ACLU Sues To Stop Tennessee Schools From Censoring Gay Educational Web Sites; Filtering Software Allows Anti-Gay Sites

NASHVILLE, TN – The American Civil Liberties Union and the ACLU of Tennessee sued two Tennessee school districts in federal court today, charging the schools are unconstitutionally blocking students from accessing online information about lesbian, gay, bisexual and transgender issues. Metropolitan Nashville Public Schools, Knox County Schools and as many as 105 other school districts in Tennessee use Internet filtering software to block Web sites containing pro-LGBT speech, but not Web sites touting so-called “reparative therapy” and “ex-gay” ministries. The “LGBT” filter is not used to block sites containing pornography, which are filtered under a different category, but it does block the sites of many well-known LGBT organizations including Parents, Families, And Friends of Lesbians and Gays (PFLAG), the Gay Lesbian Straight Education Network (GLSEN) and Human Rights Campaign (HRC).

“Allowing access to Web sites that present one side of an issue while blocking sites that present the other side is illegal viewpoint discrimination,” said Catherine Crump, a staff attorney with the ACLU First Amendment Working Group and lead attorney on the case. “This discriminatory censorship does nothing to make students safe from material that may actually be harmful, but only hurts them by making it impossible to access important educational material.”

The school districts block the Internet filtering category designated “LGBT,” which includes sites that “provide information regarding, support, promote, or cater to one’s sexual orientation or gender identity.” They do not, however, block sites that condemn homosexuality or promote “reparative therapy,” a practice purporting to “cure” LGBT people that is denounced as dangerous and harmful to young people by such groups as the American Psychological Association and the American Medical Association.

The ACLU filed the case in the U.S. District Court for the Middle District of Tennessee against Metropolitan Nashville Public Schools and Knox County Schools on behalf of two high school students in Nashville, one student in Knoxville and a high school librarian in Knoxville who is also the advisor of the school’s Gay-Straight Alliance (GSA).

“Students need to be able to access information about their legal rights or what to do if they’re being harassed at school,” said Keila Franks, a 17-year-old student at Hume-Fogg High School in Nashville and a plaintiff on the case. “It’s completely unfair for schools to keep students in the dark about such important issues and treat Web sites that just offer information like they’re something dirty.”

The lawsuit charges that blocking LGBT sites violates students’ First Amendment rights by only allowing access to sites that present an anti-gay point of view on the rights of LGBT persons on issues such as anti-gay harassment, marriage, employment discrimination and the military’s “don’t ask, don’t tell” policy while blocking access to sites that support LGBT rights. Further, the filtering hinders the ability of GSAs and their members to facilitate club activities and keeps students from accessing important information about scholarships for LGBT students or doing research for school-related assignments.

The ACLU first learned about the discriminatory filtering from Andrew Emitt, a Knoxville high school student who discovered the problem while trying to search for LGBT scholarships. Internet filtering software is mandated in public schools by Tennessee law, which requires schools to implement software to restrict information that is obscene or harmful to minors. However, the “LGBT” filter category does not include material which is sexually gratuitous and already included in the “pornography” filtering category.

“While schools may have an interest in using filters to block material that could be harmful to minors, blocking access to information about LGBT issues while allowing anti-gay information is unlawful and potentially dangerous,” said Tricia Herzfeld, a staff attorney with the ACLU of Tennessee. “There is no place for this kind of unconstitutional censorship in our public schools.”

In addition to Crump and Herzfeld, attorneys on the case are Chris Hansen of the ACLU First Amendment Working Group and Christine Sun of the ACLU LGBT Project.

The plaintiffs are Nashville students Keila Franks and Emily Logan, Knoxville student Bryanna Shelton, and Karyn Storts-Brinks, a Knoxville high school librarian and faculty sponsor for her school’s GSA.

Second Topless Pic Of Miss Cali Released, Runner Up Ready To Take Crown

A second topless photo of Miss California Carrie Prejean has been released by TheDirty.com, days after Prejean promised the state pageant that there was only one such photo in existence.

Back to the crown drama. On Wednesday Prejean’s runner-up Miss Malibu told “Access Hollywood’s” Billy Bush she is ready to step in should Prejean lose her crown because of a morality clause in the pageant contract contestants sign that promises they have no nude or semi-nude photos in their past.

The second photo is similar to the first, with Prejean’s bare back to the camera, only she’s no longer smiling.

The release of the second photo comes out days after Prejean, in an email to the Miss California pageant obtained by TMZ, promised there was only one such photo in existence. “I shouldnt (sic) have taken the photo of me in my underwear. There are no other photos of me. This was the only one I took.”

TMZ, however, claims it has seen four such photos, as over the weekend they were offered to the site in a sale.

Meanwhile on Wednesday Miss Malibu Tami Farrell told “Access Hollywood” she is ready, willing and able to take over. “I would be honored to represent the state of California if they need me for my responsibilities as first runner-up. I wouldn’t mind stepping into the spotlight.”

How low will the GOP Go? They Accuse Dems Of Using Hate Crime Bill To Protect Pedophiles (VIDEO)

The new, new thing in criticizing Hate Crimes legislation is to pretend that the Democrats have gone and given a whole bunch of special considerations or legal protections to pedophiles. That’s the case that Representative Peter Steve King made to a suppliant Sean Hannity yesterday:

HANNITY: We’re running out of time. Is it safe to say that Democrats were willing to protect pedophiles but not offer the same protection to servicemen and women? Is that an accurate statement?

KING: Sean, it is a matter of congressional record. Absolutely true — beyond any doubt whatsoever. The recorded votes are there to prove just what you’ve said. They — and on top of that, [Rep.] Alcee Hastings [D] from Florida, that spoke on the rules debate, and he read a list of about 30 different paraphilias — proclivities, I call them — including pedophiles, necrophilia, and a number of things that I wouldn’t say on this program or any other. And he said I think all philias whatsoever should be protected by this law. That means every perversion that you can imagine would be special protected status under the Democrats’ bill that passed off the — floor of the House of Representatives.

OK, in the first place, Representative King needs to get his head examined, brusquely, by some sort of pneumatic hammer. Ryan Grim made note of Alcee Hastings’ little bit of Congressional theater, which was done to demonstrate that “every perversion that you can imagine” WOULD NOT BE PROTECTED BY THE HATE CRIMES ACT.

OMG: Miss California Topless Shots Hit The Web, Could Cost Her The Crown

Miss California Carrie Prejean topless pictures are making their way to the web, and could cost her the state crown.

In a photo posted on Thedirty.com, seen in part to the left, a tan brunette in pink underwear with her arms across her chest and her back to the camera, is seen smiling over her shoulder at the camera. But with the photo, Prejean may be in violation of her contract.

According to the AP:

Pageant spokesman Roger Neal said Tuesday it appears the 21-year-old Prejean has run afoul of several sections of the 12-page contract that prospective contestants were required to sign before competing in the state contest.

The contract contains a clause asking participants whether they have conducted themselves “in accordance with the highest ethical and moral standards” and if they’ve ever been photographed nude or partially nude.

Prejean has released a statement about the photo seen below, an implicit confirmation that this photo, and others reportedly being shopped around, are indeed of her. Her hair is brown and the photos are from before her pageant-funded breast implants.

Carrie Prejean reacts to racy photos on Web

A photo of Prejean wearing only pink panties with her back turned to the camera appeared Monday on the gossip blog theDirty.com. Miss California says a Web site has posted racy photos of her in an attempt to belittle her Christianity.

Carrie Prejean says photos taken of her as a teenager had been released “surreptitiously to a tabloid Web site that openly mocks me for my Christian faith.”

Trial Begins For Men Accused Of Killing Gay Man In Florida

On dirt road that leads to Wahneta, Florida a driver made the ghastly discovery of a bloody body stabbed to death sitting on the side of the road. The date was Wednesday, March 14, 2007 at about 1:20AM.

That dead man was Ryan Keith Skipper, 25, a gay man. The trials of his accused murders – William David Brown Jr., 22, and Joseph Bearden, 23 – begin today, after several delays, as lawyers begin selecting a jury in a Polk County courtroom, reports The Ledger.

The pair were arrested soon after Skipper’s body was found and have remained in custody over the past two years.

Details of what happened between the three men remain sketchy. Family and friends hope the trial will shed light on Skipper’s final hours.
