Human Rights Campaign Calls on the LGBT Community and Allies to Participate in National, Grassroots Push to Lobby Congress Face-to-Face
The Human Rights Campaign, the nation’s largest lesbian, gay, bisexual and transgender (LGBT) civil rights organization, today launched a national, grassroots campaign called “No Excuses” to demand action from Congress on key issues of equality. Designed to take advantage of the congressional summer recess, when members are in their local offices and meeting with constituents, “No Excuses” will mobilize HRC’s 750,000 members and their allies to meet directly with lawmakers and push for federal legislative change. ACLU Sues To Stop Tennessee Schools From Censoring Gay Educational Web Sites; Filtering Software Allows Anti-Gay Sites
NASHVILLE, TN – The American Civil Liberties Union and the ACLU of Tennessee sued two Tennessee school districts in federal court today, charging the schools are unconstitutionally blocking students from accessing online information about lesbian, gay, bisexual and transgender issues. Metropolitan Nashville Public Schools, Knox County Schools and as many as 105 other school districts in Tennessee use Internet filtering software to block Web sites containing pro-LGBT speech, but not Web sites touting so-called “reparative therapy” and “ex-gay” ministries. The “LGBT” filter is not used to block sites containing pornography, which are filtered under a different category, but it does block the sites of many well-known LGBT organizations including Parents, Families, And Friends of Lesbians and Gays (PFLAG), the Gay Lesbian Straight Education Network (GLSEN) and Human Rights Campaign (HRC).
“Allowing access to Web sites that present one side of an issue while blocking sites that present the other side is illegal viewpoint discrimination,” said Catherine Crump, a staff attorney with the ACLU First Amendment Working Group and lead attorney on the case. “This discriminatory censorship does nothing to make students safe from material that may actually be harmful, but only hurts them by making it impossible to access important educational material.”
The school districts block the Internet filtering category designated “LGBT,” which includes sites that “provide information regarding, support, promote, or cater to one’s sexual orientation or gender identity.” They do not, however, block sites that condemn homosexuality or promote “reparative therapy,” a practice purporting to “cure” LGBT people that is denounced as dangerous and harmful to young people by such groups as the American Psychological Association and the American Medical Association.
The ACLU filed the case in the U.S. District Court for the Middle District of Tennessee against Metropolitan Nashville Public Schools and Knox County Schools on behalf of two high school students in Nashville, one student in Knoxville and a high school librarian in Knoxville who is also the advisor of the school’s Gay-Straight Alliance (GSA).
“Students need to be able to access information about their legal rights or what to do if they’re being harassed at school,” said Keila Franks, a 17-year-old student at Hume-Fogg High School in Nashville and a plaintiff on the case. “It’s completely unfair for schools to keep students in the dark about such important issues and treat Web sites that just offer information like they’re something dirty.”
The lawsuit charges that blocking LGBT sites violates students’ First Amendment rights by only allowing access to sites that present an anti-gay point of view on the rights of LGBT persons on issues such as anti-gay harassment, marriage, employment discrimination and the military’s “don’t ask, don’t tell” policy while blocking access to sites that support LGBT rights. Further, the filtering hinders the ability of GSAs and their members to facilitate club activities and keeps students from accessing important information about scholarships for LGBT students or doing research for school-related assignments.
The ACLU first learned about the discriminatory filtering from Andrew Emitt, a Knoxville high school student who discovered the problem while trying to search for LGBT scholarships. Internet filtering software is mandated in public schools by Tennessee law, which requires schools to implement software to restrict information that is obscene or harmful to minors. However, the “LGBT” filter category does not include material which is sexually gratuitous and already included in the “pornography” filtering category.
“While schools may have an interest in using filters to block material that could be harmful to minors, blocking access to information about LGBT issues while allowing anti-gay information is unlawful and potentially dangerous,” said Tricia Herzfeld, a staff attorney with the ACLU of Tennessee. “There is no place for this kind of unconstitutional censorship in our public schools.”
In addition to Crump and Herzfeld, attorneys on the case are Chris Hansen of the ACLU First Amendment Working Group and Christine Sun of the ACLU LGBT Project.
The plaintiffs are Nashville students Keila Franks and Emily Logan, Knoxville student Bryanna Shelton, and Karyn Storts-Brinks, a Knoxville high school librarian and faculty sponsor for her school’s GSA.

GLAAD Announces Launch of Advertising Media Program

New York, NY May 08, 2009 – The Gay & Lesbian Alliance Against Defamation (GLAAD) today announced the launch of an Advertising Media Program as part of its national lesbian, gay, bisexual and transgender (LGBT) media advocacy and anti-defamation work. The program will officially launch during a reception for LGBT advertising professionals and allies where GLAAD will honor Levi’s Brand and Wells Fargo for their commitment to LGBT-inclusive advertising. ‘Third of Kirk ministers sign anti-gay petiton’
Almost a third of Church of Scotland ministers have signed a petition attacking the appointment of a gay minister to a church in Aberdeen, organisers claimed yesterday.
The online campaign, led by the Fellowship of Confessing Churches, a new organisation, has attracted almost 6,000 supporters – more than 300 of whom are ministers.

Gay Students at a Kentucky High School Report Not Being Able to Use the Restroom because of their Sexual Orientation
Kentucky Equality Federation received reports that a Franklin County High School official allegedly sent an email to teachers instructing them not to allow homosexuals to leave class to use the restroom.
Frankfort, KY — Kentucky Equality Federation received reports that a Franklin County High School official allegedly sent an email to teachers instructing them not to allow homosexuals to leave class to use the restroom.
The email was allegedly sent after two female classmates were caught kissing in the public restroom.
In response, 15 students protested outside the school yesterday.
“My daughter was involved in a protest at Franklin County High School yesterday for their right to use the restroom,” stated Michelle Sexton.
“I have been in contact with one of the parents of the children involved in the protest and we support their constitutional right to assemble peacefully,” stated Kentucky Equality Federation President Jordan Palmer. “We call on the media to investigate this issue further and shed light on the discrimination gays and lesbians face throughout the Commonwealth. Kentucky Equality Federation will also be contacting the other parents of the children involved in today’s protest.”
Though Superintendent Harrie Buecker stated steps are being taken to address the students’ concerns, Kentucky Equality Federation is concerned they will not be addressed properly. Though not directly connected, Kentucky Equality Federation has received similar complaints in Casey, Pulaski, and Powell counties about unfair treatment of gay and lesbian students and teachers.
“I’d like to know what level this mentality, that gay and lesbian students should not be treated equally is coming from. An incident in one county could be called an isolated incident, but we now have similar reports in three other Kentucky Counties,” stated Kentucky Equality Federation Managing Director Laura Reed.
Kentucky Equality Federation will continue its own investigation and assist parents or students in filing any necessary complaints with Kentucky officials.
Palmer added that assembling together in a peaceful manner is the most basic right granted by the Kentucky Constitution, and that Kentucky Equality Federation had contacted the Office of Helen W. Mountjoy, Kentucky’s Secretary of Education for assistance in resolving the issues.

Tom Cruise Top Gun Costar McGillis: Yup, She’s Gay E! Online
Who knew when Tom Cruise famously serenaded Kelly McGillis in Top Gun with “You’ve Lost That Loving Feeling” it would be a foreshadowing of things to come?
In a new interview with SheWired.com, McGillis reveals that she’s gay. Now single, the 51-year-old actress told videoblogger Jennifer Corday that she was looking for a girlfriend. “I’m done with the man thing,” she said. “I did that. I need to move on in life.”
McGillis’ breakout role, as an Amish mother in Witness opposite Harrison Ford in 1985, earned her a Golden Globe nomination. Top Gun followed in 1986, and then two years later, she played an attorney for a rape victim (a role which earned Jodie Foster an Oscar) in The Accused.

Amazon Will Fix De-ranking ‘Glitch’
A “glitch” on Amazon.com has caused the sales rank to be removed from gay- and/or lesbian-themed books by James Baldwin, Gore Vidal and others.
“There was a glitch in our systems and it’s being fixed,” Amazon’s director of corporate communications, Patty Smith, said in an e-mail Sunday.
As of Sunday night, books without rankings included Baldwin’s “Giovanni’s Room,” Vidal’s “The City and the Pillar” and Jeanette Winterson’s “Oranges Are Not the Only Fruit.” The removals prompted furious remarks on Facebook, Twitter and elsewhere online.

Stigma drives HIV-positive gay men’s sexual risk-taking

HIV-positive gay men’s experiences of stigma and rejection by sexual partners strongly influence their involvement in casual sex and discourage them from practicing many risk-reduction strategies, report Sigma Research in their Relative Safety II report published this week.
The men they interviewed wished to balance their desire for sexual pleasure with a need to maintain their sense of moral integrity, but were often unable to avoid sex which could result in HIV transmission.
To follow up a similar study published a decade ago, Adam Bourne and colleagues interviewed 42 gay men with diagnosed HIV about their sexual practices and management of risk. The in-depth, qualitative interviews focused on recent experiences of unprotected anal intercourse (UAI), and to take part in the study, men had to have had unprotected sex in the past year. Therefore it’s important to note that the study does not reflect the experiences of the one-third of gay men with HIV who do not practice UAI in any given year.
The researchers attempted to include in the sample a mix of respondents from London and Manchester as well as lower prevalence areas, and also ensure diversity in terms of age and time since diagnosis.
All respondents were aware that they could transmit HIV through unprotected anal intercourse, and almost all said that they would never want to be responsible for doing so. Men more recently diagnosed tended to be particularly preoccupied by this concern, often avoiding sex altogether for a period after diagnosis.
In terms of the other harms which unprotected sex could give rise to, men tended to feel that sexually transmitted infections were rarely serious, although a few were more concerned about hepatitis C. Whilst some recently diagnosed men felt that HIV superinfection was an issue, men who had been diagnosed for longer usually believed that clinicians had deliberately exaggerated its importance.
Of more concern, however, were the emotional, psychological and social harms that unprotected sex could lead to. If men failed to live up to their own ethical guidelines, this could lead to inner turmoil. Moreover, some respondents described the perceived irresponsible behaviour of other HIV-positive men in order to highlight their own moral integrity. Having unprotected anal intercourse posed a threat both to a man’s positive sense of self and to the way in which other gay men saw him.
The researchers argue that men’s concerns about rejection and stigma shape they way they manage risk. Disclosure leaves men vulnerable to significant harm, including violent reactions and anxiety about ex-partners using police investigations as retribution, as well as rejection leading to emotional upset and problems finding sexual partners. In a community that often remains hostile to people with HIV, men’s instinct for self-preservation often leads them to choose behaviours where disclosure is felt to be unnecessary.
For example, many men used saunas, not just because sex was readily available, but also because the men assumed that almost all other sauna users were HIV-positive. Like online chat rooms or HIV support group meetings, saunas were thought to be ‘HIV positive spaces’ where men had implicitly announced their HIV status simply by being there. This allowed men to have unprotected sex there without an explicit discussion of HIV status, but leaving them with their sense of personal integrity intact.
In some settings, some men tried to avoid disclosure but maintain their sense of moral integrity by suggesting to sexual partners that it would be a good idea to use a condom. Nonetheless one man described how these suggestions prompted one sexual partner to ask directly whether he had HIV. When he said yes, the man became angry and left.
Another form of implicit disclosure that men tried was ticking ‘safer sex needs discussion’ on a Gaydar internet profile. Few men explicitly advertised their HIV status on their profile, but might mention it during private instant messaging. The respondents described ambiguities and misunderstandings in disclosure on the internet, but generally found that the internet enabled them to screen potential partners with less fear of disappointment or reprisal.
Nonetheless, the researchers found that men used risk reduction strategies to quite a limited extent. No respondents mentioned reducing the duration of anal intercourse or the impact that viral load or a sexually transmitted infection could have on the risk of transmission. Just a few men discussed the greater risk of infection for the receptive partner or the possible benefit of withdrawing before ejaculation.
Some men did practice some form of sero-sorting (seeking partners of the same HIV status) and respondents said that it allowed them to have uninhibited sex where HIV status did not remain the most salient concern throughout.
Nonetheless the researchers stress that no man exclusively practiced sero-sorting in a way that could guarantee that both partners had the same HIV status. Disclosure was often implicit (by being in a sauna, for example) or was not reciprocal. The respondent may have made an upfront disclosure of HIV status, and assumed that if his partner was ready to carry on without condoms, then he must be positive too.
However the majority of men actually rejected the idea of sero-sorting. It was associated in their minds with high-risk, esoteric practices, and in the words of one respondent, men who are “going spreading it round because they are shagging willy-nilly”. Many men were at pains to distance themselves from this behaviour. They were appalled by the idea that unprotected sex could ever be a regular or planned activity, and so rejected sero-sorting, strategic positioning, withdrawal before ejaculation and other risk reduction strategies.
Nonetheless these same men had all had some unprotected sex. It tended to be described as an exceptional event, explained by circumstances such as substance use or a partner’s insistence. The researchers make it clear that a number of men lacked the self-confidence or negotiation skills to manage such situations. Many men aspired to use a condom every time, but were not able to fall back on risk reduction strategies when, for whatever reason, condoms weren’t used.
In their conclusion the researchers note several consequences of HIV related stigma: a reluctance to disclose and an encouragement to have anonymous sex; some interviewees’ rejection of other HIV-positive men and their behaviour; a desire not to engage with the idea that HIV risk is an integral part of sex; and the reluctance to use risk-reduction strategies.
However they also note that, for many men, there are direct contradictions between their intentions and their behaviour. Many men construct systems of belief about risk that enable them to have the sex they desire, whilst feeling that they are ‘moral enough’. They believe they are behaving responsibly, but HIV transmission may well be taking place.
The researchers recommend tailored prevention interventions for diagnosed men which take account of the centrality of stigma, and discuss unprotected sex in credible and informative ways. Moreover health professionals need to improve their skills in engaging men with these issues.
