allowing them for first time to petition the court in their home counties.

“The Equal ID Act would make it clear to others in my situation that they can go back to the counties in which they were born to get a court order changing their gender. It would save people all the trouble I went through finding attorneys and spending nearly four years in the courts,” said Gigi Marie Somers, who testified at this morning’s committee hearing. Ms. Somers, a transgender woman born in California, was unable to obtain a new birth certificate in the state of Kansas, where she now resides. Ms. Somers was the plaintiff in the legal action brought by the Transgender Law Center.

“The rights of Californians should not end at our state’s borders,” Assemblymember Leiu said. “The Equal ID Act makes certain every Californian has the freedom and liberty to be true to his or herself.”

Birth certificates are used as primary source of identification and are often necessary to secure other forms of identification, including social security cards and passports.

California Assembly passes legislation that extends protections for the LGBT community

This week the California Assembly passed legislation that extends protections for the LGBT community with the most support of any EQCA-sponsored bill in history.

In a legislature that votes mostly on party lines on social issues, your direct grassroots action with EQCA has resulted in increased support for our legislation—proving that equality is not a partisan issue.
The bill, which will require prisons to include sexual orientation and gender identity when identifying prisoners who need protection, passed by an overwhelming margin of 65 to 9. 14 of the 29 Republican members voted for the legislation and 6 members abstained from the vote.

This recent victory is just one result of the hard work we have done together to gain more and more support for LGBT equality. Through your countless emails and lobby visits over the years you have shown all members of the Legislature the vital importance of LGBT equality. Members have told me personally that hearing stories from their constituents has only increased their support for EQCA’s legislation.

All of EQCA’s current legislation continues to pass their committees, including yesterday’s Assembly Judiciary Committee vote to make changing one’s gender identification more accessible for transgender persons and last week’s bipartisan vote in the Senate Education Committee to designate May 22 as Harvey Milk Day.

And this recent activity is evidence that the arc of equality always bends toward progress.

Equality California Launches Historic Win Marriage Back: Make it Real! Campaign

Grassroots mobilization and statewide ad buy announced

Los Angeles –Equality California (EQCA) today is launching the largest grassroots mobilization campaign of its kind in state history: Win Marriage Back: Make it Real! The new campaign features TV commercials, faith outreach, on-the-ground organizers, door-to-door canvassing and online activism. Over the next 100 days, the campaign will reach more than 300,000 Californians in person and millions online and over the airwaves.
“This is exactly the kind of person-to-person, peer-to-peer outreach we need to be doing to change minds and win support for the freedom to marry for same-sex couples,” said Mayor Gavin Newsom.
EQCA is a plaintiff in the current legal challenge against Prop. 8. The Court is scheduled to issue its ruling between now and June 3rd.

“While we remain hopeful that the court could invalidate Prop. 8, we cannot wait another day to take action. We are launching the most extensive campaign of its kind to talk openly and honestly with Californians on their front porches, online and over the airwaves in order to achieve full equality for lesbian, gay, bisexual and transgender community members,” said EQCA Marriage Director Marc Solomon.

As part of today’s launch, EQCA released the first two in a series of television ads that feature same-sex couples and Californians hurt by the marriage ban. The first ads are scheduled to air statewide starting Monday.

Over the next hundred days, volunteer canvassers will knock on 40,000 doors in targeted communities as well as enlist 100,000 activists to serve as Equality Ambassadors, who will pledge to have conversations about marriage with at least 300,000 California residents.

To help meet the campaign’s ambitious goals, EQCA is currently hiring and placing 25 full-time field organizers throughout the state, including the Central Valley, the Inland Empire, San Diego, Sacramento, Los Angeles and Orange Counties. Six organizers have already been hired.

“This campaign is for every person in every community in every part of our state, and it will empower our diverse community and allies to win marriage back together,” said Andrea Shorter, EQCA coalition coordinator. “We will also enlist 1,000 clergy in the next 100 days to help spread the word that marriage equality is a spiritual value as well as a civil right.”

EQCA will also organize major outreach events with faith, grassroots and community leaders as part of the campaign specifically working with African American and Latino communities.

Oscar Winner Dustin Lance Black Testifies in Support of Harvey Milk Day, Which Promply Passes Key Committee

Sacramento – Dustin Lance Black, the Academy Award winning writer of the film Milk, testified before the California State Senate Education Committee shortly before it passed the Harvey Milk Day Bill, SB 572, in a 7-2 vote that included bipartisan support from Sen. Abel Maldonado (R-Santa Maria) who voted for the bill.

“When I was 14 years old, a theatre director in the Bay Area told me the story of Harvey Milk,” said Black, an advocate for equal rights. “It was a story about an out gay man who stood up to prejudice and bigotry, lived openly as who he was, was elected to public office, and lit the fire of today’s national and global LGBT civil rights movement. Not surprisingly, his story gave me hope,” he said.
The bill, sponsored by Equality California (EQCA) and introduced by Senator Mark Leno (D – San Francisco) calls for a “day of special significance” honoring Milk and is designed to educate Californians about the former San Francisco City Supervisor, who became the nation’s first openly lesbian, gay, bisexual or transgender (LGBT) person elected to political office in a major city.
“We may have lost Harvey Milk, but we have not lost his passion, his commitment, and his courage,” said Geoff Kors, EQCA Executive Director. “Harvey Milk’s endurance in the face of seemingly insurmountable challenges is a source of pride and inspiration for every Californian.”

Milk’s groundbreaking service as an openly gay official helped bring LGBT people out of the closet and into civic life. During his time in office, he was responsible for both passing San Francisco’s first gay-rights ordinance and helping to defeat the controversial Briggs Initiative, which sought to ban gay and lesbian teachers from public schools. Milk, along with San Francisco Mayor George Moscone, was assassinated in November 1978.

“Harvey Milk gave hope to an entire generation of gay and lesbian people whose basic humanity and freedom had been denied and dishonored,” said Senator Leno. “He literally gave his life so that I and other LGBT elected officials could serve in public office. Thanks to Dustin Lance Black and the creators and stars of the movie “Milk,” Harvey’s incredible story continues to be told around the world. It is only fitting that we continue our work to preserve his legacy for generations to come,” he said.
The legislation was originally introduced last year by Sen. Leno, but Governor Arnold Schwarzenegger vetoed the measure at the time, claiming Harvey Milk was not well known enough beyond San Francisco. Since that time, however, Harvey Milk has become a focal point of national conversation following the successful release of Milk, the critically acclaimed film depicting the life of the slain civil rights leader for which Black and actor Sean Penn received Academy Awards.

The same group, motivated by fear and hate, who brought us Prop 8 is at it again—with a new target.
This time they are turning up the heat, urging their members to contact the governor asking him to veto EQCA’s legislation–authored by Senator Mark Leno–to honor my uncle, Harvey Milk.

Academy Award Winning Screenwriter Dustin Lance Black to Testify in Favor of Harvey Milk Day Bill

Sacramento–Dustin Lance Black, Academy Award winning screenwriter of the film Milk will testify before the Senate Education Committee on Wednesday in support of legislation establishing Harvey Milk Day in California. Senate Bill 572, sponsored by Equality California and authored by Sen. Mark Leno (D- San Francisco), creates a day of special significance on Milk’s birthday, May 22.

Harvey Milk, a former San Francisco City supervisor, was the first openly gay elected official of any large city in the United States, and only the third openly gay elected official in the nation. He and San Francisco Mayor George Moscone were assassinated in San Francisco on November 27, 1978. His life was the subject of last year’s critically-acclaimed film Milk, for which both Black and actor Sean Penn received the Academy Award.
