Schwarzenegger says Proposition 8 may violate U.S. Constitution
The governor’s decision to remain neutral in a federal challenge to Proposition 8 means no statewide official will be defending the measure in federal court.
Proposition 8 resurrected a ban on same-sex marriage, receiving 52% of the vote in the November election. The California Supreme Court ruled 6-1 last month that the measure did not violate the state constitution.

CA AG Brown again says Prop. 8 should be struck down
California Atty. Gen. Jerry Brown once again refused to defend Proposition 8’s ban on same-sex marriage Friday, telling a federal judge that it violated the U.S. Constitution and should be struck down.
Brown made his arguments in response to a federal lawsuit against the state by two gay couples who contend the initiative violates federal due process and equal protection guarantees.
Brown’s willingness to fight a state law that has been upheld by the state’s highest court contrasted sharply with President Obama’s decision this week to oppose a federal challenge to the U.S. Defense of Marriage Act brought in Orange County.
In that case, a married gay couple, Arthur Smelt and Christopher Hammer, has challenged the constitutionality of both Proposition 8 and the 1996 federal law that prohibits extension of federal benefits to same-sex couples.

WATCH: Maddow Calls Out Obama On “Don’t Ask Don’t Tell”
Reacting to yesterday’s decision by the Supreme Court to not hear a case challenging the constitutionality of the military’s longstanding “don’t ask don’t tell” policy, Rachel Maddow featured a segment that broadly called the Obama administration’s oft-stated commitments to ending the practice into question.
Maddow points out that the case itself doesn’t hurt the cause of ending DADT. Advocates for a change in policy were of the mind that the Supreme Court challenge would not be a game-changer. Nevertheless, Maddow opined that the case was “a big deal” because for all of President Barack Obama’s past advocacy in support of ending DADT, he now has a lawyer of his very own arguing that the policy is “rationally related to the government’s legitimate interest in military discipline and cohesion.”
Which is, of course, ridiculous. All “don’t ask don’t tell” is, is a policy by which everyone pretends that the gay and lesbian soldiers that are already serving in the military aren’t really there, and that everything is okay provided that those gay and lesbian soldiers agree to participate in the Grand Shenanigan of Pollyanna Pretense. So, no, Mr, President. No, Mr. President’s lawyer. No. No. And, no. It simply cannot be said that “don’t ask don’t tell” is rationally related to a single blessed thing.

Self-proclaimed ‘Christian’ group asks to fight suit on gay marriage
A self-anointed ‘Christian’ group that raised - and spent - pent more than $37 million in leading the campaign to pass Proposition 8 is now seeking to formally fight a federal lawsuit aimed at overturning California’s gay marriage ban.
The Alliance Defense Fund filed court papers Thursday asking U.S. District Judge Vaughn Walker to allow it to defend the constitutionality of Proposition 8. Did you ever wonder how mnuch money they raised for ‘fighting gay marriage’ went to pay their own saleries?

Marriage is not just a nice idea for some. To deny it is a form of bashing. On Decision Day, a group of people will participate in civil disobedience if the Supreme Court upholds Prop 8. In partnership with an interfaith group of clergy, we’ll do a peaceful street blockade with the message SEPARATE IS NOT EQUAL!

The Obama administration, criticized by gay rights advocates for not following through on a campaign promise to repeal the “don’t ask, don’t tell” policy on military service, has taken a quiet step to allow a federal court in San Francisco to limit enforcement of the policy.
Without fanfare, the Justice Department told congressional leaders last month that it would not seek Supreme Court review of a May 2008 ruling by the Ninth U.S. Circuit Court of Appeals. The ruling cast doubt on the constitutionality of discharging gay and lesbian soldiers from the military for revealing their sexual orientation and required military officials to justify each dismissal.

Minnesota Poll: A subtle shift on gay unions
With the state Supreme Court in neighboring Iowa rewriting that state’s definition of marriage to include same-sex couples, Minnesotans are divided on the subject in this state, a Star Tribune Minnesota Poll finds:
• One-third say the state needs a constitutional amendment to prohibit same-sex marriage;
• Just over one-third say that there should be no change in current state law, which bans such unions, and that it should be left to the Minnesota Supreme Court to rule on the law’s constitutionality;
• One-fourth believe same-sex marriage should be legalized.
The survey of 1,042 adults was conducted April 20-23, and has a margin of sampling error of 4 percentage points, plus or minus.

Anti-gay group allowed to enter Arkansas adoption case
(Little Rock, Arkansas) A judge has ruled that that a lawsuit challenging an Arkansas law banning unmarried couples from becoming foster or adoptive parents can proceed - and that the conservative group behind the measure can present arguments in the case.
County Circuit Judge Chris Piazza dismissed a motion by Arkansas Attorney General Dustin McDaniel to dismiss the suit. Piazza then accepted an application by the Arkansas Family Council to enter the case.
The council was behind the successful ballot measure past last November that bans unmarried couples from adopting or fostering. The American Civil Liberties Union of Arkansas filed suit, challenging the constitutionality of the law on behalf of a dozen families, some straight, some gay.

Sacramento gay man who led straight life now urges others to confront their sexuality
For much of Jacques Whitfield’s 11-year marriage he maintained a parallel life. He cheated on his wife and, he said, cheated himself.
But that’s over. Whitfield, a veteran Sacramento attorney, quit years of therapy that he once thought would exorcize his homosexuality. Today he is openly gay and has lent his voice in opposition to California’s ban on gay marriage.
While the state Supreme Court weighs the constitutionality of Proposition 8, Whitfield said he believes the court decision alone won’t change public opinion. So he wants to help change some minds.
Exit polls showed a majority of African Americans and Latinos supported the same-sex marriage ban.
Whitfield, who is African American, acknowledged that churches, and long-held notions of right and wrong, held sway. That’s why he believes it’s important for some in his community to stop hiding.
“People like me should have been empowered to have the courageous conversation with people that look like me,” said Whitfield, who recently became board chairman of the Sacramento Gay and Lesbian Center.
