Activists welcome Delhi hc’s gay verdict
Gay support groups of Vadodara have welcomed the Delhi High Court’s verdict that decriminalised homosexual relations.
They said the judgment will help solve health issues
such as HIV/AIDS, adding that the abolition of
Section 377 for adults shall also solve several ailments among the weaker segments of society.
Maya Sharma, Parma’s Founder trustee, said: “This judgment is indicative of the changing values of society and will enable further change. Generally, this movement has been seen as western, but in reality, this change would not have been possible without support and participation of people cutting across the religion, caste and age lines.”
Pointing out what kind of legal challenges women have faced recently in the state, Sharma said: “While marriage is almost compulsory for all, when it comes to women, there was a complete lack of choice. Recently in Ahmedabad, a same-sex couple went to the police for help only to be turned away because there was no provision for protection of a woman having a woman partner.”

India Decriminalizes Gay Sex
n what many are calling “India’s Stonewall”, the New Delhi High Court on Thursday decriminalized homosexual intercourse between consenting adults, by striking down section 377 of the Indian Penal Code. This law labels gay sex to be an “unnatural offense”, punishable with up to ten years in prison.
Drafted in 1860, this Colonial-era law was brought into effect by the British, and was in line with similar anti-homosexuality legislation passed in England at the time. In the past decade, gay rights activists and lawyers have strived hard to abrogate Section 377, calling it “inhuman”, and as the Naz Foundation, which filed the petition to abolition 377 in 2001 argued, a violation of constitutional rights to privacy and equality.
No Rain on Their Parade
In its ruling today, the Delhi High Court affirmed that claim, saying that Section 377 violated basic human rights. The same court, however, had dismissed a similar petition in 2001. It is clear that this latest ruling is a reflection of increased activism by gay rights groups and high profiled supporters like Bollywood actress and Former Miss World Celina Jaitley, along with a more progressive government.

Study: Gays not ‘godless Christian bashers’
This breaking news in from The Barna Group — a chronicler of religious life and habits, particularly of the Christian variety: Gay folks’ attitudes about spirituality aren’t much different from straight folks. These and other “surprising insights” were in Barna’s spiritual profile of gays released Monday. In it was a bit of a political heeding for gay-bashers:
“People who portray gay adults as godless, hedonistic, Christian bashers are not working with the facts,” wrote George Barna Monday. “A substantial majority of gays cite their faith as a central facet of their life, consider themselves to be Christian, and claim to have some type of meaningful personal commitment to Jesus Christ active in their life today.”
“It is interesting to see that most homosexuals, who have some history within the Christian Church, have rejected orthodox biblical teachings and principles — but, in many cases, to nearly the same degree that the heterosexual Christian population has rejected those same teachings and principles,” Barna said. “Although there are clearly some substantial differences in the religious beliefs and practices of the straight and gay populations, there may be less of a spiritual gap between straights and gays than many Americans would assume.”
Now there will be some quibbling with a couple of Barna’s assumptions. Like how Barna pegs the LGBT population at about 3 percent of the adult population. No, he doesn’t believe in the 1-in-10 stat, but then again, LGBT population scholar Gary Gates says it’s more like 5 percent, depending how you count.
That aside, the Barnanians found that “out of the 20 faith-oriented attributes examined in the Barna study, there were just a few in which there were no significant differences between the heterosexual and homosexual populations.”
Hmm. “No significant differences between the heterosexual and homosexual”(s)? Does Donald Wildmon know about this?
One big diff, according to the study: “While seven out of every ten heterosexuals (71 percent) have an orthodox, biblical perception of God, just 43 percent of homosexuals do. In fact, an equal percentage possesses a pantheistic view about deity — i.e., that ‘God’ refers to any of a variety of perspectives, such as personally achieving a state of higher consciousness or maximized personal potential, or that there are multiple gods that exist, or even that everyone is god.”
Another diff: “Heterosexuals were twice as likely as homosexuals to strongly agree that the Bible is totally accurate in all of the principles it teaches.”
And in the timeliness is next to godliness (OK, and cleanliness) dept: On Monday a crew of organizations supporting same sex marriage are launching their Get Engaged Tour of California — a pump-priming tour of the state in advance of an expected 2010 ballot measure campaign expected later this year. We told you about it a while back. Faith leaders will be prominently featured on this tour, as opposed to last year’s anti-Proposition 8 campaign, when they were largely invisible.
“Our faith-based values require us to love our neighbor as ourselves,” said Pastor Samuel Chu, of California Faith for Equality. “Gay and lesbian people are our neighbors and they should be able to enjoy the dignity, respect and commitment that come with marriage.”

‘Come Out’ Album’s Message: God Loves You Just as Gay as You Are
LOS ANGELES, CA — Gospel singer and an out lesbian member of clergy in the Gospel Truth Music Ministry (http://www.rizigospel.com/), the Rev. Rizi Nasele Timane’ is unveiling her new album “Come Out,” a collection of original songs that call for full human rights for the lesbian, gay, bisexual and transgender community. As part of the album’s promotion, Timane’ is touring the United States during the summer of 2009.
The album’s title song challenges the fundamentalist notion that God and the Bible condemn homosexuality and strives to educate the public about what the Bible really says and does not say about homosexuality. “I have extensively studied the Greek and Hebrew translations of the Bible, and I found that, when interpreted properly, the Bible does not condemn homosexuality at all,” stated Timane’.
“I’m the first out lesbian reverend and gospel singer from Nigeria, West Africa,” Timane’ continued. “I was one of the first people to identify as openly gay in homophobic Africa, and I know firsthand how that rejection translates to drug addiction and suicide.” According to the Massachusetts 2006 Youth Risk Survey, lesbian, gay, bisexual, transgender and questioning youth are up to four times more likely to attempt suicide than their heterosexual peers. Additionally, San Francisco State University’s Chavez Center Institute has found that LGBTQ youth who come from a rejecting family are up to nine times more likely to attempt suicide than their heterosexual peers because of the negative treatment endured.
“For LGBT persons, this painful struggle with religion or spirituality and sexuality is responsible for depression, low self-esteem, drug addiction, self-abuse, isolation and the entering into of false heterosexual marriages,” said Timane’. “Worst of all, it’s responsible for thousands of suicides each year in the LGBT community, especially amongst our teens and young adults. It is my hope to put a stop to these negative traits and suicides by re-educating our community.”
“Anti-LGBT arguments like the one contending that California’s Proposition 8 ensures children’s wellbeing by providing them with a mother and father are totally absurd. In the case of Proposition 8, the state’s laws permit adoption by gay and lesbian parents as well as single parents and even allows courts to assign a single grandparent, aunt, uncle or even a non-blood relative to be a child’s guardian or caregiver,” continued Timane’.
“The goal of my new album is to enable any LGBT person seeking God to know that God loves them just as gay as they are,” states Timane’. She also wants to help those who are struggling with their spirituality and sexuality, just as she did for many years, to finally find complete reconciliation and affirmation.

Christian group sues for right to burn gay teen novel
n a scene which appears to have been lifted straight out of Ray Bradbury’s Fahrenheit 451, a group of Christians in Wisconsin has launched a legal claim demanding the right to publicly burn a copy of a book for teenagers which they deem to be “explicitly vulgar, racial [sic], and anti-Christian”.
The offending book is Francesca Lia Block’s Baby Be-Bop, a young adult novel in which a boy, struggling with his homosexuality, is beaten up by a homophobic gang. The complaint, which according to the American Library Association also demands $120,000 (£72,000) in compensatory damages for being exposed to the book in a display at West Bend Community Memorial Library, was lodged by four men from the Christian Civil Liberties Union.
Their suit says that “the plaintiffs, all of whom are elderly, claim their mental and emotional well-being was damaged by this book at the library,” and that it contains derogatory language that could “put one’s life in possible jeopardy, adults and children alike.”
“The word ‘faggot’ is very derogatory and slanderous to all males,” the suit continues. “Using the word ‘Nigger’ is dangerously offensive, disrespectful to all people. These words can permeate violence.” The suit also claims that the book “constitutes a hate crime, and that it degrades the community”.
“They’ve filed a claim against the city of West Bend and the city has to decide if it is valid,” said Deborah Caldwell-Stone, acting director of the ALA’s office for intellectual freedom. “Their insurance company is evaluating the claim, but I would be very surprised if they found any merit in it … Should they find any merit in this claim, we would certainly support the library in fighting it.”
The legal challenge follows a lengthy campaign by some West Bend residents to restrict access to teenage books they deemed sexually explicit from library shelves, which was eventually thrown out at the start of June.
“Obviously we were really pleased with the outcome to that – there was a unanimous vote to keep the books in the library and we thought the matter should be over,” said Larry Siems, director of the Freedom to Write programme at PEN America.
Siems said there was clearly “a bit of theatre” in the lawsuit which followed. “They’ve filed a lawsuit which has little possibility of going forward legally, and they’re asking for damages which include the right to burn a book. It does seem more to gain publicity than a real serious challenge.” But, he said, PEN remained very concerned about the impulse behind the claim. “This is a group of people trying aggressively to rid the library of these books and that’s very serious – it needs to be fought.”
The claimants, he said, “have a right to continue to express their views, and this in a way is a creative attempt to express those views”. But it’s “also a dangerous game when you’re talking about something like book burning, calling on the law to burn books. It’s certainly completely un-American, and if they paused, I think they would agree.”
It was not possible to reach the Christian Civil Liberties Union for comment.

Poll: Conservatives, churchgoers do about face on DADT
Solid majorities of self-identified conservatives and weekly churchgoers now favor allowing gays and lesbians to serve openly in the U.S. military, a striking turnaround in just the last four years, according to a new Gallup poll. Overall, 69% of U.S. adults surveyed support a change in the military’s “don’t ask, don’t tell” policy, an increase of six percentage points since late 2004.
According to Gallup:
The finding that majorities of weekly churchgoers (60%), conservatives (58%), and Republicans (58%) now favor what essentially equates to repealing the “Don’t Ask, Don’t Tell” policy implemented under President Clinton in 1993 is noteworthy for several reasons. First, the data show that these traditionally conservative groups are shifting on this issue, supporting it to a far greater extent than they support legalized gay marriage. Second, it suggests the political playing field may be softer on this issue, and President Barack Obama will be well-positioned to forge ahead with his campaign promise to end the military ban on openly gay service members with some support from more conservative segments of the population. To date, it is estimated that more than 12,500 servicemen and servicewomen have been discharged under the policy, including more than 200 since Obama took office.

Knowing Someone Gay/Lesbian Affects Views of Gay Issues Gallup.com -
WASHINGTON, D.C. — While 57% of Americans oppose legalizing gay marriage, Americans who personally know someone who is gay or lesbian are almost evenly divided on the matter, with 49% in favor and 47% opposed. Among those who do not personally know anyone who is gay, 72% oppose legalized gay marriage while just 27% favor it.

The results are from a May 7-10, 2009, USA Today/Gallup poll, which asked Americans their views on a number of issues relating to gays and lesbians. Overall, a majority of Americans (58%) say they have a friend, relative, or coworker who is gay or lesbian — basically unchanged since Gallup first asked this question in 2003.

Examining personal experience by ideology, 71% of self-identified liberals say they personally know someone who is gay or lesbian — far more than is true among moderates and conservatives, who align more closely with the national average.

Views of gay marriage are strongly related to ideology. But the increase in support among those who personally know someone who is gay or lesbian is not merely a reflection of the fact that liberals are more likely to know someone of same-sex orientation. Further analysis reveals that, when controlling for ideology, those who know someone who is gay or lesbian are significantly more supportive of gay marriage than are those of the same political persuasion who do not personally know someone who is gay or lesbian.
Americans who know someone who is gay or lesbian are about evenly split between saying legalizing gay marriage will change society for the worse (39%) and that it will have no effect on society (40%). Nearly two-thirds of Americans (63%) who do not personally know a gay or lesbian person believe that legalized gay marriage will change society for the worse — far greater than the 48% of national adults who say the same. Only a small minority of Americans believe legal gay marriage will change society for the better, but those who personally know someone who is gay or lesbian are three times more likely to say this than are those who do not know anyone who is gay or lesbian.

Experience and Acceptance
In addition to the findings on gay marriage, Gallup similarly finds those with personal experience with gay or lesbian individuals more accepting of same-sex relations in general. While a majority of Americans overall (56%) think same-sex relations should be legal, two-thirds (67%) of those who personally know a gay or lesbian individual say this. A majority (57%) of those who do not personally know anyone who is gay say gay or lesbian relations should not be legal.

Of those who say they personally know someone who is gay or lesbian, 88% say they are comfortable around these individuals, compared to 64% of those who do not personally know someone who is gay or lesbian. Among adults overall, fewer than 2 in 10 say they are uncomfortable around someone who is gay or lesbian, but that number increases to 3 in 10 among those who do not personally know anyone who is gay or lesbian.

All in God’s Family: Creating Allies for Our LGBT Families Launched
WASHINGTON, May 11 – Leading organizations today released a curriculum designed to help faith communities support and embrace lesbian, gay, bisexual and transgender (LGBT) people and their families. The National Gay and Lesbian Task Force’s Institute for Welcoming Resources, COLAGE and Family Equality Council announced that this multimedia curriculum will go a long way in providing the necessary tools to make faith communities affirming of LGBT people and their families.
“While many churches have done very well welcoming individual lesbian, gay, bisexual and transgender members into their midst, many have not done so well with LGBT families,” says the Rev. Rebecca Voelkel, Institute for Welcoming Resources and faith work director of the National Gay and Lesbian Task Force. “But LGBT families deserve the same love and honor as all of God’s beloved families. This curriculum helps congregations extend God’s extravagant welcome to all of God’s families – especially LGBT families.”
All in God’s Family includes concrete tools to educate faith leaders, including a step-by-step guide to supporting LGBT families of faith and tools for facilitating group learning, community dialogue, Bible study and community action planning to highlight LGBT families in our communities. Additionally, the curriculum includes Families Like Mine, a book about adults with LGBT parents written by Abigail Garner, whose father is gay; the youth-produced documentary In My Shoes: Stories of Youth with LGBT Parents; and a CD containing the phototext exhibit “That’s So Gay: Portraits of Youth with LGBT Parents.”
“I know many LGBT parents who struggle with faith,” says Jennifer Chrisler, executive director of Family Equality Council. “It can be difficult to find a congregation that feels welcoming and supportive. Though they want raise their children in a community that shares their values and beliefs, LGBT parents also want their children to be embraced. That’s why we partnered to put together All in God’s Family: Creating Allies for our LGBT Families. We know there are thousands of congregations out there that want to embrace our families. We want to give them the tools to do so more fully.”

These results are nothing short of stunning. Support for gay marriage is up 11 points in a single month, and up from 22 percent in March 2004. Those advocating second-class status for gay couples are headed toward “fringe minority” status. The biggest gain over this past month came among Republicans, who went from 6 to 18 percent support for gay marriage — still a significant minority in their caucus, but evidence that the efforts of Steve Schmidt and Meghan McCain are having an effect. If the GOP is to remain an ongoing concern in the future, it will have to evolve toward a more tolerant position on gay marriage.

McDonald’s Agrees To Training and Settlement After Staff Called Gay Customers “Faggots,” Super-Size Training For Management Offered After Kentucky Incident
LOUISVILLE, KY – Nine months after an employee at a McDonald’s restaurant in downtown Louisville called a group of gay customers a series of anti-gay slurs, the American Civil Liberties Union announced today that McDonald’s has agreed to a cash settlement and diversity training for management at 30 of its Louisville-area restaurants.
Ryan Marlatt, Teddy Eggers, and three other friends had stopped for lunch at a McDonald’s restaurant on East Market Street on July 26, 2008 while visiting Louisville for the weekend. While they waited for their food to be prepared, an employee behind the counter referred to them as “faggots” to another employee. When Marlatt and Eggers objected to the slur and asked to speak with a manager, the employee who had called them “faggots” started arguing with them, repeatedly calling them “faggots” in front of other customers and calling one of them a “cocksucker” and “bitch.”
“The reason we made such a big deal out of this to begin with was because we didn’t want it happening to anyone else, so I’m very glad McDonald’s management is going to be having these trainings,” said Eggers of Indianapolis, Indiana. “We were hurt and upset, but at least we’re adults and can handle being called names. We hated thinking that this kind of harassment might also happen to someone young and vulnerable who would really take it to heart.”
The supervisor on duty refused to refund the group’s purchase, so Marlatt attempted several times in the following weeks to contact both the general manager of the McDonald’s and the corporate offices, with no results. Louisville law prohibits discrimination on the basis of sexual orientation, so the ACLU filed a complaint in September on behalf of Marlatt and Eggers with the Louisville Human Relations Commission. In October, representatives of a variety of lesbian, gay, bisexual, and transgender groups as well as other civil rights organizations protested at the downtown Louisville McDonald’s where the incident took place.
Although Marlatt and Eggers only asked for $28, McDonald’s offered them $2000 each on its own, which they accepted, Sun said. The Louisville Human Relations Commission has been thoroughly investigating Eggers and Marlatt’s complaint since it was filed last September and helped negotiate the settlement between the parties.
“We’re really grateful to the Louisville Metro Human Relations Commission for its investigation, as well as to our friends at the Fairness Campaign, and commonGround at the University of Louisville, for keeping the pressure on McDonald’s to do the right thing,” said Michael Aldridge, Executive Director of the ACLU of Kentucky. “While we’re fortunate to have a law banning sexual orientation discrimination in Louisville, this goes to show that it’s still important to speak out and do something about it when your rights are violated.”
“McDonald’s could have saved itself a lot of embarrassment if they’d just done the right thing from the start and done something about this, but it’s great that so many people stood up for us and came forward to say treating people the way we were treated is wrong,” said Marlatt. “We just hope the trainings keep McDonald’s from letting this happen to any of their customers from now on.”
When their Louisville Human Relations Commission complaint was filed, Marlatt and Eggers asked for a refund of the money they spent on the McDonald’s meal, and asked that one employee – the cashier who objected to the other employee’s name-calling – be commended. “She was the only employee in the whole place who tried to help us,” said Eggers. “I hope she hears about this and knows how much we appreciated her sticking up for us.”
“While we wish Ryan, Teddy, and their friends hadn’t had to go through this whole experience to begin with, we’re glad that at least McDonald’s is taking steps to prevent anything like this from happening again in the future,” said Christine Sun, a senior staff attorney with the ACLU Lesbian Gay Bisexual Transgender Project who is representing Marlatt and Eggers. “Businesses should treat all of their customers with respect regardless of their sexual orientation.”
