Signals Commitment By Obama Administration To Protect Transgender Workers From Discrimination
WASHINGTON, DC – The U.S. Department of Justice decided not to appeal a federal court ruling awarding transgender veteran Diane Schroer the maximum compensation for the discrimination she suffered after being refused a job with the Library of Congress. The deadline for seeking an appeal was June 30. The American Civil Liberties Union has represented Schroer in her case.
The Obama administration’s decision whether to appeal the final ruling in the case has been closely watched in part because the Bush administration defended the case so vigorously, arguing that transgender Americans are not protected by any existing federal laws. The decision not to appeal the verdict is consistent with the Obama administration’s campaign promises to protect transgender workers against discrimination and his administration’s recent order taking steps to bar gender identity discrimination in federal employment.
“I am grateful that the court took the time to examine the case in detail and come to a fair and unbiased decision. In that same light, I am gratified that the current administration saw this for what it was, a case of sex discrimination focused against transgender people, and recognized that it must end in this country,” said Schroer, an Army Special Forces veteran with 25 years service. “The important signal that the administration’s decision sends to all LGBT individuals gives me renewed hope and restores some of my shaken faith in what our country stands for.”
On April 29, 2009, a federal court awarded Schroer maximum damages of $491,190 for back pay, other financial losses and emotional pain and suffering after finding the Library illegally discriminated against Schroer because of her sex. At trial, Schroer testified that she had applied for a position with the Library of Congress as the senior terrorism research analyst and was offered the job. Prior to starting work, she took her future boss to lunch to explain that she was in the process of transitioning and wished to start work presenting as female. The following day, Schroer received a call from her future boss rescinding the offer, telling her that she wasn’t a “good fit” for the Library of Congress.
“We are pleased and relieved that the Obama administration has decided to bring an end not only to years of hard-fought litigation but also to a painful chapter of Ms. Schroer’s extraordinary life,” said Sharon McGowan, a staff attorney with the ACLU LGBT Project. “The administration’s decision not to challenge this important civil rights ruling is a welcome sign that it intends to live up to its commitment to help end transgender discrimination in the workplace.”
The ACLU filed the lawsuit against the Library of Congress on June 2, 2005, charging that the library unlawfully refused to hire Schroer in violation of Title VII of the Civil Rights Act of 1964, which prohibits sex discrimination in the workplace. In an earlier ruling in this case, the court issued a groundbreaking opinion that discriminating against someone who transitions from living as one gender to another is sex discrimination under federal law. In reaching this decision, the court compared the discrimination faced by Schroer to religious-based discrimination, saying, “Imagine that an employee is fired because she converts from Christianity to Judaism. Imagine too that her employer testified that he harbors no bias toward either Christians or Jews but only ‘converts.’ That would be a clear case of discrimination ‘because of religion.’ No court would take seriously the notion that ‘converts’ are not covered by the statute.” The court also ruled that the library was guilty of sex stereotyping against Schroer because of its view that she failed to live up to traditional notions of what is male or female.
“This case put employers on notice that discrimination against transgender individuals is like any other form of discrimination – counterproductive and against our principles as a nation,” added Schroer. “But this case alone won’t end the rampant discrimination that transgender people face throughout the country. That’s why we need Congress to pass the Employment Non-Discrimination Act that was introduced last week.”
In addition to McGowan, the legal team consisted of Ken Choe, Senior Staff Attorney for the ACLU LGBT Project, James Esseks, Litigation Director for the ACLU LGBT Project and Arthur Spitzer, Legal Director of the ACLU of the Nation’s Capital.

Study: Gays not ‘godless Christian bashers’
This breaking news in from The Barna Group — a chronicler of religious life and habits, particularly of the Christian variety: Gay folks’ attitudes about spirituality aren’t much different from straight folks. These and other “surprising insights” were in Barna’s spiritual profile of gays released Monday. In it was a bit of a political heeding for gay-bashers:
“People who portray gay adults as godless, hedonistic, Christian bashers are not working with the facts,” wrote George Barna Monday. “A substantial majority of gays cite their faith as a central facet of their life, consider themselves to be Christian, and claim to have some type of meaningful personal commitment to Jesus Christ active in their life today.”
“It is interesting to see that most homosexuals, who have some history within the Christian Church, have rejected orthodox biblical teachings and principles — but, in many cases, to nearly the same degree that the heterosexual Christian population has rejected those same teachings and principles,” Barna said. “Although there are clearly some substantial differences in the religious beliefs and practices of the straight and gay populations, there may be less of a spiritual gap between straights and gays than many Americans would assume.”
Now there will be some quibbling with a couple of Barna’s assumptions. Like how Barna pegs the LGBT population at about 3 percent of the adult population. No, he doesn’t believe in the 1-in-10 stat, but then again, LGBT population scholar Gary Gates says it’s more like 5 percent, depending how you count.
That aside, the Barnanians found that “out of the 20 faith-oriented attributes examined in the Barna study, there were just a few in which there were no significant differences between the heterosexual and homosexual populations.”
Hmm. “No significant differences between the heterosexual and homosexual”(s)? Does Donald Wildmon know about this?
One big diff, according to the study: “While seven out of every ten heterosexuals (71 percent) have an orthodox, biblical perception of God, just 43 percent of homosexuals do. In fact, an equal percentage possesses a pantheistic view about deity — i.e., that ‘God’ refers to any of a variety of perspectives, such as personally achieving a state of higher consciousness or maximized personal potential, or that there are multiple gods that exist, or even that everyone is god.”
Another diff: “Heterosexuals were twice as likely as homosexuals to strongly agree that the Bible is totally accurate in all of the principles it teaches.”
And in the timeliness is next to godliness (OK, and cleanliness) dept: On Monday a crew of organizations supporting same sex marriage are launching their Get Engaged Tour of California — a pump-priming tour of the state in advance of an expected 2010 ballot measure campaign expected later this year. We told you about it a while back. Faith leaders will be prominently featured on this tour, as opposed to last year’s anti-Proposition 8 campaign, when they were largely invisible.
“Our faith-based values require us to love our neighbor as ourselves,” said Pastor Samuel Chu, of California Faith for Equality. “Gay and lesbian people are our neighbors and they should be able to enjoy the dignity, respect and commitment that come with marriage.”

Gay Muslims in the UK

With the advent of civil partnerships it is easy to forget that significant sections of the gay community in the UK live in fear. There are approximately 125,000 gay Muslims in the UK and most live with feelings of shame and guilt.
Although, leading clerics assert homosexuality to be against the teaching of The Quran, there are tentative signs of the beginnings of an acceptance within the Muslim establishment and the internet provides an important forum for gay Muslims to connect and support each other.
Most Muslims could never imagine that someone praying beside them at their local Mosque could possibly be gay. Islam teaches that homosexuality is evil, and as a result most gay men and lesbians will remain in the closet or choose not to follow their natural instincts. With around 1.25 million Muslims in the UK, it is estimated that the challenge of being homosexual in this community affects around 125,000 individuals every day.
This significant minority is likely to be living with feelings of shame, guilt and fear; aware of how their community will judge them and even ostracise them. Iftekhar Hai, Director of Interfaith Relations for the United Muslims of America, says that homosexuality is unnatural. He points to a verse in the Quoran where the prophet Lut says “For ye practice your lusts on men in preference to women: ye are indeed a people transgressing.”
“According to the scripture, there’s no doubt,” Hai said. “It’s not right and proper.”
However, there are now alternative views being expressed. A number of Muslim scholars are arguing that in the Quoran men are punished for raping and abusing other men, not for engaging in consensual gay sex. Indeed, it is argued that the traditional interpretations were made by heterosexual men, whereas there are now some gay Muslim writers coming out of the closet to redress the balance.
In the context of this oppressive environment, gay Muslims seek alternative means of support in the community. An example I came across recently is the website forum Al-Fatiha, a support group for gay Muslims. A short visit to this site reveals just how deep and complex the issues are. One posting reads:
“I feel like a rag doll in the middle of a tug of war, and for all of you who are in the same boat, you know what a difficult position this puts us in…I’ve come to realize that I cannot be the only one in the world in this predicament. So if you are a lesbian Muslim in a similar situation, I’d love to talk to you, and maybe we could help each other out.”
Sir Iqbal Sacranie, Britain’s most senior Muslim, described homosexuality as a harmful, immoral vehicle for spreading disease, so it is no surprise that the internet remains the only place where many gay or bisexual Muslims can reveal their true selves.
As part of a piece on gay Muslim life, The Times contacted members of this community and described it as “underground”. The article reveals a world where thousands of lives have been wrecked by sham marriages, lying, unacknowledged HIV and crippling isolation.
Among a number of powerfully descriptive stories, “Zac”, 24, tells how he has been prevented from living as a gay man. He describes how his parents had forced him into an arranged marriage with his Pakistani cousin in the hope that it would “make me straight”. He is now “trapped” at home with his pregnant wife, overwhelmed by feelings of frustration and resentment towards his parents.
But what about your experience?
The gay support group Al-Fatiha are embarking on a historic survey of Muslims who are lesbian, gay, bisexual, transgender, intersex, queer, and questioning or exploring their gender identity and/or sexual orientation (LGBTIQQ).
The results of the survey will tell Al-Fatiha about the muslim community, people’s experiences and concerns. The results will guide Al-Fatiha’s educational and advocacy work on behalf of LGBTIQQ Muslims, and will be shared with the entire community. To fill out the survey, click here.
It can be difficlt and confusing to come out in a faith which doesn’t allow you the freedom to be who you are, but in terms of the muslim faith, there are number of support groups who offer help and advice, including Imaan and Al-Fatiha.

Those self-anointed “Christians” are hating again in Alameda
Those self-anointed “Christians” who hate gays (and lesbians and bisexuals and especially transgender folks) are at it again.
This time they are out howling against a program in Alameda, CA designed to protect LGBT kids (and the kids of LGBT parents) from being harassed at school.
These “Christians” – who undoubtedly believe they hate the “sin” and not the “sinner” are nevertheless ready to crucify these children on the cross of political expediency and fund raising priorities. They don’t care what happens to LGBT kids (and the kids of LGBT parents). All they care about is their right to let their kids grow up to be bullies, haters and bigots. After all, where would their “Christian” church be if people didn’t hate gay folk?
There’s nothing in the Alameda plan that prevents parents from teaching their kids that homosexuality is against their religion, morally wrong or bad. What the schools want to teach is that (whatever you believe about homosexuality) you can’t beat kids up because they are LGBT kids (or the kids of LGBT parents.
Is this a measure of acceptance? Only if you believe that the alternative of having kids bullied – sometimes to the pint of suicide – is acceptable in a country that claims to be the “Land of the Free,” let alone a “Christian nation.”
Protesting LGBT kids (and the kids of LGBT parents) is not negotiable. It is a whole lot closer to what Jesus had in mind than the empty rhetoric of these far right law firms that exist only to raise money by demonizing LGBT people and their allies.

Panel backs transgender woman in restroom case in Maine
AUGUSTA, Maine — The Maine Human Rights Commission decided Monday that a transgender woman was discriminated against at a Denny’s restaurant in Auburn when management would not let her use the ladies room until she had sex reassignment surgery.
While the lawyer representing the Denny’s owners said that the 3-2 decision could have far-reaching, negative consequences for all Maine businesses with shared restroom facilities, it was hailed as a civil rights victory by the Maine Civil Liberties Union and advocacy organization Equality Maine.
“It’s important to know that people have rights, including transgender [people], and that businesses are not free to discriminate,” said Zachary Heiden, the legal director of the MCLU.

Revisiting 1969 and the Start of Gay Liberation
On Friday afternoon, officials from the National Gay and Lesbian Chamber of Commerce rang the closing bell at the New York Stock Exchange to commemorate the 40th anniversary of the Stonewall uprising and also to honor Lesbian, Gay, Bisexual and Transgender Pride Month.
The embrace of the gay rights movement by Wall Street — the title of the stock exchange event was “From Stonewall to Federal Hall” — was a striking example of how much things have changed for lesbians and gay men in four decades. The change is brought into relief in a monthlong exhibition, “1969: The Year of Gay Liberation,” that opened June 1 at the New York Public Library.
Using the Stonewall uprising, which began in the early morning hours of June 28, 1969, as a starting point, the exhibition focuses on the pivotal months that followed, charting the emergence of a new strain of militant activism — exemplified by groups like the Gay Liberation Front, Radicalesbians and the Street Transvestites Action Revolutionaries — that expressed a new vision of gay freedom.
The activist vision of that era, the exhibition suggests, was more far-reaching than the so-called homophile movement, which had used a more cautious approach, and also more critical of societal institutions like the family than the contemporary gay rights movement, which has been dominated in recent years by the debate over same-sex marriage.
Jason Baumann, who curated the exhibition and also coordinates the extensive collection of gay materials in the library’s Manuscripts and Archives Division, contrasted the new exhibition with “Becoming Visible: The Legacy of Stonewall,” the library’s landmark show in 1994 on the history of gay and lesbian life in New York.

Mike Gin, Redondo Beach’s Chinese-American, Rotarian, Gay Mayor
After months of living legal limbo, Redondo Beach Mayor Mike Gin’s marriage was finally declared legal several days ago by the California Supreme Court. But marital validation was no tonic for Gin, who wasn’t celebrating the landmark decisions on same-sex marriage issued last week by the California Supreme Court.
“It’s a bittersweet feeling,” he admits. “My husband and I are thrilled about that part of the ruling that affects us, but there are many other couples now who cannot share in the happiness that we were able to experience on our wedding day. I’m hoping that someday all of us can experience that same happiness.”
Gin and his husband, Christopher Kreidel, were part of the pool of approximately 18,000 gay people married after the California Supreme Court ruled a year ago that same-sex marriages were legal, but before the Proposition 8 vote last fall banned same-sex marriage.
Despite the ruling early last week upholding Prop. 8, he is not discouraged. He notes that Prop. 22, the long-standing gay-marriage ban overturned by the courts last May, passed in 2000 with 60 percent of the vote, while Prop. 8 passed with only 52 percent.
“I think it is still a very strong social issue on both sides in our society right now,” he says. “But the voting numbers show that as a society we’re moving in the right direction.”
Gin is an unusual public official in that he is gay, married, Asian-American — and popular at a time when California politicians are reaching new lows in approval-rating polls. After serving eight years on the Redondo City Council and four as mayor, Gin has developed a reputation as a classic old-school politician who listens patiently to residents, considers a wide array of arguments and interests before making a decision, and goes out of his way to avoid confrontation.

Voices of Witness Africa New documentary tells stories of gay Anglicans
Voices of Witness Africa is a new 30-minute documentary intended to help Episcopalians listen to the views and experiences of Anglicans who are gay, lesbian, bisexual and transgender (GLBT) and to emphasize that homosexuality is “not just a North American or European issue,” says the Rev. Cynthia Black.
Co-produced by Black, rector of Christ the King Church in Kalamazoo/Texas Corners, Michigan, and Katie Sherrod, a writer and commentator based in Fort Worth, Texas, the documentary features GLBT Africans who talk about their lives and their relationships with God and the church.
“The voices of LGBT folks from around the world need to be heard,” says Black.
Among those interviewed for the documentary is the Rt. Rev. Christopher Senyonjo, retired bishop of the Diocese of West Buganda in the Anglican Church of Uganda, who leads a study and prayer group for gay Anglicans. “I’m sorry about what the church is saying. God loves you, God loves you,” Senyonjo says in support of GLBT Christians. While he acknowledges that speaking out has been “very risky,” Senyonjo adds, “When you know the truth, it should make you free.”
Although homosexuality is illegal in most African countries, “several people in the film cite cause for hope,” said a news release from the Chicago Consultation, a sponsoring organization of the documentary.
“Many, many years ago, when the townships were in smoke and people were dying, we never thought that we would be where we are now,” Yvonne Daki, manager of iThemba Lam Center of Inclusive and Affirming Ministries in South Africa, says in the documentary. “We will have one day a situation where gay people can speak openly about their sexuality.”
For Black, one of the surprises when working on the documentary was “how willing participants were to have their name and image used publicly, even when they knew their bishop would be receiving a copy of the film, and even when there could potentially be horrific consequences for doing so … Their courage is incredible.”
Sherrod was most impressed how the interviewees’ faith “informs their actions every minute of every day. All of them spoke of God as a intimate part of their lives, a presence who gives them hope and strength in the face of terrible oppression and active persecution, not only by the state, but in most cases by the Anglican church leaders in their country. To witness the depth of their faith was inspiring and humbling.”
“Viewers who have followed the plight of GLBT people in Africa will hear familiar and tragic stories of fear, imprisonment and abuse,” the Chicago Consultation news release said. “However, they may also be surprised by the support and hope voiced by some of the film’s subjects, including African Anglican bishops and priests.”
Black said that much inspiration can be found in the stories of hope that were heard — “hope that one day the church will have moved beyond the issues of sexuality that divide it.”
All the instruments of communion have supported a process of listening to the experiences of homosexual people throughout the Anglican Communion. At the 1998 Lambeth Conference, resolution 1.10 committed all the provinces of the Anglican Communion to a listening process. It was not until 2005 that the Listening Process was officially launched with the appointment of a facilitator who would monitor the work being done, share the results and enable further listening.
The Anglican Consultative Council, the communion’s most representative policy-making body, met in Jamaica in May 2009 and supported the renewal of the Listening Process, which has received a 2.5-year grant from the Satcher Health Leadership Institute at the Morehouse School of Medicine in Atlanta, Georgia to run five “pilot conversations” around the communion.
The “Voices of Witness Africa” documentary is being released just before the Episcopal Church’s General Convention, which will be held July 8-17 in Anaheim, California. “At the meeting, deputies and bishops will discuss both the church’s mission in the developing world and the inclusion of gay, lesbian, bisexual and transgender people,” the Chicago Consultation news release said. “The film is being mailed in advance to all deputies and bishops. It is also being mailed to all bishops of the Anglican Communion, including those who lead churches that are hostile to GLBT Christians.”
“With General Convention approaching, some people focus on what effect its actions might have on the part of the Anglican Communion that is more conservative than the Episcopal Church,” said Black. “I think the film helps us to remember that there are hundreds of thousands of LGBT folks in the communion who are watching what the Episcopal Church does.”

SD Evangelical Lutheran Church Synod Votes To Keep Current Policy On Gay Clergy
The South Dakota Synod of the Evangelical Lutheran Church of America voted today to uphold its current policy, preventing gay and lesbian clergy from being in a committed relationship while serving as pastors. The vote is only a recommendation from the South Dakota Synod. The recommendations will be taken to the ELCA national assembly in August.
Pastors and church members on both sides of the issue voiced their concerns before voting at the annual Assembly.
Nearly 800 members of the South Dakota ELCA gathered in Sioux Falls for the annual assembly. But, this years agenda included a heated debate: whether to support allowing gay and lesbian clergy to serve as pastors *and be in a committed same-sex relationship.
“I think we really need to wrestle with a new vision here,” Pastor Mindy Ehrke of Salem Lutheran Church in Mount Vernon said.
“As a Christian person, as a teacher, I need to turn to the word of God,” Pastor Daniel Ostercamp of St. John’s Lutheran Church in Webster said.
ELCA members were here to debate and vote on two resolutions: one would reject a change to the social statement and current teaching documents on sexuality, the other would reject a change in ministry policy to allow gay clergy in relationships.
One by one, church members and delegates stepped up to floor microphones to defend what they believe South Dakota should encourage.
“I think that we all need to take a step back and look at the other words that god’s taught us, love your neighbor as yourself, I think we all need to take a look at that right now,” Kristin Ackermann, member of Shalom Lutheran Church in Harrisburg, said. March For Gay Marriage In Fresno Hundreds of same-sex couples gather in the state’s conservative center.
Hundreds of same-sex couples and their supporters marched Saturday through dusty California farm towns, gathering in the state’s conservative center to push for gay marriage in less hospitable areas. Just days after the state’s highest court upheld a ban on gay marriage, advocates vowed to win the hearts and minds of those who reject their unions. They are pledging to put a new initiative before voters to overturn the ban, perhaps as soon as next year. The weekend-long event has attracted the movement’s most well-known activists and celebrities including Charlize Theron and Eric McCormack. It was organized by a lesbian mother in Fresno who was removed from the parent-teacher association at her son’s Roman Catholic school after she spoke out against banning gay marriage. “Fresno represents middle America values, and we can start changing our neighbors’ feelings about gay marriage beginning right here in the Central Valley,” said lead organizer Robin McGehee, a 36-year-old college professor who married her longtime partner last year. “We’re doing exactly what the freedom riders would do in the South in the 1960s, which is reaching into communities that are different from us so we can all live in equality.” Gay activists believe their campaign against Proposition 8 focused too much on liberal urban enclaves along the coast, failing even to reach out to the state’s rural regions. The measure passed with nearly 69 percent of the vote in Fresno County, compared to 52 percent statewide.
