The California Supreme Court today appeared inclined to uphold Proposition 8, but showed obvious reluctance to void thousands of same-sex marriages already in place when voters restored a ban on gay marriage last fall.
During three hours of arguments in San Francisco, the justices peppered lawyers opposing Proposition 8 with questions that suggested they do not believe they have the authority to trump the will of the voters.
At the same time, even justices who voted against striking down California’s previous ban on gay marriage indicated that Proposition 8 should not wipe out an estimated 18,000 same-sex marriages that took place last year. Those couples mobilized around the state to obtain marriage licenses after the Supreme Court ruled last May that California’s prior ban on gay marriage was unconstitutional.
“Is that really fair to people who depended on what this court said was the law?” Justice Ming Chin asked Ken Starr, the former Clinton impeachment prosecutor who argued that same-sex marriages shouldn’t be recognized under Proposition 8.

California Court Weighing Gay Marriage Ban
SAN FRANCISCO — Under intense pressure from both sides in the debate over same-sex marriage, the California Supreme Court began hearing arguments Thursday morning on the future of a ballot initiative passed by voters last November that outlawed such unions.
Supporters and opponents of the measure, Proposition 8, began lining up in front of the courthouse in San Francisco before dawn, bringing with them signs, banners and a sense of tense anticipation.
“We knew we had to be here to see it with our own eyes,” said Katherine Stoner, 61, who had traveled from Monterey, with her partner of 34 years, Michelle Welsh.
Several ardent — and outnumbered — opponents of same-sex marriage also held signs with messages like “Gay = Pervert” and “A Moral Wrong Can’t be a Civil Right.”
Don J. Grundmann, a member of the American Warrior Ministry in San Leandro, Calif., said he believed that homosexuality was a “emotional pathology” that he feared would be taught to children.
“That’s the real objective,” Mr. Grundmann said.
Mr. Grundmann said he wanted to support traditional marriage between a man and a woman, which Proposition 8 affirmed in the November election, passing with 52 percent of the vote. Opponents have sued, saying the ballot measure violates the state constitution, setting up Thursday’s hearing.
The three-hour hearing is a critical legal test for both sides. But opponents of Proposition 8 also used Thursday’s hearing as a prime moment to rally their forces and demonstrate resilience after a stinging election loss that many among them believe could have been avoided. Tauscher moves to end gay ban
Walnut Creek Democrat Ellen Tauscher will move today to end the “Don’t ask, don’t tell” ban on gays in the military, a 15-year relic of the Clinton-era culture wars.
Tauscher last summer had promised a full-scale push to end the ban this year. The Obama presidency clearly lifts the veto threat that had blocked any such move during the Bush administration. Obama promised to support repeal during his campaign. His Republican opponent Sen. John McCain remained opposed.
Polls show solid public support for lifting the ban, with as many as 75 percent backing repeal, a number that has climbed steadily during the wars in Iraq and Afghanistan.
The argument for the ban is that allowing gays and lesbians to serve openly would damage morale.
McCain made that argument last year, saying, “I believe the polarization of personnel and breakdown of unit effectiveness is too high a price to pay for well-intentioned but misguided efforts to elevate the interests of a minority of homosexual service members above those of their units.”
A General Accountability Office study in 2005 showed the military lost 800 service members in 161 occupations. The ban has led to the discharge of desperately needed linquists and translators during the Iraq and Afghanistan wars. See
