This doesn’t excuse it, but what’s with the attacked guy saying he didn’t wake up until he was naked after falling asleep fully clothed? He must have been pretty messed up. WTF? I have to wonder what kind of party it was. If everyone was as baked as he may have been, the whole thing shouldn’t come as much of a surprise to anyone.
Pumpkin Pie – you’re right; but unfortunately in Scotland, until our new Sexual Offences (Scotland) Act 2009 comes into effect next year, the legal term for male rape is still “sodomy”. In England and Wales, the crime of rape was extended to include male rape in 1994, but the Scottish Office refused to do that for Scotland, and it’s taken 10 years of campaigning since devolution to get these offensive terms like sodomy and gross indecency finally removed from Scots law.
Incidentally, related to comment 2, the new Act quite rightly makes it absolutely clear that the fact that the victim was drunk or drugged is no defence whatsoever to a charge of rape.

what was it Diamanda Galas said about rapists: ‘I don’t care who you are or what you’ve been through. you need tied to a tree and tortured.’
“Sodomy”? I beg your pardon? It’s the 21st century. Using such a loaded term is quite offensive to those of us who enjoy consensual anal sex.

Oh, I see. I forgot this was in Scotland. I thought that judge was just being old-fashioned!
