  1. So what happens if the judge decides the ban is illegal? Will gay marriage be legal again?

  2. I hope this all gets changed for the better.. A groups right should never be decided by false “facts” and religious hatred. Its sad society has been ruled for so long all because of bigoted interpretations of stories that are suppose to make people “good” but instead are used as tools to instill anger and hatred in people.

  3. Marcus, the case proponents will ask that SS marriages be immediately resumed if prop 8 is found to be in breach of the Constitution but in my opinion even if Judge Walker finds in favour of the proponents, he is unlikely to allow marriages to resume… His decision might be stayed by higher courts anyway — the Supreame Court would be most likely to stay the decision until it has had the chance to rule on it. .

From what I’ve read, if Judge Walker rules Prop 8 unconstitutional, the Pro 8 forces will immediately file an appeal with the 9th Circuit Court of Appeals and request a stay. The stay will probably be granted. If it isn’t, the 9th Circuit would say how long the state has to reinstate SS marriage. The best source for info on this case is http://prop8trialtracker.com/.
