Black Pastors and Gay Rights: DC Becomes a Battleground

The nation’s capital is suddenly center court in America’s loud argument over gay marriage. Nothing new about that, except that this time the battle is being hashed out in the streets, churches and living rooms in working class wards of the city. While there is something poignant about both sides literally singing the same hymn (“We Shall Overcome”) at its rallies, there is also something refreshing about the debate taking place in the unofficial part of Washington, D.C: For once, it’s not partisan.That is not to say it’s not a touchy issue. Gay marriage pits race and faith together in the same combustible conversation, and does so in a community in which both are sacrosanct subjects. The black Christian church predates Emancipation by more than two centuries, and served as a bulwark against the pernicious effects of slavery, Jim Crow, alcohol and drugs, AIDS, poverty, crime, police brutality and bad schools.
In the face of all that, African-American pastors and their churches have offered up faith and love of family as twin defenses. Thus they have been an institution with a message that at its core is fundamentally conservative. And at the same time, it was from the pulpits of these very same black churches that emanated the commanding voices that demanded fundamental change to the old order. Make no mistake, the moral authority and raw political power of the civil rights movement was rooted in these self-same churches. And in that sense they were a liberating, as well as a stabilizing, force.
These contradictory forces of liberalism and conservatism have coexisted, not always easily, for centuries within the church. But gay marriage has opened a chasm in the black community, in which, to paraphrase (and modernize) Lincoln who, while speaking about the North and South during the Civil War, observed that each side reads the same bible, prays to the same God, invokes His wisdom against the other – and belongs to the same political party.
In the local politics of Washington, the true power brokers are predominately black, monolithically Democratic and tuned into the religious sensibilities of their constituents. Thus, the discussion taking place here over gay marriage is really a series of conversations; some within the black community and some within the Christian churches, and almost all of it within the Democratic Party. This is not altogether a bad thing. For starters, there’s no Republican bogeyman, and for another, the race card is played to establish one’s bona fides, not to stoke prejudice. Finally, the church-bashing rhetoric one finds in other places where this debate is taking place is muted here: Attacking the church would simply be a good way to lose the argument. And judging by the language being invoked by both sides, the stakes of this argument are high: Leaders of competing camps clearly believe that what unfolds here in unofficial Washington will be a harbinger for where this nation is heading on gay rights.
“The march towards equality is coming to this country, and you can either be a part of it or stand in the way,” David Catania, one of two openly gay D.C. Council members, declared on May 5, as the council approved his pro-gay marriage measure.

California appellate court rules La Crescenta property belongs to Los Angeles diocese

A California appellate court’s June 9 ruling was the latest in a series of recent developments that return disputed church properties to three California Episcopal dioceses.

On June 9, the San Diego-based Fourth District Court of Appeal ruled unanimously that the Diocese of Los Angeles is legal owner of property currently occupied by St. Luke’s Anglican Church. The congregation had cited theological differences when severing ties to the Episcopal Church (TEC) in 2006 and realigning with an Anglican diocese in Uganda.

In unrelated agreements, displaced Episcopalians will return July 1 to two other disputed properties, St. John’s Church in Petaluma, in the Diocese of Northern California and St. Paul’s Church in Modesto in the Diocese of San Joaquin.

“The long history of the Episcopal Church in La Crescenta will continue with new leadership and the potential for sustained growth, and as an open source of full inclusion for all humanity,” Bishop Jon Bruno of Los Angeles said June 9 after learning of the court’s decision.

“It is important that we preserve the essence of St. Luke the healer and the ongoing maintenance of the historic church building. It is a jewel in the crown of La Crescenta, and a blessing to the people of the Diocese of Los Angeles.”

Los Angeles: ‘property held in trust’ for wider church

The appellate court ruling affirmed a 2007 trial court decision that the church, located about 15 miles north of Los Angeles, was held in trust for the mission of both the local diocese and the wider church. In issuing the ruling, the ten-member panel cited a January 5, 2009 California Supreme Court decision, which returned St. James Anglican Church in Newport Beach to the diocese. Attorneys in that case, New v. Kroeger, have appealed the decision to the U.S. Supreme Court.

John Shiner, chancellor for the Diocese of Los Angeles, said a timeline for transition will advance in accordance with court procedures.

The Rev. Rob Holmann, rector of St. Luke’s Anglican Church, declined to comment June 10. “I know the general direction of the ruling, but I am withholding all comment until I see it” and until he could speak with attorneys, he told the Episcopal News Service.

A few days earlier, Holmann had told the Glendale News Press that he and the 200-member congregation “would very much like to stay” in the 83-year-old river-rock building, considered a cultural, architectural and historic local landmark.

Bruno said the future mission of St. Luke’s, now under his direct pastoral control, will be to focus on “deepening our understanding of what it means to be reconciled, welcoming and healthy people of God.”

Petaluma and Modesto: Episcopal congregations set to return July 1

After a bitter split and three years of “homelessness,” members of St. John’s Episcopal Church in Petaluma are returning July 1 to the 118-year-old church, the Rev. Norman Cram said in a telephone interview June 10.

“We are jubilant, overwhelmingly jubilant,” said Cram, priest-in-charge. “We celebrated our homelessness and we overlooked the inconveniences of living and worshipping out of a laundry basket but now that these things are almost behind us, it’s almost overwhelming.”

Citing disagreement over the ordination of a gay bishop, a majority of the 250-member congregation in December 2006 had voted to sever ties with the Episcopal Church and the Diocese of Northern California but declined to vacate church property. They formed St. John’s Anglican Church, displacing about 55 continuing Episcopalians who initially met in homes.

The Rev. David Miller, rector of the Anglican congregation, had sought a transfer of his canonical residence to the Argentina-based Anglican Province of the Southern Cone and was eventually deposed by the Rt. Rev. Jerry Lamb, then bishop of the Diocese of Northern California.

Miller did not return ENS telephone calls June 10. Mike McIntosh, parish administrator for the disaffiliated group, said a news release would be issued eventually, but declined further comment. The congregation’s last service in the church will be Sunday, June 28.

The continuing Episcopal congregation eventually began meeting on Sunday evenings at the Elim Lutheran Church in Petaluma who “magnificently sheltered us,” said Cram. He added that he hopes: “to present a healthy Christian perspective of love, compassion and kindness to our community, to be the yeast for the values of unity and inclusiveness in Petaluma.”

Meanwhile, Bishop Jerry Lamb of San Joaquin told ENS that discussions are underway with St. Paul’s Church in Modesto for return of that property by July 1, which several years ago affiliated with the Anglican Mission in America.

The Rev. Michael McClenaghan, rector, did not return ENS calls.

Lamb was already planning an organizational meeting, seeking lay leaders to begin the work of transition. “I have been making calls this week to laity who are or have been members of St. Paul’s and have signaled their desire to remain in the Episcopal Church,” he said in a statement posted on the diocesan website.

Former gay-porn actor guilty of Denver murder

A male escort was convicted this afternoon of the premeditated murder of his boss and former sexual partner, and now will spend the rest of his life in prison.

Timothy Boham, 28, was found guilty by a nine-woman, three-man jury in Denver District Court of first-degree murder after deliberation, felony murder and aggravated assault.

Colorado law mandates that someone found guilty of first-degree murder must spend the rest of their life in prison, without the possibility of parole. Judge Will Hood Jr. will hand down the sentence Tuesday.

The jury took less than five hours to convict Boham, whose lawyers — Amber St. Clair and Kristan Wheeler — claimed that his victim, wealthy Denver businessman J.P. Kelso, committed suicide. They tried to persuade the jury that the murder scene was merely a coverup for a suicide so that Kelso’s life-insurance policy would pay out.

According to four days of testimony, Boham had a paid sexual encounter in late 2005 with Kelso, who owned Professional Recovery Systems, a debt-collection agency where Boham briefly worked twice.

Boham, a former gay-porn actor, said he and Kelso hung out together numerous times in the 11 months they knew each other.

Lambda Legal Files Federal Lawsuit Against Assisted Living Facility Following Eviction of HIV-Positive Retired Minister

‘They shunned and rejected him, making him feel like a complete outcast.’

(Little Rock, Ark.) — Lambda Legal announced today that it has filed suit in U.S. District Court for the Eastern District of Arkansas against Fox Ridge of North Little Rock, an assisted living facility.

The lawsuit was filed on behalf of 75-year-old Reverend Dr. Robert Franke, a retired university provost and Unitarian-Universalist minister, and his daughter, Sara Franke Bowling.

Dr. Franke, who relocated to Little Rock to be closer to his daughter, moved in to Fox Ridge after fulfilling all of its residency requirements — including submission of medical evaluation forms from a local physician. The next day, however — after realizing Dr. Franke is HIV-positive —Fox Ridge officials abruptly ejected Dr. Franke from the facility. A Fox Ridge staffer told Bowling her father’s personal belongings could remain, but that the “body” had to be out by the end of the day.

“I was stunned that my dad was thrown out of his new home,” said Bowling. “The people at Fox Ridge were supposed to make sure that he was comfortable and cared for, and instead they shunned and rejected him, making him feel like a complete outcast.”

Dr. Franke requires no special medical attention beyond daily medication and regular check-ups with a physician, and Fox Ridge is licensed by the state to provide Dr. Franke with the kind of care he and his daughter were seeking for him.

“Federal and state laws exist to protect people from just this sort of unjust treatment,” said Scott Schoettes, HIV Project staff attorney for Lambda Legal. “Unfortunately, this is something we are seeing far too frequently, all across the country. Those tasked with caring for our elderly loved ones need to know that it is illegal to discriminate against someone with HIV based on outdated and misguided beliefs about its transmission.”

Franke and Bowling are seeking damages under the Fair Housing Act, the Arkansas Civil Rights Act and the Arkansas Fair Housing Act, as well as an injunction, under those laws and the Americans with Disabilities Act, preventing Fox Ridge from continuing to engage in this kind of conduct.

“This is about doing the right thing,” said Franke. “I want to make sure it doesn’t happen to anyone else — because no one should ever be made to feel the way I did.”

Scott Schoettes, HIV Project Staff Attorney, and Kenneth Upton, Supervising Senior Staff Attorney, are handling the case for Lambda Legal. They are joined by co-counsel Gary L. Sullivan of the Tripcony Law Firm in Little Rock, Arkansas. The case is Robert G. Franke and Sara Franke Bowling v. Parkstone Living Center, Inc., dba Fox Ridge at North Little Rock.

Maine legalizes same-sex marriage

Same-sex marriage became legal in Maine on Wednesday as Gov. John Baldacci signed a bill less than an hour after the state legislature approved it.

“I have come to believe that this is a question of fairness and of equal protection under the law and that a civil union is not equal to civil marriage,” said Baldacci, a Democrat.

But he raised the possibility that the residents of the state would overturn the law, saying, “Just as the Maine Constitution demands that all people are treated equally under the law, it also guarantees that the ultimate political power in the State belongs to the people.”

Three other states — Massachusetts, Connecticut and Iowa — allow same-sex marriages. Vermont has passed a law making gay and lesbian marriages legal that takes effect in September. New Hampshire lawmakers are close to passing a similar bill.

On Tuesday, the Washington City Council voted to recognize same-sex marriages from states that allow those unions. Mayor Adrian Fenty has indicated that he will sign the measure. The impact of ‘Christian’ homophobia: New Research Reveals Young Americans Losing Their Religion In Staggering Numbers

New research shows young Americans are dramatically less likely to go to church — or to participate in any form of organized religion — than their parents and grandparents.

“It’s a huge change,” says Harvard University professor Robert Putnam, who conducted the research.

Historically, the percentage of Americans who said they had no religious affiliation (pollsters refer to this group as the “nones”) has been very small — hovering between 5 percent and 10 percent. However, Putnam says the percentage of “nones” has now skyrocketed to between 30 percent and 40 percent among younger Americans.

Putnam calls this a “stunning development.” He gave reporters a first glimpse of his data Tuesday at a conference on religion organized by the Pew Forum on Faith in Public Life.

The research will be included in a forthcoming book, called “American Grace.”

This trend started in the 1990s and continues through today. It includes people in both Generation X and Y.

While these young “nones” may not belong to a church, they are not necessarily atheists.

“Many of them are people who would otherwise be in church,” Putnam said. “They have the same attitidues and values as people who are in church, but they grew up in a period in which being religious meant being politically conservative, especially on social issues.”

Putnam says that in the past two decades, many young people began to view organized religion as a source of “intolerance and rigidity and doctrinaire political views,” and therefore stopped going to church.

This movement away from organized religion, says Putnam, may have enormous consequences for American culture and politics for years to come.

“That is the future of America,” he says. “Their views and their habits religiously are going to persist and have a huge effect on the future.”
