    After months of speculation, the Political Affairs Committee in the Lower Chamber of Parliament has requested fellow law makers to consider scrapping the article on homosexuality from the penal code in conformity with the International Charter on Civil rights, The New Times can exclusively reveal.

    The President of the Political Affairs committee; Bernadette Kanzaire told  parliament yesterday that the United Nations AIDS (UNAIDS) council had requested the government to scrap the article pointing out that it was contrary to articles 16 and 26 of the United Nations Covenant on Civil and Political Rights that seek protection of all citizens with disregard to sex, religion and others.

    “All persons are equal before the law and are entitled without any discrimination to the equal protection of the law.

Rwanda’s legislature is in the process of revising its 33-year-old penal code.

**A 48-hour marathon by the Parliament of Rwanda to criminalize homosexuality is under way**

URGENT CALL TO ACTION

CALL FOR THE IMMEDIATE WITHDRAWAL OF ARTICLE 217 OF THE DRAFT REVISION OF THE RWANDA PENAL CODE ACT WHICH CRIMINALIZES HOMOSEXUALITY

Horizon Community Association (HOCA), an LGBTI organization in Rwanda, in collaboration with the Coalition of African Lesbians (CAL) and the International Gay and Lesbian Human Rights Commission (IGLHRC) calls on all human rights defenders, organizations, governments, civil society, globally, to immediately take action against a proposed article in the draft Penal Code Act in Rwanda which would criminalize homosexuality.


Background
In November 2009, a draft revision on the Penal Code Act of Rwanda was tabled in the Parliament of Rwanda. Article 217 of the draft act would introduce new, oppressive legislation—the criminalization of consensual same-sex acts and relationships as well as criminalizing the work of LGBT human rights defenders. Homosexuality has never been a crime in Rwanda.

The lower house of the Rwandan Parliament will hold its final debate on this draft code Wednesday December 16, 2009. A vote on this draft code will occur before the end of this week.

Article 217 reads:

Any person who practices, encourages or sensitizes people of the same sex, to sexual relation or any sexual practice, shall be liable for a term of imprisonment ranging from five (5) to ten (10) years and fine ranging from Two Hundred thousand Rwanda Francs (200.000 RwF) to one million (1,000,000)Rwanda francs.

This article is a violation of basic human rights and is contradictory to the Rwandan Constitution as well as various regional and international human rights treaties and conventions. This proposed law stands in direct conflict with the rights to human dignity, personal freedom (Article 12), Equality (Article 16), Expression (Article 18), and Privacy (Article 22) ensured by the Rwandan Constitution, and in particular, Article 22(1), which states that “the private lives of individuals shall not be infringed upon in any way.” Likewise, this proposed article is counter to the guarantees of nondiscrimination and equality before the law in Articles 2, 3, and 28 of the African Charter on Human and People’s Rights. Furthermore, laws criminalizing and detentions of people because of consensual sex between persons of the same sex are arbitrary and violate Articles 2 and 26 on the rights to equality before the law, freedom from discrimination, and privacy of the International Covenant on Civil and Political Rights (ICCPR), to which Rwanda is a party (Toonen v. Australia, 1994).

If the new Penal Code includes this provision, it will also hinder the implementation of the Rwanda National Strategic Plan on HIV and AIDS by the National Commission of Fight against AIDS (CNLS), which is currently considering the inclusion of Men who have Sex with Men (MSM) in the plan. A law of this nature would be a major setback to the Rwandan Government’s commitment to national unity, tolerance, inclusiveness, dialogue, social cohesion and security among Rwandan citizens and residents.

		<description>I think it is sad to see how some people wish to label societies as more or less civilised. To say, for example, that African societies are in some way less valuable than our own.

This is very short sighted in many ways. Africa is an absolutely vast continent which contains very many cultures.

The twentieth century in Europe was a period of truly monstrous inhumanity. It was as a result of that massive human atrocity the holocaust that social liberalism became accepted in the post war years of Western Europe. However even after the holocaust we have of course seen further atrocities in Serbia.

We are not in a position to point the finger at African societies and accuse them of being inferior.

The homophobia in Rwanda and Uganda is no different from the homophobia that we see anywhere else.

We are much better to address the homophobia as it is than to say that it is some unique product of &quot;backward&quot; societies. We are very stupid if we believe that Europe has advanced beyond this behaviour.

I believe this homophobia is alive and well in Europe but it is biding its time.

The British Conservative Party is fuelling homophobia in Poland just as stark as that in Uganda by forming a tiny European grouping with the Polish Law and Justice Party. There is nothing civilised about advancing homophobia in another part of Europe and then pretending in your own country that it is not what you are doing.</description>

I for one am Glad I was born in the UK at the middle end of the 20th Century.  For all this country&#039;s faults, I am not going to be tortured and killed by the Govt because I love another man, my friends and family are not going to be put in prison because they love me!</description>

WQill it be safe for gay people to visit Rwanda in the future? The Rwandan Government has also interferred with the formation of the Rwandan Green Party as well. It seems that Africa is being taken oiver by Christian and Muslim Religious fundamentalists!</description>

These can be found in every society in the world.

Given the right circumstances they can thrive.

We have seen this in Europe.

I grew up in Northern Ireland which was entirely white at that time apart from a small chinese community. There was a great deal of homophobia, trust me. No Africans around at all!

We cannot say that a country or a continent is inherently more or less homophobic than another.

All countries have homophobic people within them. Sometimes those people can take power and then do great damage.</description>

There is no such thing as claiming the will of the people in legislating human rights violations; the Nazis used that excuse and they were ultimately held individually responsible for violating human rights. It is the only true way to enforce human rights; otherwise many politicians would routinely violate all sorts of human rights for any number of groups.</description>

I doubt very much that cutting government aid to these societies will have any influence but rather it would be a monstrous act which hits out most likely not at the law-makers but rather the poorest people in the countries.</description>
