US: Judge strikes down Michigan’s ban on same-sex marriage

    I’ve just finished reading the judgement and it’s a good read! The judge tears apart the state’s rationale for the ban and he even gives Regnerus the judicial equivalent of a smack in the mouth.

    That’s now five states where marriage amendments have been struck down and another three at least where there have been decisions that favour SSM whilst not dealing with the bans directly. I just hope it’s all upheld throughout appeals.

    This is a big deal. I believe that this judge is the first Republican appointee to strike down a same-sex marriage ban in Federal Court.

      He is not the first Republican appointee to strike down a same-sex marriage ban in Federal Court. Indeed, probably the majority of the rulings have come from Republican appointees because there are more of them. Judge Vaughn Walker of Prop 8 fame was a Republican appointee. The judges who recently struck down marriage bans in Utah, Oklahoma, and Kentucky were all Republican appointees.

        Actually the guy in Utah was appointed by Obama and the one in Oklahoma by Clinton. In Kentucky the SSM ban hasn’t been struck down either although that judge was appointed by daddy Bush.

        The Texas guy was another Clinton appointee and the lady in Virginia was Obama’s. Friedman is the first Republican appointee (Reagan) since SCOTUS decided Windsor to strike down an SSM ban and that is significant since it shows both Democrat and Republican justices are interpreting Windsor in the same way. That makes it more difficult for the lunatic fringe of SCOTUS to argue the other way though I’m sure they will.

          Thanks for sharing your knowledge. This is all the more reason to make sure a DEMOCRAT is in the White House. Anyone who whines that there’s no difference between the two parties clearly isn’t interested in discovering how different they really are.

        Sorry, but that’s simply not true. The judges in Utah and Oklahoma were both Democratic appointees. While Walker was a Republican appointee, as a gay man himself you have to admit he was a little bit more likely to rule on our side that the average Conservative. The fact that a Republican appointee in Michigan would strike down this law using the same arguments as the Democrats before them is a huge deal for this movement.

    They are all unconstitutional, they were always unconstitutional. Did anybody seriously think you could just ignore the 14th amendment, or say that somehow equality for all didn’t include people who are gay? What we’ve got now is a more informed and legally defensible interpretation. In the early days of the 14th amendment, and for fifty years, they considered that “separate, but equal” was acceptable. Rosa Parks could take the bus, and she would get from A to B, but there was nothing wrong with requiring her to sit at the back of the bus. Today, right-thinking human beings reject that as unacceptable discrimination.

    Another falling domino being lined up. There will of course be an appeal, there always is, but one by one the US states will bring in equal access to marriage.

    There will be many “Christian fundamentalist’s” frothing at the mouth after reading that paragraph, my guess is that it is going to be cited in many, many more cases before the Courts this year. I personally loath Regnerus and the frauds that keep him in money, I have waited 40 + years to see this come, but come it has.

The funder clearly wanted a certain result, and Regnerus obliged”. Yes, branded to the world as the lying fraud that he is, finally. That is the kiss of death to his credibility and I suspect his career too.
