  2. If he is a minor, shouldn’t he be taken away from her? He is obviously still in physical danger and mental danger from this mad woman.

    They could then interview him and proceed further if needed.

    It is hard to believe she can assault him so badly and then have the right not to let police see him.

      I was thinking the same thing. I’m a social worker in Canada and here that absolutely would have happened. The mother would be in jail and the son would be taken into care by some foster family that could help him embrace who he is. If that child was the child of someone of influence, be sure the outcome would be different! USA only works for the rich and the strong.

    In most jurisdictions in the United States this act would be potentially considered “Statutory Rape” which applies to sexual acts when one of the participants is under a certain age, “age of consent”, where if they are younger than such age they are not deemed able to consent to specified acts (such as entering contracts or here, sexual activity). Under Texas Penal Code – Section 22.011 this is 17 years old for sexual acts. Also under that section it is an “affirmative defense” to a charge (which would be against the older cousin) that at the time of the act he “was not more that 3 years older than the “victim” . . . ” This may be why there have been on charges filed against the older cousin. Technically, as an affirmative defense, the police could still arrest and charge him and he would have to raise it (and prove it) at trial. There are other requirements for this defense which likely do not apply (at least nothing mentioned in the article).

      Hopefully (and especially in light of the reaction of the mother now facing charges) they will not do so as it would still appear as an arrest on his record which creates additional problems in and of itself, especially when it is for a sexual crime. As for the claim by the mother regarding the inappropriate (and possibly illegal – counseling on the commission of a crime by an officer of the law) it may be fictitious, but given Texas’ reputation for overlooking violence in domestic situations (especially stories regarding infidelity and catching the participants in the act) it is possibly true.

It is not hard to imagine this Texan woman is homophobic but I’m inclined to believe her when she says she would have reacted in the same way id she had found her cousin licking out (I paraphrase) her 15 year old daughter. I don’t excuse her. The cousin was of a similar age and the act was seemingly consensus. I think she should be done for GBH.

  13. I feel sorry for kids in homophobic, transphobic, heterosexist and gendernormative Texas. And it has to be remembered that Texas was born as a rogue state as it was stolen off the Mexicans all because the white settlers wanted to expand their vile slave trading activities into Mexico which had already abolished slavery by the 1830s. Now we know where Hitler got his ‘lebensraum’ ideas from and it does indeed seem from the homophobic, child abuse-accomodating attitude of the officer featured in this story that the Texan law enforcement agencies are indeed populated by those whom would not be that out of place in the SS.
