Gay Dems complain DNC cut off funding, drop support for Biden event
Theboard of directors of the National Stonewall Democrats are dropping their support for a June 25 DNC fundraiser with Vice President Joe Biden over, they wrote in an email obtained by POLITICO, a combination of policy slights and the claim that they’ve been cut off from traditional party funding.
In the email to Tom Petrillo, who runs the party’s substantial gay fundraising operation, the board members write:
[W]e are incredibly disappointed that the DNC has made a decision to withhold any financial support to National Stonewall Democrats this year but is in turn asking us to help raise money for the DNC in a difficult financial environment. The DNC has historically supported National Stonewall through sponsorship of the annual Capitol Champions event. This year, we did not receive any support. The DNC has traditionally provided materials for the many Pride parades and festivals around the country to help educate the LGBT community about why the Democratic Party is the Party for full LGBT equality. This year we were informed that we would not be receiving any materials or support for producing materials for the various nationwide Pride activities. These decisions were very disappointing.
We’d be remiss to also not mention that the recent legal brief of the Obama Administration defending DOMA is incredibly hurtful. The members of the Board and our membership put our hopes, our dollars and our time into ensuring the election of Barack Obama because we believed that he supported us. To now have his Administration refer to our relationships in the same terms used by our long time enemies such as Pat Robertson, Jerry Falwell and James Dobson hurts on so many levels. To have our committed and loving relationships referred to as the moral equivalent of incest and pedophilia is not something that any of us ever expected from this Administration considering how hard we worked to be seen and respected. For that reason alone, advocating for attendance at a fundraiser to support the Administration and the DNC, while they have not condemned this hurtful language, is not something our membership will receive positively.
The group says it’s not “boycotting” the June 25 fundraiser with Joe Biden; it just won’t encourage its members to attend.
Gay money is, historically, of outsized importance to the Democratic Party. Howard Dean, in particular, launched his presidential campaign in part on enthusiasm from gay donors about his support for civil unions, and maintained those relationships as chairman. Bid to Block Recognition of Unions Fails In DC
The District of Columbia Board of Elections and Ethics rejected a proposed ballot question intended to block city recognition of same-sex marriages from other locations. Last month, the City Council voted 12 to 1 to recognize same-sex marriages from other jurisdictions, a decision widely seen as a prelude to an inevitable vote on legalizing same-sex marriages in the capital. Schwarzenegger, AG Brown oppose bid to immediately block Prop 8
Gov. Arnold Schwarzenegger and Attorney General Jerry Brown on Thursday urged a federal judge to keep Proposition 8 in force for now, arguing that it would create too much uncertainty across the state to put the voter-approved ban on gay marriage on hold while the latest legal challenge unfolds in the federal courts.
In court papers, state lawyers argued against an injunction that would freeze the current gay marriage ban, opposing a request filed in federal court in San Francisco last month by two gay couples seeking the right to marry. Backed by former U.S. Solicitor General Theodore Olson and renowned lawyer David Boies, the couples moved to counterract the California Supreme Court’s recent ruling upholding Proposition 8, arguing that it violates equal protection rights under the federal constitution.
Brown and Schwarzenegger argued separately that it would create too much havoc to put the law on hold until the constitutional issues are resolved, perhaps eventually by the U.S. Supreme Court. The governor and attorney general did not take a position on the federal constitutional questions, focusing only on whether Prop 8 should be blocked while the case is litigated, a move that would allow same-sex couples to resume marrying in California.
Brown had previously urged the California Supreme Court to overturn Prop 8, and Schwarzenegger has said publicly he believes the courts eventually will permit gay marriage.

Unanimous California Supreme Court Rejects Attempt to Limit Discrimination Claims by People with Disabilities
‘The Court’s decision furthers the Unruh Act’s purpose to eradicate arbitrary and invidious discrimination from California’s business establishments.’
(San Francisco, June 11, 2009) — Today the California Supreme Court unanimously ruled that California’s Unruh Civil Rights Act does not impose extra legal hurdles for people with disabilities, including people living with HIV who seek damages for discrimination.
Statement from Tara Borelli, Staff Attorney at Lambda Legal and a principal author of the friend-of-the court brief Lambda Legal submitted urging today’s legal result in Munson v. Del Taco:
“The Court rightly rejected efforts to misread the Unruh Civil Rights Act to impose extra legal hurdles which would have harmed all disabled Californians who face discrimination in public accommodations, including those living with HIV.
“Real, reliable change for people with disabilities has been painfully slow in coming but the high court’s decision today promises greater fairness in California. The Court’s decision furthers the Unruh Act’s purpose to eradicate arbitrary and invidious discrimination from California’s business establishments.
“Though this case does not directly involve people living with HIV, the application of this decision will be helpful to all people living with disabilities who encounter discrimination, which includes many Californians living with HIV.”
Background on Munson v. Del Taco:
Kenneth Munson, a wheelchair user, filed suit against Del Taco, Inc. alleging violations of the federal Americans with Disabilities Act and California’s Unruh Act. Munson’s suit is based on claims arising from visits he made to one Del Taco restaurant, where he encountered architectural barriers to his use of the parking lot and restroom.
Background on Unruh Civil Rights Act:
California’s Unruh Civil Rights Act requires that public accommodations — businesses such as restaurants, rental housing, and doctors’ offices — are open to everyone, without arbitrary discrimination based on disability (including HIV), sex (including gender identity), sexual orientation, marital status, race or several other personal characteristics. Similarly, the federal Americans with Disabilities Act (ADA) forbids denying disabled people equal access to public places. In 1992, California revised the Unruh Act to better protect disabled Californians from discrimination by saying that a plaintiff who proves an ADA violation has also proven a state law violation.

China’s first Gay Pride event
China’s first Gay Pride event, organised by Shanghai’s English-speaking expatriates, has been quietly celebrating homosexuality this week with no hint of a parade or advertising hype.
In a country where acceptance of homosexuality is still low, organisers — foreigners living in China — have been reluctant to draw official attention.
So “Shanghai Pride” does not include the colourful parade that typifies Gay Pride events in Europe and the US, but is centred around events held in private venues to avoid the need for government permission.
As a result, few Chinese appear to be taking part — or even to know about the events — and attendees have been mostly expatriate.
“Even though we have talked about (Shanghai Pride) for a long time, the news published in Chinese about this is only very recent,” said Xing Zhao, a gay man in his thirties.
Homosexuality has long been a taboo subject in China with gay sex decriminalised only in 1997, while homosexual behaviour was officially viewed as a mental disorder until 2001.
Those behind Shanghai Pride hope it will help change prevailing attitudes, no matter how incrementally.

Gay penguin dads in German zoo hatch their first chick
Z and Vielpunkt, two male Humboldt penguins at Germany’s Bremerhaven Zoo, are the proud new parents of a healthy penguin chick.
“Another couple threw the egg out of their batch. We picked it up and put it in the nest of the gay penguins,” veterinarian Joachim Schöne told the German newspaper Bild of the pair’s entry into parenthood. Z and Vielpunkt faithfully cared for their adopted egg for more than a month; in late April it hatched. Since then, they’ve been taking care of their chick around the clock; it’s still too young to feed itself, so the dads feed him fish mash, Schöne explained.
“Since the chick arrived, they have been behaving just as you would expect a heterosexual couple to do,” the zoo said in a statement.
The Bremerhaven Zoo’s same-sex penguin couples (there are three such pairs in residence there, all males) first made news back in 2005, according to the BBC. At the time, the zoo announced plans to “test” the sexual orientations of the six penguins, who’d been seen engaging in mating rituals and trying to incubate rocks as if they were eggs. Gay rights advocates were outraged when the zoo brought four new female penguins into the colony in a bid to encourage the penguins to reproduce, and the zoo later nixed the idea. (In the zoo’s defense, Humboldt penguins are classified as vulnerable to extinction, so it does make a certain amount of sense to be concerned about them reproducing. And since Z and Vielpunkt have done just that, everyone wins!)

Gay Pride in Moscow: Report from a Chicago Activist
MOSCOW, May 14, 2009 (Gay Liberation Network) – After 14 hours of flights, last night I found myself in Eastern Europe for the first time in my life, warmly greeted by lesbian and gay activists who, despite state repression, are organizing their fourth annual pride event in this city. This year’s event is dubbed ‘Slavic Pride’, denoting the significant participation of activists from around the region.
The previous three years’ events have gone forward despite bans from the authorities and violence from neo-fascists in Russian orthodox and skinhead garb. This year the authorities not only banned the Pride event, but for good measure, approved the anti-gays’ application to hold their own event this past Tuesday.
That same day, our Moscow friends countered with their own unsanctioned action at the Department of Registration of Acts of Civil Status – an attempt by two lesbian activists to get a marriage license.
Leading Slavic Pride activist Nikolai Alekseev said the action was inspired in part by a February civil disobedience action at a marriage license bureau in Chicago. The Moscow action received widespread international press coverage, including from the New York Times.
As I shadowed Alekseev around the city last night, press coverage if anything seemed to build, with Nikolai’s two cell phones ringing incessantly and meetings with Finish and Slovenian journalists held near midnight just outside of Red Square.
Slavic Pride is slated for this Saturday, amidst the big ‘Eurovision Fest’ being hosted this year by Moscow. For those not familiar with what Eurovision is, think American Idol times ten, with a profusion of media coverage and street banners that puts Chicago’s 2016 Olympics bid hype to shame.
While our specific plans for Saturday are necessarily secret at this time, the aim is to cause maximum embarrassment to the government if they attempt to arrest us or allow the neo-fascists to attack.
In response to Moscow activists’ application for a permit this year, police chief Vladmir Pronin told the Russian news agency Interfax that gay pride parades in the capital are “unacceptable – gay pride parades shouldn’t be allowed”.
“No one will dare to do it, such ‘braveheart’ will be torn to shreds,” he added. “The West can say we’re bad guys, but our people will see it is right. Our country is patriarchal, that’s [sic] sums it up… I positively agree with the Church, with the Patriarch, politicians, especially with [Mayor] Luzhkov, who are convinced that man and woman should love each other. It is established by God and nature.”
However, Moscow Pride organizers have vowed to move forward with this year’s Pride event despite the police chief’s threats.
“Mr. Pronin already showed his incompetency last year when his services were unable to prevent us unveiling a banner directed against the Mayor, right opposite his office,” said Alekseev.
The main pride event successfully took place nearby at the monument to the famous Russian gay composer, Peter Tchkaivosky, while the authorities and neo-fascists were hoodwinked in to thinking that it would take place outside of homophobic Mayor Yuri Luzhkov’s office.
Today at the start of a gay rights conference at an undisclosed location east of the city, I was joined by British gay rights campaigner Peter Tatchell and LGBT activists from around Russia and Belorussia Minsk, Rostof, Sochi, Ufa, St. Petersburg, Krasnodar, Ekaterinbourg, Volgodonsk, Ryazan and of course Moscow.
As we gathered on a coach to go to the conference, Moscow activist Nikolai Baev explained how a group of young activists from Ryazan, about 200 miles south of the capital, got involved in organizing this year’s Slavic Pride:
“There is a very discriminatory law in the Ryazan region which prohibits so-called propaganda about homosexuality20and among minors. The law passed in 2006 and we had pickets that said that homosexuality is absolutely normal and we are proud of our situation. We picketed in front of schools in Ryazan and we were detained because it was illegal.”
Two people were found guilty and fined 1500 roubles (about $45 US) each. Alekseev came to Ryazan to help in the campaign and in the appeal of their cases to the Constitutional Court of Russia.
Then, Sergey Yenin, 19, explained how he became involved in gay rights organizing in Belorussia :
“I felt myself to be gay from my early childhood, he explained.
“Last year I came to Minsk and there I got acquainted with some gay activists and I thought it would be great if I fought for my gay rights. There are a lot of people who don’t fight for their rights, who don’t participate in such activist movements, and they just consume our achievements.
“For example, we fought for our gay club, our one gay club in Minsk. It was in danger of being closed [by the government], but it still exists, due to us.”
I asked Sergey if he had participated in Minsk Pride events before.
“Yes, of course. The most outstanding Pride parade took place in 2001. But I didn’t participate because I was only 11 then. There were over 300 people participating in this event and 300 watching. This was fabulous This was an historical moment in Belorussia.
“The last one took place in October of 2008. It was named Queer Walk and it took place on the 11th of October 2008, the international day of coming out, and we organized a pride parade. It was a rather private, intimate event, there were fifty participants because we cannot organize such a public event because of our government.
“If we applied for an event, we would be denied.
“There is an action that takes place [each year] called Chernobyl Way, and all of the opposition parties take place there, and our LGBT group participated last year and this year. Last year we raised the rainbow flag and there were a lot of bad comments about it, there were a lot of thre ats [of violence]. There were such political parties as Right Alliance, and they threaten us all of the time. This year we didn’t20raise our rainbow flag because the organizer of the Belorussian National Front, the main opposition party, they coordinated a call to us, do not raise your rainbow flag, not because we have anything against you, because our fight for clean air, free of radiation will turn into a fight for gay rights.”
I asked Sergey why he personally joined the 15 others for the ten hour train ride from Belorussia to join this Saturday’s Slavic Pride: “I [only] made the conclusion [to come] on May 12 because I was really very frightened about myself and my friends. I know that there is some information that Pride is going to be canceled, and more than this, that Pride participants are going to be beaten.
“Because this is my fight really.If I don’t go to the pride parade, who will go there? My reasons to come was to support my friends – and of course to support gay rights.”

WATCH: “Daily Show” Takes On Army, White House Over Gay Translator’s Firing
A storm is brewing over President Obama’s refusal to intercede on the behalf of Dan Choi, an Arabic translator and lieutenant in the U.S. Army who was just dismissed for being gay. Choi went on the “Rachel Maddow Show” last week and said he intends “to fight it tooth and nail,” and that this kind of behavior “weakens the military.” 54 Arabic translators (and hundreds more servicemen) have been dismissed from the Army due to their sexuality.
Jon Stewart excoriated President Bush for his policies and President Obama for flip-flopping on the issue, saying:
“So it was okay to waterboard a guy 80 times but God forbid the guy who could understand what that prick was saying has a boyfriend? Waterboarding may make a prisoner talk, but it ain’t gonna make him talk English.”

Governor defends gay officer in New York Army National Guard
Governor David Paterson lambasted the military’s “don’t ask, don’t tell” policy on Thursday and defended a gay New York National Guardsman who’s facing dismissal for violating it.
First Lt. Daniel Choi, 28, of New York City, graduated from the U.S. Military Academy in 2003 and served as an Arabic interpreter in Iraq in 2006 and 2007. In March, he joined a West Point alumni group called Knights Out and identified himself as a gay officer.
Military policy forbids homosexual service members from disclosing their sexual orientation. Choi received a discharge notice from the Army last week.
Paterson, who recently introduced a bill to legalize same-sex marriage in New York, spoke out Thursday on Choi’s behalf:
“What public interest does it serve for this veteran who risked his life in Iraq to be discharged from the military for exercising the democratic rights that he defended overseas?” he said. “This case is more proof that this policy needs to be changed.”

A Gay Justice?
Former Stanford Law School dean Kathleen Sullivan is, according to the National Law Journal, one of the 100 most influential lawyers in America. She’s a nationally prominent scholar and teacher of constitutional law, and author of the nation’s leading casebook in constitutional law.
Stanford Law School professor Pamela Karlan clerked for former Supreme Court Justice Harry Blackmun, is founding director of Stanford’s Supreme Court Litigation Clinic, and is a leading expert on voting and the political process.
Sullivan and Karlan are both frequently mentioned as possible Supreme Court nominees for President Obama.
Both women also happen to be openly lesbian. … Peter Sprigg, a senior fellow at the conservative Family Research Council, says that “the real issue would not be the person’s private life but the issue would be would they be imposing their personal ideology upon the court. In this case would they be imposing a pro homosexual ideology, a pro-same sex marriage ideology.”
Sullivan, for instance, joined a friend of the court brief arguing that same sex marriage should be legal even if the “equal protection” clause “would not always have been interpreted by the courts to forbid discrimination against gay people.” Not allowing same sex marriage is a violation of “both due process and equal protection; the former because the right to marry is a form of liberty and the latter because the restriction treats lesbians and gay men differently from straight individuals.”
That she believes that because she’s lesbian, and not because she believes the refusal to allow same sex marriage constitutes unconstitutional discrimination, is another matter.
Either way, discussion about a Justice Sullivan or a Justice Karlan comes at a time when the Obama administration is hearing some impatience voiced by gay and lesbian activists on other issues.
“I think there is some disappointment in the gay community that (President Obama) hasn’t in this initial period spoken more directly and more forcefully about some of the issues he spoke about on the campaign,” Richard Socarides, a former adviser to President Bill Clinton on gay and lesbian issues, told us for Good Morning America today. “Specifically the ‘Don’t ask/Don’t tell’ policy in the military.” See Gay Justice?
