The “money” is not cash/child support for the mother. There is no “money” to be given back. It is the requested services through the state that caused the “donor” to be brought in. The state is suing for “reimbursement” because the one mom is looking for health insurance for their kids. The state wants to recoup their money from the sperm donor, the one the states claims is the 2nd parent.
This is one of the many unequal consequences from the denial of civil rights (marriage) for gays.
The 2nd parent has health insurance. But… because they are “gay”, they could not marry nor could she legally adopt their children.
Because of this legal (unequal) consequence, she cannot put HER children on HER health insurance, which would end this outrageous “sue the sperm donor” result/insanity.
