A Gay Justice?
Former Stanford Law School dean Kathleen Sullivan is, according to the National Law Journal, one of the 100 most influential lawyers in America. She’s a nationally prominent scholar and teacher of constitutional law, and author of the nation’s leading casebook in constitutional law.
Stanford Law School professor Pamela Karlan clerked for former Supreme Court Justice Harry Blackmun, is founding director of Stanford’s Supreme Court Litigation Clinic, and is a leading expert on voting and the political process.
Sullivan and Karlan are both frequently mentioned as possible Supreme Court nominees for President Obama.
Both women also happen to be openly lesbian. … Peter Sprigg, a senior fellow at the conservative Family Research Council, says that “the real issue would not be the person’s private life but the issue would be would they be imposing their personal ideology upon the court. In this case would they be imposing a pro homosexual ideology, a pro-same sex marriage ideology.”
Sullivan, for instance, joined a friend of the court brief arguing that same sex marriage should be legal even if the “equal protection” clause “would not always have been interpreted by the courts to forbid discrimination against gay people.” Not allowing same sex marriage is a violation of “both due process and equal protection; the former because the right to marry is a form of liberty and the latter because the restriction treats lesbians and gay men differently from straight individuals.”
That she believes that because she’s lesbian, and not because she believes the refusal to allow same sex marriage constitutes unconstitutional discrimination, is another matter.
Either way, discussion about a Justice Sullivan or a Justice Karlan comes at a time when the Obama administration is hearing some impatience voiced by gay and lesbian activists on other issues.
“I think there is some disappointment in the gay community that (President Obama) hasn’t in this initial period spoken more directly and more forcefully about some of the issues he spoke about on the campaign,” Richard Socarides, a former adviser to President Bill Clinton on gay and lesbian issues, told us for Good Morning America today. “Specifically the ‘Don’t ask/Don’t tell’ policy in the military.” See Gay Justice?

As was true every year since Wimbledon’s tennis stadium was built in 1922, the grass at Centre Court in the summer of 1937 had been worn to brown patches at the baseline and service line during tournament play. Players started, stopped and skidded hundreds of times during matches, and the grass could have used a break to recover after the Wimbledon championships ended in early July. Two weeks later, though, on July 20, the players who had faced each other in the final there were back again. Don Budge, a 22-year-old American, and Baron Gottfried von Cramm of Germany, 28, were scheduled to meet in the sport’s premiere team competition, the Davis Cup.
Budge and Cramm were competing in what was essentially a semifinal to determine whether the U.S. or Germany would go to the challenge-round final against England. The match normally would have been staged on Court No. 1, but in a tribute to the renown of the two players, Wimbledon officials moved it to Centre Court. The American star, who had honed his serve and backhand to almost untouchable sharpness, made a likely favorite for the British, since he was taking on the representative of the increasingly bellicose German nation. But the crowd was on Cramm’s side: England was already set to play in the final round, and the fans were hoping that the Germans would beat the formidable American team, giving England a better shot at the cup.
Cramm had other supporters that July day, but their backing sent a chill through him: Nazi officials sitting in the royal box expected him to win for the glory of the fatherland. A victory would also reassure them about his patriotism. The German star had refused to join the Nazi Party, and in April he had been interrogated by the Gestapo regarding allegations of homosexual activity — a crime in Nazi Germany. The handsome, aristocratic Baron von Cramm desperately needed to redeem himself against the homely young American who had learned to play tennis on public courts in California. Cramm’s prospects were not encouraging: In the Wimbledon final, Budge had beaten him easily in straight sets.
But then the match began, and spectators and players alike soon realized that an extraordinary competition of skill and guile and endurance was under way. James Thurber, the tennis-besotted writer for The New Yorker magazine was on hand, and he would later describe the Budge-Cramm five-set marathon as “the greatest match in the history of the world.” Read the rest of this WSJ Review. As of Sunday night, books without rankings included Baldwin’s “Giovanni’s Room,” Vidal’s “The City and the Pillar” and Jeanette Winterson’s “Oranges Are Not the Only Fruit.” The removals prompted furious remarks on Facebook, Twitter and elsewhere online.

Joe Torre would have no trouble with gay players
In an interview with Larry King to talk about his new book, The Yankee Years, the subject of athletes coming out and announcing they are gay was brought up.
King asked the Dodgers’ manager if active players could ever safely announce they were gay.
Torre’s answer:
Well that’s a great question, I don’t know. But I just hope that an active player, if that’s the case, can feel free to do that. That’s all I can say. But I don’t know. Obviously, you have 25 players in the clubhouse, and, you know, it’s going to be tough for everybody to feel as maybe I do. But I’d like to believe our country is turning in that direction.
