Conservatives Shift In Favor Of Openly Gay Service Members
A new Gallup poll shows that 69 percent of Americans are now in favor of openly gay men and women serving in the military, up from 63 percent five years ago. Support among liberals and Democrats remains high — around 86 percent and 83 percent respectively — but the biggest shift in support occurred among conservatives and Republicans. Fifty-eight percent of people who identify as conservatives say they support gays serving in the military, up from 12 points from 46% in 2004. Fifty-eight percent of Republicans support what is essentially a repeal of “Don’t Ask, Don’t Tell.”
While a majority of Americans still oppose legalizing gay marriage, the shift in support for gays serving in the military “suggests the political playing field may be softer on this issue, and President Barack Obama will be well-positioned to forge ahead with his campaign promise to end the military ban on openly gay service members with some support from more conservative segments of the population,” Gallup writes.

Supreme Court Rejects Challenge To “Don’t Ask, Don’t Tell”
The Supreme Court on Monday agreed with the Obama administration and upheld Pentagon policy barring gays and lesbians from serving openly in the military.
The court said it will not hear an appeal from former Army Capt. James Pietrangelo II, who was dismissed under the “don’t ask, don’t tell” policy. The federal appeals court in Boston earlier threw out a lawsuit filed by Pietrangelo and 11 other veterans. He was the only member of that group who asked the high court to rule that the Clinton-era policy is unconstitutional.
During last year’s campaign, President Barack Obama indicated he supported the eventual repeal of the policy, but he has made no specific move to do so since taking office in January. Meanwhile, the White House has said it won’t stop gays and lesbians from being dismissed from the military.
In court papers, the administration said the appeals court ruled correctly in this case when it found that “don’t ask, don’t tell” is “rationally related to the government’s legitimate interest in military discipline and cohesion.”
Pentagon spokesman Bryan Whitman referred requests for comment to the Justice Department, but said the military policy “implements the law.”
“The law requires the (Defense) Department to separate from the armed services members who engage in or attempt to engage in homosexual acts; state they are homosexual or bisexual; or marry or attempt to marry a person of the same biological sex,” Whitman said in a statement.
A legal advocacy group vowed to press ahead with efforts to reverse the policy despite the legal setback.
“We don’t see that at all as bad news for repeal,” said Kevin Nix, spokesman for the Servicemembers Legal Defense Network. “What happened today puts the ball back into the court of Congress and the White House to repeal the law, and that’s where we think it should be right now.”

Poll: Conservatives, churchgoers do about face on DADT
Solid majorities of self-identified conservatives and weekly churchgoers now favor allowing gays and lesbians to serve openly in the U.S. military, a striking turnaround in just the last four years, according to a new Gallup poll. Overall, 69% of U.S. adults surveyed support a change in the military’s “don’t ask, don’t tell” policy, an increase of six percentage points since late 2004.
According to Gallup:
The finding that majorities of weekly churchgoers (60%), conservatives (58%), and Republicans (58%) now favor what essentially equates to repealing the “Don’t Ask, Don’t Tell” policy implemented under President Clinton in 1993 is noteworthy for several reasons. First, the data show that these traditionally conservative groups are shifting on this issue, supporting it to a far greater extent than they support legalized gay marriage. Second, it suggests the political playing field may be softer on this issue, and President Barack Obama will be well-positioned to forge ahead with his campaign promise to end the military ban on openly gay service members with some support from more conservative segments of the population. To date, it is estimated that more than 12,500 servicemen and servicewomen have been discharged under the policy, including more than 200 since Obama took office.

Ward 8 Democrats Act Ahead of D.C. Council Legislation
The District’s same-sex marriage debate continued yesterday in the basement of a library in Ward 8, the predominantly African American community that council member Marion Barry invoked in justifying his recent vote against a bill to recognize gay marriages performed outside of the city.
But yesterday, gay rights advocates declared victory in a key battle to set the tone for the issue when the Ward 8 Democrats voted 21 to 11 to support the legalization of same-sex marriage, in preparation for legislation expected to be introduced in the D.C. Council this year.
The Ward 8 vote came after almost two hours of discussion about religion, referendums and civil rights among the crowd of about 100 people at the Washington Highlands Library on Atlantic Avenue SW.
Barry, who was scheduled to speak for the opposition, did not attend. Sandy Allen, a former council member and president of the Ward 8 Democrats, said Barry told her he had a doctor’s appointment.
More than a week ago, Barry drew ire and praise when he was the lone dissenter in a 12 to 1 vote to recognize same-sex marriages from other jurisdictions. Barry, a civil rights icon and a longtime supporter of gay rights, said his vote represented the feelings of the predominantly black Ward 8 and, in a broader sense, most black people in the District.
Local gay rights advocates say there is some credence to Barry’s argument. A 2006 poll by a local group advocating same-sex marriage shows strongest opposition among black residents. Some of those sentiments were on display at yesterday’s Ward 8 discussion.
“We are not homophobic. We are not hatemongers. We love everybody,” said the Rev. Patrick J. Walker, chairman of a new task force of ministers opposed to gay marriage. The task force is part of the Missionary Baptist Ministers’ Conference in the region, which pressed Barry to vote against the same-sex marriage recognition legislation.
“It’s our position that this is an issue that should go before the people. Thirteen people . . . should not set the moral compass of this city,” Walker said, referring to the members of the council. He is the pastor of New Macedonia Baptist Church in Southeast.

Moscow Police Smother Rally for Gay Rights as It Begins
MOSCOW — Police officers in Moscow quickly suppressed a gay rights demonstration on Saturday, detaining dozens of protesters who hoped to showcase discrimination in Russia ahead of the Eurovision song contest final on Saturday evening.
The approximately 40 people rounded up face misdemeanor charges for trying to hold what a police spokesman, Anatoly Lastovetsky, called “unsanctioned” demonstrations.
Such demonstrations have become an annual headache for the Moscow authorities, who refuse to grant permission to organizers to hold the events despite constitutional guarantees protecting freedom of assembly. At previous gay rights events, police officers have often stood by as neo-fascists and radical Orthodox Christian groups attacked protesters.
While there were no reports of violence on Saturday, the crackdown on this year’s protest could prove an embarrassment as thousands of European visitors enter the city for the Eurovision final, a huge pop music spectacle that Moscow is hosting for the first time after Dima Bilan, a Russian pop star, won last year’s contest in Serbia. Gay protest broken up in Moscow
Police in Russia have broken up a protest by gay rights activists in Moscow, staged to coincide with the final of the Eurovision Song Contest.
Some 30 campaigners had gathered near a university in defiance of a ban on their march and many were dragged away by police when they shouted slogans.
British gay rights activist, Peter Tatchell, was among those detained.
A counter-demonstration by nationalist and religious groups was allowed to go ahead elsewhere in the Russian capital.
Equal rights
The gay rights group had been waving flags and chanting slogans demanding equal rights and condemning the treatment of gays and lesbians in Russia.
At least 20 were arrested as police moved in to disperse the protest.
As he was being taken away by police, Mr Tatchell shouted: “This shows the Russian people are not free.”
Speaking from a police station, he later told the BBC: “The way the police violently broke up our peaceful protest is an indication of a drift toward authoritarianism that is affecting all Russians.”
‘Satanic’
The organiser of the gathering and leading campaigner, Nikolai Alexeyev, was also detained at the event, which took place in the south-west of the city.

New UN plan to boost HIV services targets gay men and transgender people
Two United Nations agencies are launching a plan to provide increased HIV-related information and health services to men who have sex with men and transgender populations, while stressing the need to make universal access to treatment, care and support a reality for all.
The initiative, spearheaded by the Joint UN Programme on HIV/AIDS (UNAIDS) and the UN Development Programme (UNDP), comes ahead of the International Day Against Homophobia, observed on 17 May.
“The case is clear and urgent,” said Jeffery O’Malley, Director of UNDP’s HIV group. “If we are going to make universal access for sexual minorities a meaningful reality, we must work towards ending homophobia and transphobia. We must address the legal and policy barriers.”
In a news release issued today, the agencies noted that in many parts of the world, HIV prevalence among men who have sex with men is more than 20 times higher than in the general population.
In addition, studies show that HIV prevention services reach only one tenth to one third of people who engage in male homosexual activity. At the same time, there is growing evidence that the majority of new infections in many urban areas are among men who have sex with men.
“Yet, these same groups have limited access to HIV-related information and health services due to discrimination, violence, marginalization and other human rights violations,” the agencies stated. “In many countries, they still face criminal sanctions and lack access to justice.”
Paul De Lay, acting Deputy Executive Director at UNAIDS, stressed the need for rigorous monitoring by countries of the evolution of their epidemics, and for tailoring national responses to the needs of those most at risk.
“In many settings this will be men who have sex with men,” he said, adding that responses must be based on local epidemiological and social realities to be effective.
The plan being launched – the UNAIDS Action Framework: Universal Access for Men who have Sex with Men and Transgender People – outlines several factors that impede access to HIV services, such as unwillingness on the part of governments and donors to invest in the sexual health of sexual minorities.
It also sets out how UNAIDS will work towards achieving universal access through three main objectives – improving human rights, strengthening the evidence base through better data, and reinforcing capacity and promoting partnerships to ensure broader and better responses.
In a message to mark the International Day, UNAIDS Executive Director Michel Sidibé called for greater efforts to end homophobia and ensure the barriers that stop access to HIV services are removed.
“I urge all governments to take steps to eliminate stigma and discrimination faced by men who have sex with men, lesbians and transgender populations. They must also create social and legal environments that ensure respect for human rights and enable universal access to HIV prevention, treatment, care and support,” he stated.
Mr. Sidibé added that while governments committed in the 2006 UN Political Declaration on HIV/AIDS to removing legal barriers and passing laws to protect vulnerable populations, more than 80 countries still have legislation that prohibits same sex behaviour.

Violence feared over Moscow gay march
Gay rights activists have warned there could be violence on the streets of the Russian capital Moscow on Saturday as the city stages the Eurovision Song Contest final.

The competition traditionally has a large gay following and Russian activists are trying to hold the country’s first ever gay pride march while thousands of Eurovision fans are in Moscow.
But the city council has refused to give official permission for the march, while allowing hardcore nationalists and religious groups to stage a counter-demonstration on the same day.
Gay activists have come under attack from such groups in the past.
“We will still go ahead”, says Nikolai Alekseev, leader of Russia’s gay rights movement.
“There will be outrage around the world… if on the 16 May people are being arrested and beaten on the streets of Moscow hours before the Eurovision Song Contest final.
“It will be a disgrace for Russia.”

Gay row goes before Kirk’s ‘court’ as split threat talked down
A COMPLAINT against openly gay Kirk minister Scott Rennie will be heard before the Church of Scotland’s own equivalent of a civil court next week.
However, the moderator designate refused to be drawn into the controversy surrounding the appointment of Mr Rennie, 36, as he faced questions over the possibility of a split in the Kirk if it goes ahead.
During what was his first public appearance in the role, the Rev Bill Hewitt, 58, insisted his job would be to oversee a forthcoming Church debate on the issue and he would not be drawn into answering questions about the row.
However, reacting to the suggestions that supporters of controversial preacher Fred Phelps – who has protested against homosexuality in the United States – are planning to demonstrate outside the General Assembly when the issue is being discussed, he said: “People are free to demonstrate if they want.
