Gay Democrats in the US state of Florida have urged Attorney General Pam Bondi and Governor Rick Scott not to appeal against a ruling which struck down the state’s same-sex marriage ban.

District Judge Robert Hinkle ruled the 2008 voter-approved ban is in violation of the constitutional guarantee of equal protection and due process.

The judge immediately stayed his ruling pending appeals.

Despite that GOP leaders have not said how they will approach the new ruling, which was one of various against the ban, Democrats on Friday said they should allow the ruling to remain.

Representative Joe Saunders, an openly gay Democrat, and one of two gay members of the legislature, said: “I hope both [Governor Scott] and Attorney General Bondi stop politicking and get on the rights side of history.”
