I would assume if I’m reading this judge’s decision correctly that if a suit is brought to defend the ban, those bringing it will have to prove that allowing same-sex marriage will cause significant harm to marriage and to the state. That’s going to be a very difficult thing to prove with 16 states and one jurisdiction allowing it and perhaps it will be reason for the court to strike down the ban.

The judge wants Penn to squirm and cough up $$ for a defence, money that could be used elsewhere for better purpose. Penn is being taught an expensive lesson.

Obviously, the defendants have money to burn, just like that awful American hate group, NOM. It’s mind boggling that their hatred of SSM could cause them to throw a lot of money at a losing battle as one state after another legislates it into law. You’d think they would have learned a lesson already. It’s going to be a bit more difficult now that the majority of the 31 red (republican) states where there is a ban have republican governors from what I’ve read. all of whom I would assume would veto any bill. Nasty people.
