Future pope refused defrocking of convicted priest
The future Pope Benedict XVI refused to defrock an American priest who confessed to molesting numerous children and even served prison time for it, simply because the cleric wouldn’t agree to the discipline. The case provides the latest evidence of how changes in church law under Pope John Paul II frustrated and hamstrung U.S. bishops struggling with an abuse crisis that would eventually explode.
Documents obtained by The Associated Press from court filings in the case of the late Rev. Alvin Campbell of Illinois show Cardinal Joseph Ratzinger, following church law at the time, turned down a bishop’s plea to remove the priest for no other reason than the abuser’s refusal to go along with it.
“The petition in question cannot be admitted in as much as it lacks the request of Father Campbell himself,” Ratzinger wrote in a July 3, 1989, letter to Bishop Daniel Ryan of the Diocese of Springfield, Ill.
With the church still recovering from a notable departure of priests in the 1970s to marry, John Paul made it tougher to leave the priesthood after assuming the papacy in 1978, saying their vocation was a lifelong one. A consequence of that policy was that, as the priest sex abuse scandal arose in the U.S., bishops were no longer able to sidestep the lengthy church trial necessary for laicization.
New rules in 1980 removed bishops’ option of requesting laicizations of abusive priests without holding a church trial. Those rules were ultimately eased two decades later amid an explosion of abuse cases in the United States.
Campbell’s bishop had requested that he be quickly defrocked, in part to spare the victims the pain of a trial, but Ratzinger’s response was in keeping with church law at the time. Bishops retained the right to remove priests from ministry or to go through with a trial and recommend to Rome a cleric’s defrocking, and nothing prevented them from reporting such crimes to police as they should have done, the Vatican has argued.
“Nothing in the new code prevented a bishop from exercising his discretion to restrict ministry or to assign a priest to a job where he was out of contact with the public,” said Jeffrey Lena, the Vatican’s attorney in the U.S.
Campbell’s is one of several decades-old cases to emerge in recent months raising questions about Ratzinger’s decisions and the church law he was following involving abusive priests as head of the Catholic Church’s doctrinal watchdog office, a position he took in 1981. The round of scandals worldwide left the Vatican initially blaming the media and groups supporting abortion rights and gay marriage, but recently Benedict has denounced the “sin” that has infected the church.
John Paul’s views on laicizations were made known in a 1979 letter to priests, in which he wrote that their ordination was “forever imprinted on our souls” and that “the priesthood cannot be renounced.” Ryan, in his letter to Ratzinger, quoted Campbell saying essentially the same thing: “Once a priest, always a priest.”
“The whole idea was that the priesthood was so sacred you couldn’t kick these guys out,” said the Rev. Tom Doyle, a canon lawyer who reviewed the Campbell case and who has advocated for abuse victims. “It wasn’t that it wasn’t possible – it was possible – but the practice had been not to accept the petition unless the priest accepted.”
Campbell’s misdeeds date back at least 15 years before his defrocking.
As an Army chaplain, he was reprimanded and ultimately left the service after abusing at least one boy, according to military and church correspondence. An Army letter in his file said he had exploited his rank and position as a chaplain “by engaging in indecent homosexual acts” with a child under 16 who had been under his supervision.
Even so, Bishop Joseph McNicholas, then at the helm of the Springfield diocese, wrote to him, “Be assured that we will welcome you with open arms here at home.” While church officials overseeing clergy in the military were alerted of Campbell’s actions, and reference is made to the molestations in Ryan’s letter to Ratzinger, it’s not clear whether McNicholas knew.
Campbell became a pastor upon his return to the diocese. In at least three instances after returning to diocesan work, he was forced to depart jobs as parish pastor or administrator “for reasons of health,” a euphemism for sexual abuse used within the church that Ryan himself put in quotes.
After workers at a rape crisis center alerted authorities that they were treating one of Campbell’s victims, police found he had been plying boys with video games, bicycles, watches and other gifts to get them to the waterbed in his second-floor rectory bedroom. Ryan sent Campbell to a New Mexico treatment facility after the arrest.
Campbell was sentenced to 14 years in prison in 1985, after admitting to molesting seven boys during his time as pastor of St. Maurice Parish in Morrisonville, Ill. He was released in 1992 after serving about seven years for sexual assault and sexual abuse.
Ryan apparently waited four years after Campbell went to prison, according to church files, before asking for the priest’s defrocking. It’s unclear what accounted for the delay.
In his 1989 letter to Ratzinger, Ryan outlined Campbell’s many offenses against children and asked for his laicization. He pointed out the local notoriety of the priest’s case and said his crimes and those of another abusive priest had already cost the diocese $1.5 million in damages and legal fees.
“I fear the infliction of further pain upon the victims of his criminal activity and their families,” Ryan wrote. “I fear that the diocese will suffer further pastorally and in public relations, to say nothing of greater financial damage.”
Ratzinger refused, citing Vatican policy, and told the bishop to proceed with a church tribunal.
It is unclear whether a church trial was ever held for Campbell. After his release from prison, he was cajoled by Ryan and his subordinates into accepting his defrocking. Three years after Ryan’s initial letter to Ratzinger, the bishop’s request to Rome was granted.
For bishops attempting to remove a child molester without a church trial or the priest’s cooperation in the 1980s, requests were rebuffed and sent back to diocesan tribunals where the cases could stagnate for years. While a full-fledged canonical trial could make sense given such a serious crime, bishops found them virtually inapplicable, in part because the statute of limitations very often had expired well before allegations had even been reported. Bishops’ hands, in some cases, were tied.
“In that case, it was tied by the universal law of the church,” said Monsignor Kenneth Lasch, a retired priest and canon lawyer who has advocated for abuse victims. “Rome would take the position at that time that unless he was convicted canonically, they wouldn’t laicize.”
Lena defended the church’s handling of cases, but said it has been improved with revisions.
“Is our criminal justice system broken because procedures are complex, or because they are designed to ensure that an innocent person is not wrongly convicted? Any mature criminal justice system – including the canonical system – has two duties: to punish the guilty and, of no less importance, to protect the innocent from mistaken prosecution. Sometimes, in a rush to judgment, people forget about the latter,” Lena said.
“And of course, legal systems can always be improved. I think the consensus is that the implementation of SST and the procedures developed in its wake improved the canonical system,” he said.
SST is short for “Sacramentorum Sanctitatis Tutela,” John Paul’s 2001 letter that, among other things, mandated all abuse cases would be overseen by the Congregation for the Doctrine of the Faith, Ratzinger’s office.
Kathie Sass, a spokeswoman for the Diocese of Springfield, said no one familiar with the intricacies of the Campbell case was still working in the tribunal and able to talk.
Sass said Ryan, who lives in a nursing home outside the diocese, was unable to respond to questions. He retired in 1999 under a cloud of accusations of sexual relationships with male prostitutes and at least one priest; his successor found that he had engaged in “improper sexual conduct,” allegations Ryan denied.
David Clohessy, director of the Survivors Network of those Abused by Priests, said that in Campbell’s case “and hundreds like it, Ratzinger chose to put concerns about dangerous pedophiles and the church’s reputation above concerns about children’s safety.”
Others believe the ultimate blame lay with John Paul, whose policies the cardinal was interpreting.
“Ratzinger was just obeying his boss,” said Doyle.
John Paul “certainly, I would say, is more culpable than Benedict,” said Lasch.
The Vatican previously accepted involuntary laicizations, but turbulence of the 1970s, in which the Catholic Church suffered a huge worldwide loss of priests, helped push John Paul to revise the policy and promulgate the 1983 Code of Canon Law, which emphasized more due process rights for priests and discouraged penal sanctions.
“It didn’t have any provisions in it for involuntary laicizations,” said Msgr. John Alesandro, a canon lawyer and professor at Catholic University. “But I think most canonists believed that whether it was in the Code of Canon Law or not, the pope could do it.”
John Paul did not, and as the abuse crisis exploded in the Catholic Church in the United States, bishops grew frustrated.
Alesandro sat on a Vatican-commissioned panel examining the policy, which ultimately was revised under “Sacramentorum Sanctitatis Tutela.” In 2003, new revisions gave bishops the right to ask the Vatican to laicize a priest through a speedier administrative procedure, or for the CDF itself to forward a defrocking case directly to the pope if the evidence is overwhelming.

‘Two-Track’ Church Suggested by Archbishop of Canterbury
PARIS — The Most Rev. Rowan Williams, the archbishop of Canterbury, said profound differences among the world’s 77 million Anglicans over gay clergy and same-sex unions could divide their church into a “two-track model” yielding “two styles of being Anglican.”
The formula could avert a formal breach between liberals and conservatives but bring new strains in the relationship between the global Anglican Communion and American Episcopalians who resolved this month to open the door to ordaining openly gay bishops and to start the process of developing rites for same-sex marriages.
Archbishop Williams insisted that the issue should not be debated “in apocalyptic terms of schism and excommunication but plainly as what they are — two styles of being Anglican.”
In a lengthy message published Monday on his Web site, the archbishop offered a detailed and nuanced response to events at the Episcopal convention in Anaheim, Calif., this month when gay-rights advocates in the United States chalked up major victories over conservatives on sexual issues. The Episcopal Church is the official branch of the Anglican Communion in the United States.
The developments were seen by liberals and conservatives as likely turning points in the history of the divided Episcopal Church, reflecting the profound rifts over sexual issues within Anglicanism — the world’s third largest network of Christian churches after the Roman Catholic and Orthodox Churches. The differences have crystallized around the Episcopal Church’s consent in 2003 to the consecration of the church’s first openly gay bishop, V. Gene Robinson of New Hampshire.
The Episcopalians had agreed to a moratorium on the election of gay bishops, but it was lifted at the convention in Anaheim.
The archbishop of Canterbury is the spiritual head of the Anglican Communion, which is composed of 38 provinces worldwide. The Episcopal Church claims about 2.3 million members.
In his message, Archbishop Williams repeated his view that “a blessing for a same-sex union cannot have the authority” of the full Anglican Communion, any more than a blessing for a heterosexual couple living outside marriage would have.
That, in turn, means that as long as the broader church “as a whole does not bless same-sex unions, a person living in such a union cannot without serious incongruity have a representative function in a Church whose public teaching is at odds with their lifestyle.”
The issues have confronted the archbishop with deep divisions not simply between liberals and conservatives in the United States but also across the broader church with its many followers in Africa, Britain and elsewhere. Four conservative dioceses in the United States and many individual Episcopal churches have broken away from the national denomination to forge alliances with conservative Anglican groups such as the Anglican Church of Nigeria.
Archbishop Williams said: “There is at least the possibility of a twofold ecclesial reality in view in the middle distance: that is, a ‘covenanted’ Anglican global body, fully sharing certain aspects of a vision of how the Church should be and behave, able to take part as a body in ecumenical and interfaith dialogue; and, related to this body, but in less formal ways with fewer formal expectations, there may be associated local churches in various kinds of mutual partnership and solidarity with one another and with ‘covenanted’ provinces.”
The archbishop has promoted the idea of covenant — described by some analysts as a kind of good-behavior guide for churches — to overcome the rift.
“This has been called a ‘two-tier’ model, or, more disparagingly, a first- and second-class structure,” the archbishop’s message said. “But perhaps we are faced with the possibility rather of a ‘two-track’ model, two ways of witnessing to the Anglican heritage, one of which had decided that local autonomy had to be the prevailing value and so had in good faith declined a covenantal structure.”
The message continued: “It helps to be clear about these possible futures, however much we think them less than ideal, and to speak about them not in apocalyptic terms of schism and excommunication but plainly as what they are — two styles of being Anglican, whose mutual relation will certainly need working out but which would not exclude cooperation in mission and service of the kind now shared in the Communion.”

Diocese of Niagara to offer same-sex blessings
As of Sept. 1, the diocese of Niagara will allow its priests to bless same-gender couples who have been civilly married.
Niagara becomes the second diocese in the Anglican Church of Canada, after the Vancouver-based New Westminster, to offer a sacrament for same-sex blessings. (The diocese of New Westminster, which allowed same-sex blessings in 2002, currently limits the rite to eight parishes.) The issue of same-sex blessings continues to deeply divide Anglicans in Canada as well as worldwide.
“The Niagara Rite is intended for the voluntary use of priests who wish to offer a sacrament of blessing regardless of the gender of the civilly married persons…” the diocese of Niagara said on its Web site, www.niagara.anglican.ca
The rite may also be used for the blessing or renewal of vows for couples “celebrating a significant moment in their married life together,” said an introduction to the Niagara Rite.
The approval of the rite came five years after the diocesan synod of Niagara passed a motion allowing civilly-married gay couples, “where at least one party is baptized,” to receive a church blessing. The diocesan bishop at that time, Ralph Spence, had refused to implement the motion. In January 2008, a similar motion was approved by Niagara’s diocesan synod, and this time, Bishop Spence gave his approval, but said he reserved the right to determine when the same-sex blessings would move forward.
Last fall, Bishop Spence’s successor, Michael Bird, informed a meeting of the Canadian house of bishops that he intended to develop the rite, saying, “I believe we are among those who have been called by God to speak with a prophetic voice on this subject.”
Under a list of protocols outlined by Bishop Bird, a cleric who wishes to offer the Niagara Rite must contact the bishop’s office “so that a conversation can take place between the bishop and the cleric involved.” The cleric is expected to provide details about the couple the cleric intends to bless “and should be prepared to have a conversation about the response of the parish to the blessings,” the list added. “A date for such a blessing should not be confirmed with the couple until after this conversation with the bishop has taken place.”
A parish is not required to get the approval of its vestry before it can offer such blessings.
Two other dioceses – Montreal and Ottawa – have also informed the house of bishops about their intention to move ahead with same-sex blessings. At that meeting, the house of bishops issued a statement saying that a “large majority” of its members could affirm “a continued commitment to the greatest extent possible” to a moratorium on the blessing of same-sex unions. But it acknowledged that the moratorium, which had been sought by the Archbishop of Canterbury and the primates of the Anglican Communion, would be difficult for some dioceses “that in confidence have made decisions on these matters.”
The issue of whether dioceses can offer same-sex blessings is likely to be revisited at the 2010 meeting of General Synod, the governing body of the Anglican Church of Canada. In 2007, General Synod had agreed that blessing rites for gay couples are “not in conflict” with core church doctrine, but refused to affirm the authority of dioceses to offer them. General Synod delegates had also voted to study revising the marriage canon (church law) to allow priests to marry all legally qualified persons. Marriage for gay people has been legal in Canada since 2005.
Last spring, Council of General Synod (CoGS), the church’s governing body in between General Synod meetings, decided not to ask General Synod 2010 to amend the marriage canon to allow for the marriage of same-sex couples. The decision was made after the faith, worship and ministry committee, which was asked by CoGS to prepare “a theological rationale to allow for the marriage of all legally qualified persons,” said that it found the request problematic. Janet Marshall, committee chair, told CoGS that some members felt uncomfortable about being asked to create a rationale for only one side of the argument.

In UK RC Church rejects gay parents claims
The Roman Catholic Church has reacted angrily to comments endorsing gay parenthood from a charity with strong links to the Church.
Terry Prendergast of Marriage Care, which is partly funded by the Church, said there was no evidence children were harmed by having same-sex parents.
But the organisation representing Catholic bishops said children need parental role models of both genders.
It said Mr Prendergast, a former priest who has since married, was wrong.
Mr Prendergast made his comments to a gathering of gay Roman Catholics in Leicester.
He told the audience at the Quest conference that same-sex families, along with single and cohabiting parents, suffered discrimination and denigration because they fell short of the Vatican’s definition of what constituted a real family.

Instead, he said, they should be held up as role models and an advert for Catholicism.
Mr Prendergast also claimed that there was no evidence to show that children of same-sex parents suffered in any way, and that the elements that made for successful child-rearing were stable relationships.
But the Catholic Bishops Conference of England and Wales has insisted that Mr Prendergast is wrong.
Pastoral response
In a statement, the organisation acknowledged that although it was difficult to define what a family was, the Church still believed that stability for children came from having parents of opposite genders who could provide different role models.

Church ponders next step on gay vows
Episcopal bishops in New England and Iowa, the only parts of the nation where same-sex marriage is legal, are preparing for a wave of requests to allow priests to oversee the ceremonies as the result of a decision last week by the Episcopal Church that opens the door to church weddings for gay couples.
In interviews yesterday, none of several bishops interviewed said they were immediately prepared to allow priests to officiate at same-sex weddings, which remain prohibited by the canons of the Episcopal Church.
But, citing the denomination’s decision Friday to allow bishops in states where same-sex marriage is legal to “provide generous pastoral response’’ to same-sex couples, the bishops indicated that they are looking for ways to allow priests to at least celebrate, if not perform, gay nuptials in church.
“The problem is the prayer book says that marriage must conform to the laws of the state and the canons of the church, but if we respond to the laws of the state, we are in violation of the canons of the church,’’ said Bishop Stephen T. Lane of Maine, where the situation is further complicated by a possible referendum to overturn same-sex marriage. “We’re trying to respond pastorally, but not to get so far beyond the bounds of what the church understands that our clergy are just sort of hanging out there.’’
Lane also said bishops of New England, where same-sex marriage has been approved in every state but Rhode Island, are hoping to reach a common plan, because “we don’t want people running back and forth between the New England states.’’
“The folks who would like to be married are members of our congregations and will have a legal right to marriage should the law be upheld,’’ Lane said. “Clergy are caught trying to be faithful both to the canons of the church and the laws of the state, and some flexibility will help us make good pastoral judgments while the church wrestles with the definition of marriage and the rites in the Book of Common Prayer.’’
The Episcopal Church is one of several mainline Protestant denominations grappling with how to respond to increasing societal acceptance of same-sex couples. But the issue is particularly thorny for Episcopalians because the denomination and the global Anglican Communion to which it belongs have been riven by controversy over the 2003 election of an openly gay priest, the Rev. V. Gene Robinson, as bishop of New Hampshire.
In an interview yesterday, Robinson said he expects to get married to his longtime partner once same-sex marriage becomes legal in New Hampshire, in January. Robinson said Episcopal priests in New Hampshire have been long been allowed to bless same-sex couples, including those in civil unions, and that he expects to continue to ask priests to bless, but not legally officiate at, same-sex weddings.
“My feeling is that it’s time to separate the civil action from the religious action for all couples, and my guess is that we will continue that practice, which is to say we will ask clergy to get out of the civil marriage business and continue to offer the church’s blessings of civil unions and of same-gender marriages,’’ said Robinson. As a practical matter, that means marriages are solemnized by justices of the peace, who sign the legal documents, and then blessed by clergy.
In Eastern Massachusetts, Bishop M. Thomas Shaw has been one of the most vocal supporters of same-sex marriage, but also one of the most determined to differentiate between civil and religious marriage.

Philip Hensher: Forget about a ‘cure’ for homosexuality
It grows increasingly hard to tell the difference between bishops of the Church of England and Paris Hilton. Bishops used to be thoughtful, retiring people, happy to spread the word of God through bring-and-buy sales, the Mothers’ Union and the occasional sermon. Nowadays, some of them have been bitten by the bug of publicity, and they just can’t seem to shut up.
One bishop in particular has been an absolute gift to the media on slow days for news. With no story whatsoever in sight, the office intern is instructed to call up Dr Michael Nazir-Ali, the Bishop of Rochester, and ask him for his opinions on – well, it hardly matters. He will strike a moral pose, and many of us will wonder where on earth he gets it from. He is, frankly, a perfect scream.
In 2000 he said that having children in a marriage was not an “optional extra” and there was “a real lack” if people decided not to have children. Last year, he said Islamic extremism was turning parts of our cities into “no-go areas”, and complained about the amplified call to prayer. He has also denounced multiculturalism as “newfangled and insecurely founded” and in 2007 announced he wouldn’t be going to the Lambeth Conference, in protest at a gay bishop in America.
In a few months he is retiring, 10 years early, to set up a confederation of fundamentalist churches. In the meantime, he has been going round shedding a few more flaky ponderings like psoriasis. The latest, revealed in a newspaper interview, is on the subject of homosexuality, and it amazes me that Dr Nazir-Ali has taken so long to get round to his African colleagues’ favourite subject. Dr Nazir-Ali said: “The Bible’s teaching shows that marriage is between a man and a woman. That is the way to express our sexual nature. We welcome homosexuals, we don’t want to exclude people, but we want them to repent and be changed.”

Terry Prendergast, the chief executive of Marriage Care, claimed there is “no evidence” that children do better if they are brought up in a traditional two-parent family.
He claimed that those who live together out of wedlock are trying to lead good lives but find themselves “consigned to the dustbin” by the church.
His comments – to be made this weekend to Quest, a group of homosexual Catholics – go directly against the church’s teaching, which holds that homosexuality is sinful and that families should be based on the marriage of a man and a woman.
Mr Prendergast said: “We see, for example, that statistically children do best in a family where the adult relationship is steady, stable and loving – you should note here perhaps that I stress adult, not married, since there is no evidence that suggests that children do best with heterosexual couples.”
He claimed that God was present in the relationships of married, homosexual and cohabiting heterosexual relationships where there was “commitment, consent and covenant”.
He went on: “They want to live good lives according to the precepts of the Gospels. They are an advert for the Church, an advert that the Church often ignores or consigns to the wastebin.”
