Teens’ attorneys call attempted murder “staged”
Attorneys for three teens accused of trying to push a lesbian classmate off of a cliff are calling the incident “staged,” the Lexington Herald-Leader [1] reported.
Cheyenne Williams, 18, said three of her classmates kidnapped her, took her to picturesque Flat Lick Falls, and tried to push her over a cliff.
The attorneys for the three defendants dispute that story.

James Baechtold, who represents one of the teens, said Williams’ story contains “distinct falsehoods” the Herald-Leader reported. “There’s no merit to any of these allegations at all.”
The Kentucky Equality Federation, an LGBT advocacy group, told Williams they would support her potential lawsuit financially. The group also vowed to push to have the incident classified as a hate crime, which would mean tougher penalties if the teens are convicted.
A video that Williams took with her cell phone appears to be a key piece of evidence.
“I have seen the video and I will not comment on what it shows other than to say that is what I base my opinion on. It was staged performance and the alleged victim was a participant,” Sharon Allen Gray, an attorney for one of the defendants told KYMT [3].
A hearing Thursday is likely to reveal more details in the case.

ENDA activists avoid prison time
Four lesbian activists who earned the nickname “the ENDA 4” for staging a protest – and getting arrested – at House Speaker Nancy Pelosi’s Washington, D.C., office will not face any prison time, a judge ruled Tuesday.
ENDA is the Employment Non-Discrimination Act that has been held up in a House committee since last year. The activists want the bill to come to a House vote.
While the charges against the group were dropped, the four women affiliated with the gay advocacy group Get Equal [1] were ordered to stay away from Pelosi’s office for the next six months, according to Metro Weekly [2].

In addition, the women – Chastity Kirven, Janine Carmona, Michelle Wright and Samantha Ames – are barred from engaging in “disruptive behavior” around the Capitol for the next six months.
Ames and Carmona, who are both D.C. residents, also must perform 60 hours of community service. The other two are exempt from community service because they live outside the District.
Claire Morris Clark, the attorney representing the ENDA 4, told Metro Weekly, “This is a very good outcome.”

Wisconsin budget extends rights to gay couples
With the budget signed Monday by Gov. Jim Doyle, Wisconsin has become the first state with a constitutional amendment banning same-sex marriage and civil unions to put in place domestic partnerships for same-sex couples.
Wisconsin also is the first Midwestern state to legislatively put in place legal protections for same-sex couples, according to advocates.
But supporters of the ban still contend the creation of domestic partner benefits violates the constitutional amendment on marriage because it creates a legal status that approximates marriage — and they could file a legal challenge soon.
Starting Aug. 3, couples will be able to apply for a declaration of domestic partnership in their home counties. Partnerships would be dissolved through a termination process at the county clerk’s office.
Some counties and municipalities already
*ecognize domestic partnerships, including Dane County and the city of Milwaukee. But Maria Cadenas, executive director of the Cream City Foundation, an advocacy group on gay and transgender issues, said that for her and her partner, registering in Milwaukee only affected their gym membership.

Gay Sailor Found Dead On Marine Base In Suspected Homicide
CAMP PENDLETON — The body of a 29-year-old sailor was found in a Camp Pendleton guard shack Tuesday, and a “person of interest” was taken into custody in connection with the suspected homicide, Navy officials said yesterday.
The body of Seaman August Provost of Houston, Texas, was discovered about 3:30 a.m. on the western edge of the base, said Doug Sayers, a spokesman for Navy Region Southwest.
An autopsy was completed yesterday, but authorities were waiting for results of toxicology tests to determine a cause of death.
A “person of interest” was being held in the Navy brig at Marine Corps Air Station Miramar. No charges have been filed.
The death has local gay activists calling for a formal investigation into whether Provost was slain because of his sexual orientation.
“We’re definitely monitoring this and trust and hope the military will investigate this in the professional way it should,” said Nicole Murray-Ramirez, chairman of San Diego’s Human Rights Commission. Murray-Rameriz also has contacted Reps. Susan Davis and Bob Filner, asking that they make official inquiries to the military concerning an investigation.
The Navy would not comment on whether Provost’s orientation had anything to do with the death.
“While ‘Don’t ask, Don’t tell’ is in place, anybody in the military who is a homosexual has no place to go to get assistance or counseling,” said Ben Gomez of Servicemembers Legal Defense Network, an advocacy group for gays in the military.
Provost’s boyfriend, Kaether Cordero, said yesterday that Provost was openly gay but kept his private life quiet for the most part.
“People who he was friends with, I knew that they knew,” Cordero said from Houston. “He didn’t care that they knew. He trusted them.”

A Long Road Traveled
The last time I got as close to the White House as I did this week was many years ago—six years after the Stonewall riots, when I was a 13-year-old National Spelling Bee participant from St. Margaret’s School in Lowell, Mass. We spelling bee kids didn’t make it into the White House that day—we stood outside as first lady Betty Ford spoke to us from a balcony. By then I already knew I was gay. Raised in a staunch Catholic home and taught (and tormented) by nuns, I was certain that an open homosexual (that was the only term I knew back then) could never be allowed inside the White House. I knew nothing of the nascent gay-rights movement—it hadn’t reached Lowell in 1975. All I knew was that that whatever words there were to describe what I was, it would have to be suppressed forever. I assumed that I would have to either become a priest or figure out some other way to hide.
Thankfully, time marched on, and I eventually became a politicized college student rather than a candidate for the priesthood—and ultimately I kicked open my closet door and came out. But I can’t help thinking about that personal history as I replay the reel of yesterday’s visit to the White House in my head. As the executive director of SAGE, an advocacy group for LGBT senior citizens, I was invited, along with some 200 other LGBT leaders, to join the Obamas in commemorating gay pride—which falls this year on the 40th anniversary of the Stonewall riots.
I was accompanied by three SAGE members: a lesbian couple who are 86 and 91, who reminisced about voting for FDR and described Barack Obama as “the most inspiring politician since Adlai Stevenson,” and a Stonewall veteran and founder of the Gay Liberation Front, an activist group formed in the aftermath, who proudly chose his SAGE T shirt over the ties worn by every other man in the room.
Apart from celebrating, we had gone to the White House to make a point: that older people have to be included in the Obama agenda for LGBT progress. And we did what we came to do, with one of our members (the Stonewall vet) even receiving a personal meeting with the president and Mrs. Obama. But as I stood with my partner, in the front row, some five feet from the presidential podium, I realized how intensely personal this experience was for me. I thought about how each member of the SAGE contingent has had our own life’s journey—and each of us was moved deeply and differently by that moment.

Gay Exorcism Mania
Been hearing a lot about the gay exorcism lately?
About a week after Fairfield County Weekly ran a story on Bridgeport’s Manifested Glory Ministries and the almost violent “casting out of spirits” they performed on a teenager (“Losing Grip,” June 18), the story has been picked up by Hartford-based Fox 61, then the AP, then CNN and then, inevitably, everyone else.
(A headline at TheSpoof.com even announced “Michael Jackson Died During Gay Demon Exorcism.”)
Robin McHaelin, executive director of the advocacy group True Colors, says that after viewing the YouTube clip of the event, she confirmed that, months earlier, the teenager seen in it attended True Colors’ Queer Prom in Hartford.
Also, the boy, confirmed to be 16 years old, did not undergo the ritual at the behest of his parents; he sought out Manifested Glory, and his mother was shocked of the footage of him writhing on the floor or being held up by his arms as the church’s “prophet” and “overseer” yelled evocations.
This limits what actions the state Department of Children and Families, whom McHaelin contacted, can do about the matter.
“I think this is a very troubled family and the child needs space for reflection,” says McHaelin. “I am hoping that if we back off, the church will back off, too.”

Group: Gay bias killings highest since 1999
national advocacy group says the number of lesbian, gay, bisexual and transgender people killed in bias-motivated incidents increased by 28 percent in 2008 compared to 2007.
The National Coalition of Anti-Violence Programs released its report Tuesday. It says last year’s 29 killings is the highest it has recorded since 1999. It documented the same number of slayings then.
The New York-based coalition says the overall number of victims who reported anti-LGBT violence in 2008 increased by 2 percent.
The coalition says its figures are more accurate than those from law enforcement agencies. As an example, the group says the FBI doesn’t record bias crimes against transgender people because gender identity isn’t covered by federal hate-crime law.

LGBT Legal And Advocacy Groups Decry Obama Administration’s Defense of DOMA
We disagree with many of the administration’s arguments, for example, that DOMA is a valid exercise of Congress’s power, is consistent with Equal Protection or Due Process principles, and does not impinge upon rights that are recognized as fundamental.
We are also extremely disturbed by a new and nonsensical argument the administration has advanced suggesting that the federal government needs to be “neutral” with regard to its treatment of married same-sex couples in order to ensure that federal tax money collected from across the country not be used to assist same-sex couples duly married by their home states. There is nothing “neutral” about the federal government’s discriminatory denial of fair treatment to married same-sex couples: DOMA wrongly bars the federal government from providing any of the over one thousand federal protections to the many thousands of couples who marry in six states. This notion of “neutrality” ignores the fact that while married same-sex couples pay their full share of income and social security taxes, they are prevented by DOMA from receiving the corresponding same benefits that married heterosexual taxpayers receive. It is the married same-sex couples, not heterosexuals in other parts of the country, who are financially and personally damaged in significant ways by DOMA. For the Obama administration to suggest otherwise simply departs from both mathematical and legal reality.
When President Obama was courting lesbian, gay, bisexual and transgender voters, he said that he believed that DOMA should be repealed. We ask him to live up to his emphatic campaign promises, to stop making false and damaging legal arguments, and immediately to introduce a bill to repeal DOMA and ensure that every married couple in America has the same access to federal protections.

Gay Couples Forced to Flee US Over Immigration Law
An estimated 36,000 Americans face a choice — separate or move abroad — because they can’t secure green cards for their partners like heterosexual spouses can., said U.S. Rep. Jerrold Nadler, D-NY, citing information from the advocacy group Immigration Equality.
Bills have been introduced in Congress to treat same-sex partners like heterosexual spouses for the purposes of immigration but are likely to face a strong fight, both from gay marriage opponents and anti-immigration groups. The 1996 Defense of Marriage Act prevents immigration officials from recognizing gay marriages, even from states where they are now legal.
Proponents see the issue as a basic rights question, and Steve Ralls, a spokesman for Immigration Equality, said he believes the best chance for the legislation is as part of a larger immigration bill.
But other immigration advocates want to keep the issues separate, fearful of bogging down an already tough fight. Kevin Appleby, migration policy director for U.S. Conference of Catholic Bishops, said the push for same-sex partners in immigration is about getting recognition in federal law for gay marriage — which he opposes.
”It’s an unholy marriage of the immigration debate and the same-sex marriage debate,” he said. ”It’s very combustible.”
Lown’s decision last month brought the issue to an unlikely place, a town of 90,000 where ranchers and roughnecks from the vast open lands come to do their banking and send their kids to the regional state college. The town’s only other recent brush with national fame came last year when it housed the hundreds of children taken from a polygamist sect’s ranch in nearby Eldorado.
