Why is it we recoil in horror when we hear of retribution being meted out in places like Iran, yet holler like a lynch mob at home? Shooting another child for any reason is appalling, but incarcerating a 14 year old for 21 years is pretty steep punishment, for little benefit. And September wants more.
And do you really think that this child’s homophobia was the result of his mature reflection. or perhaps fed him by those around him?
This is a horrendous tragedy – and blame should be well spread out, parents, school, community, those with guns, media etc..
I was going to agree with September – because I am angry. But then I read your post. You make good points. McInerney is not an independent adult and his attitudes are reflection of those in authority – who will, it seems, learn nothing from the destruction of two young lives.
its a sad case on a few levels….that a 14 year old could have access to a gun like that is sad….that a life is lost and another destroyed forever is sad….and two families will suffer for the rest of their lives is sad, too.
Hope this sad case will teach a few lessons about guns, anger, intimidation, prejudice, ignorance and hate….and that one day, we may see it all disappear.

But what good will locking this juvenile up for a full 21 years achieve? What chance is there of this child ever contributing to society if we lock him up from the ages of 14 to 35?

At the very least, it sends a powerful deterent message that such criminal behavior, regardless of the age of the criminal will not go unpunished or be given a token slap on the wrist!
The right to bear arms is a right in America unfortunately, actually a distortion of an amendment in the Constitution which at the time of the revolution in 1776 against the British, applied only to the militia, not ordinary citizens in today’s society. Access to guns is relatively easy even though some states have tightened laws.. Some states don’t even do thorough background checks on people who purchase them. This 14 year old either found the gun at home, assuming his father owned one, or it was stolen. From what I know of American gun laws, guns and shotguns have to be stored under lock and key when not in use and the ammunition removed. Obviously this was not the case.

Not enough. He went out to kill, knew he was going to kill therefore should have been given a life sentence… you know like he would have done if the victim was straight.
Yes he is remorseful but being remorseful doesn’t being back the victim so why should he have a comfortable life. This isn’t as simple as he just made a mistake, he took a life and maybe harsher punishments would start to act as a deterrent.
There is a lot of evidence to suggest that harsher sentences do not deter people from committing crime. He has already received a harsher sentence than usual as he was tried as an adult.
America needs to think about how important the right to bear arms is and if that necessarily means gun ownership in any case. It also needs to educate young people about homophobia.
If either one of the above had been implemented sooner their wouldn’t be a victim to mourn.

If McInerny has any brothers or sisters they should be removed from their parents as they are clearly unfit to parent.
This is a clear case of premeditated murder – period. No amount of justification and attempts to “explain” or to claim “extenuating circumstances” can mitigate this behavior.
I do agree with you all that this was straight up murder, not manslaughter, but I think it’s important to try to understand exactly why McInerney recieved the convictions he did.
The way I understand it, pursuing the plea bargain was an act of practicality for the courts. Court cases get fouled up all the time, and it is very difficult to convict someone with murder (which requires an insight into their thought process) as opposed to manslaughter (which is simply the act), much less a minor.
Let’s face it, killers like McInerney slip through the hands of the law all the time, either through botched trials or woefully inadequate sentences. In this case, the killer has been sentenced to two decades behind bars, for a murder he perpetrated while he was a minor, with no possibility of his sentence being reduced.
Taking into account all of the weaknesses and failings of the court system, that’s a fairly solid result. Should it be longer? Possibly. Should he have been convicted of murder? In an ideal world, where the principle counts as much as the results.
Unfortunately, this isn’t an ideal world, and killers walking off scot-free after a mere decade (or even less) isn’t an irregular occurrence. Bearing that in mind, I’m glad that at least some justice has been done. I just hope more is done to PREVENT murders like this happening in the first place.

This young killer is the product of Christian propaganda taught and preached to him and his parents and others, Christians teach hate and killing of LGBT people. The anti gay hate that Christians have in America is a very old and slow growing cancer that if not treated will destroy America and other countries. Simply put teaching children to hate and kill gays is insane. There is not winner here only losers with the Christians to blame for teaching and preaching children and adults to hate and destroy anybody who is different. This is what America is showing the world, that is is homophobic and hateful and can kill anybody they do not like. The bully on the planet who tries to tell people he is really the good guy, but some of us are smart enough to see through the false propaganda and lies.
So this bigot murders a gay child in cold blood from behind and now he is going to prison, where he will have unlimited gay sex, against his will, one can infer…..ironic, don’t you think? He should have been given life since the murder was clearly planned ahead of time…in the US that is called murder one…usually results in a death sentence or life in prison without parole…but since he only murdered a “fag” it is “not so bad”! At 14, it’s a fair assumption that his views have been handed down to him from parents, school, society etc. They’re unlikely to have been formed from mature reflection. We’ve got to remember the two boys jailed for the murder of Jamie Bulger in 1993. They were given an eight year tariff extended to 15 years by the then Home Secretary which they successfully appealed against. They were 10 years old at the time, just above the age of criminal responsibility in England. In Trondheim, Norway two six-year old boys killed a five-year old girl. They were back at school a month later. The age of criminal responsibility in Norway, a country with a fantastic gay rights record is 15 – which would have ment that Brandon McInerney would probably have got off scot free.

why not invent something like “the homophobe panic defense” ? like, ‘i was afraid he was going to kill me, so i killed him’ or something as minor as ‘i was afraid he was going to jeer at me, i didn’t know what to do, so i shot him’.
If 21 years sounds rather harsh considering that he was only 14 when he commited the crime, then what does that make the penalty for homosexuality in Iran? At least he will still be young when he is released. Gay men in Tehran can expect to find themselves hanging from the jib of a crane.
