Two former lesbian lovers have been jailed for making false claims against a man who subsequently spent two weeks in custody last August.

25-year-old Kerry-Ann Austin, of Leyfields in Lichfield, was sentenced to two months in jail after lying to the police about her husband, Paul, breaching a restraining order not to contact her.

Her former partner Louise Howes, 29 – sister of Paul – was also given the same sentence.

Both Austin and Howes, of Forrester Close, Lichfield, admitted perverting the course of justice

According to the prosecuting lawyer, Miss Rena Smith, on August 17th the two women saw Mr Austin driving past in his car.

In order to keep their relationship a secret, the two lovers fabricated a lie about Mr Austin and told police he had threatened and abused them.

As a result, Mr Austin was taken into custody, and only released on bail two weeks later.

The two women voluntarily retracted their statements and confessed to the lie shortly afterwards.

Austin later said in his victim impact statement that the two women needed to be punished.

“This is an extremely serious matter, because it cuts at the root of the court system,” said Judge Michael Dudley when sentencing the pair, according to the Lichfield Mercury.

“This was a deliberate act on the part of you both, initially on the spur of the moment, but you decided what was going to be said.”

The defence lawyer for Mrs Austin, Paul Mytton said his client – mother of three children from the marriage – did everything she could to avoid her husband, who she said had found the end of their marriage difficult to accept.

Mr Mytton added that his client never thought Mr Austin would be remanded in custody.

For Howes – who remains in contact with her brother – defence lawyer Hugh O’Brien-Quinn said his client was remorseful for her actions.

“It was not her argument – she (Howes) backed up her friend and partner. She doesn’t blame her co-accused because she knows she is responsible for her own actions,” he said.
