Lawsuit Challenges Wis. Domestic Partnership Law
Social conservatives asked the Wisconsin Supreme Court on Thursday to strike down the state’s new domestic partnership law, saying it violates a constitutional ban on gay marriage.
The lawsuit, filed by three members of Wisconsin Family Action, acknowledges the court will not have time to act before the law goes into effect next month but says justices should halt registrations as soon as possible.
Democratic Gov. Jim Doyle signed the law in the state budget last month. Starting Aug. 3, same-sex couples can register with counties to receive dozens of the same legal protections as married couples, including the right to inherit assets, make hospital visits and take medical leave to care for an ill partner.
Wisconsin became the first Midwestern state to enact legal protections for same-sex couples through the Legislature. It also became the first nationwide to allow domestic partnerships despite having a ban on gay marriage and any “substantially similar” relationships. See Lawsuit Challenges Wis. TSA refuses to hire HIV+ Air Force Vetr to scan luggage, ACLU to sues - wonder if Obama will at lteat fix this?
“I was looking for a way to be able to serve my country once again and to supplement my income through this financial crisis with the possibility of changing my career. But after a lengthy interview and screening process, I was told that I am incapable and unworthy because I have HIV,” said Michael Lamarre, who worked in intelligence for the National Security Administration while serving in the Air Force from 1984 to 1987. “I am a long term HIV survivor, and it has never interfered in my ability to work. As I have learned having lived with HIV for nearly 20 years, people with HIV need to be able to make a living and support themselves just like everyone else as well as have the right to serve their country.”
Lamarre has lived with HIV for 19 years. His viral load is nearly undetectable and he has never had any of the medical conditions associated with AIDS. Just last November he completed a 165 mile bike ride for charity in just 2 days.
Today the ACLU filed a complaint on Lamarre’s behalf with the Equal Employment Opportunity Counselor for the Eastern Region of the TSA charging that the TSA is in violation of its own policy barring discrimination against people with disabilities. A copy of TSA’s non-discrimination policy is available on their website at: http://www.tsa.gov/assets/pdf/civil_rights_policy.pdf. The complaint also charges that the refusal to hire Lamarre violated his equal protection guarantees. It asks the TSA to rescind Lamarre’s disqualification from employment.
“As we have known for quite a while now, people living with HIV can lead long and productive lives and can make significant contributions in all professions, including baggage screeners,” said Dr. Margaret Fischl, MD, director and principal investigator of the AIDS clinical research unit at the University of Miami. “A baggage screener with HIV would pose no risk to others and would be no more likely to become infected with a cold or virus than anyone else working in the airport.”

Governor defends gay officer in New York Army National Guard
Governor David Paterson lambasted the military’s “don’t ask, don’t tell” policy on Thursday and defended a gay New York National Guardsman who’s facing dismissal for violating it.
First Lt. Daniel Choi, 28, of New York City, graduated from the U.S. Military Academy in 2003 and served as an Arabic interpreter in Iraq in 2006 and 2007. In March, he joined a West Point alumni group called Knights Out and identified himself as a gay officer.
Military policy forbids homosexual service members from disclosing their sexual orientation. Choi received a discharge notice from the Army last week.
Paterson, who recently introduced a bill to legalize same-sex marriage in New York, spoke out Thursday on Choi’s behalf:
“What public interest does it serve for this veteran who risked his life in Iraq to be discharged from the military for exercising the democratic rights that he defended overseas?” he said. “This case is more proof that this policy needs to be changed.”

So You’re Dead? That Won’t Stop the Debt Collector From Trying To RIp Off Your Survivors

The New York Times just reported on a company that tries to collect money owned by dead people by contacting sruvivors.
That’s right: Your Mom dies and you get a call from a nice kindly person working for DCM Services <http://www.dcmservices.com> asking if you “want to settle the balance on a credit card or bank loan, or perhaps make that final utility bill or cellphone payment.” See So You’re Dead? THe Tiems reprots: “or some relatives, paying is pragmatic. The law varies from state to state, but generally survivors are not required to pay a dead relative’s bills from their own assets. ” So you are not under any legal obligation to pay for a dead person’s personal debts.
But DCM Services tries to sweet talk you into paying them for the dead person’s bills. THe Tiems reports: “DCM Services, which began in 1999 as a law firm, recently acquired clients in banking, automobile finance, retailing, telecommunications and health care” but these upstanding firms don’t want people to know who tehy are.
Of all the underhanded, scum-sucking, detestable things I have seen American business do in the past six decades, this takes the cake.

Gay Media in Receivership
The investment fund that owns the Washington Blade, the Southern Voice, Genre magazine, and other gay publications has been forced into receivership by the federal Small Business Administration (SBA), which will sell the fund’s assets and distribute the proceeds to investors.

“As a consequence of defendant’s continuing violation… SBA is entitled to the injunctive relief… including the appointment of SBA as receiver of [the Avalon Equity Fund],” the SBA wrote in an August 2008 court filing, which was only recently found by Gay City News.
Avalon, which owns a stake in the company that publishes the New York Blade and HX, was licensed by the SBA as a small business investment company (SBIC) in 2000. Through 2007, it borrowed just over $38 million from the federal agency to invest in gay media properties and a range of other ventures.
As part of its contract with the SBA, Avalon was required to have private money or assets in the fund from sources, such as individual investors, that had a value equal to half the amount it borrowed from the SBA or just over $19 million. See Gay Media in Receivership
