Schwarzenegger says Proposition 8 may violate U.S. Constitution

Gov. Arnold Schwarzenegger has declined to defend the constitutionality of Proposition 8, telling a San Francisco judge that the legality of the anti-gaymarriage measure is for the courts to decide.

The governor’s decision to remain neutral in a federal challenge to Proposition 8 means no statewide official will be defending the measure in federal court.

Proposition 8 resurrected a ban on same-sex marriage, receiving 52% of the vote in the November election. The California Supreme Court ruled 6-1 last month that the measure did not violate the state constitution.

CA AG Brown again says Prop. 8 should be struck down

California Atty. Gen. Jerry Brown once again refused to defend Proposition 8′s ban on same-sex marriage Friday, telling a federal judge that it violated the U.S. Constitution and should be struck down.

Brown made his arguments in response to a federal lawsuit against the state by two gay couples who contend the initiative violates federal due process and equal protection guarantees.

Over Brown’s opposition, the California Supreme Court upheld the proposition last month on state, not federal, constitutional grounds, a few days after the federal suit was filed in San Francisco.

Brown’s willingness to fight a state law that has been upheld by the state’s highest court contrasted sharply with President Obama’s decision this week to oppose a federal challenge to the U.S. Defense of Marriage Act brought in Orange County.

In that case, a married gay couple, Arthur Smelt and Christopher Hammer, has challenged the constitutionality of both Proposition 8 and the 1996 federal law that prohibits extension of federal benefits to same-sex couples.

WATCH: Maddow Calls Out Obama On “Don’t Ask Don’t Tell”

Reacting to yesterday’s decision by the Supreme Court to not hear a case challenging the constitutionality of the military’s longstanding “don’t ask don’t tell” policy, Rachel Maddow featured a segment that broadly called the Obama administration’s oft-stated commitments to ending the practice into question.
Maddow points out that the case itself doesn’t hurt the cause of ending DADT. Advocates for a change in policy were of the mind that the Supreme Court challenge would not be a game-changer. Nevertheless, Maddow opined that the case was “a big deal” because for all of President Barack Obama’s past advocacy in support of ending DADT, he now has a lawyer of his very own arguing that the policy is “rationally related to the government’s legitimate interest in military discipline and cohesion.”
Which is, of course, ridiculous. All “don’t ask don’t tell” is, is a policy by which everyone pretends that the gay and lesbian soldiers that are already serving in the military aren’t really there, and that everything is okay provided that those gay and lesbian soldiers agree to participate in the Grand Shenanigan of Pollyanna Pretense. So, no, Mr, President. No, Mr. President’s lawyer. No. No. And, no. It simply cannot be said that “don’t ask don’t tell” is rationally related to a single blessed thing.

Self-proclaimed ‘Christian’ group asks to fight suit on gay marriage

A self-anointed ‘Christian’ group that raised – and spent – pent more than $37 million in leading the campaign to pass Proposition 8 is now seeking to formally fight a federal lawsuit aimed at overturning California’s gay marriage ban.

The Alliance Defense Fund filed court papers Thursday asking U.S. District Judge Vaughn Walker to allow it to defend the constitutionality of Proposition 8.

The morning of the decision, we invite the Bay Area community to come for encouraging music and words from community leaders, testimonies from married couples and blessings for those who will be doing civil disobedience. We will march in a procession from the church to Civic Center Plaza. Some people will join the march from the LGBT Center on Market and Octavia.

NOTE: We request clergy to come in their religious garb as appropriate for their tradition. Please come at 8:00am to prepare.

If Proposition 8 is upheld, we will surround those who are willing to be arrested in civic disobedience as we sing, and move aside as they are arrested.

Marriage is not just a nice idea for some. To deny it is a form of bashing. On Decision Day, a group of people will participate in civil disobedience if the Supreme Court upholds Prop 8. In partnership with an interfaith group of clergy, we’ll do a peaceful street blockade with the message SEPARATE IS NOT EQUAL!
